MINUTES OCTOBER 21, 1980 The Planning Commission of the City of Campbell convened this day in regular session in the regular meeting place, the Council Chambers of the City Hall, 75 North Central Avenue, Campbell, California. ROLL CALL Present Commissioners: Pack, Meyer, Kasolas, Fairbanks, Chairman Campos; Principal Planner Philip J. Stafford, Planner I Tim J. Haley, Engineering Manager Bill Helms, City Attorney J. Robert Dempster, Recording Secretary Linda Dennis. Absent Commissioners: Dickson and Kotowski; Planning Director Arthur A. Kee. APPROVAL OF MINUTES October 7, 1980 Commissioner Meyer moved that the minutes of the regular Planning Commission meeting of October 7, 1980, be approved as submitted, seconded by Commissioner Kasolas and unanimously adopted. COMMUNICATIONS Mr. Stafford reported that communications received pertain to specific items on the agenda and would be considered at that time. CONSENT CALENDAR Mr. Stafford stated that there are no consent items to be considered this evening. ARCHITECTURAL APPROVALS S 80-22 Continued application for approval of plans and Citti Florist elevations to allow construction of an office and retail building on property known as 1603 S. Bascom Avenue in a C-Z-S (Commercial) Zoning District. Mr. Stafford briefly reviewed the application for the Commission, stating that revised plans have not been received; therefore, Staff is recommending a continuance. It was moved by Commissioner Pack, seconded by Commissioner Kasolas and unanimously adopted that S 80-22 be continued to the Planning Commission meeting of November 4, 1980 in order that revised plans could be submitted. -2- PUBLIC HEARINGS PD 80-06 This is the time and place for a continued Calvary Temple public hearing to consider the application of Rev. Lloyd Hastings on behalf of Calvary Temple, Inc., fora planned development permit and approval of plans, elevations and development schedule to construct a day-care center and assembly hall on property known as 202 Railway Avenue in a P-D (Planned Development/Industrial) Zoning District. Mr. Stafford reviewed the application for the Commission, stating that this item has been continued from the Planning Commission meeting of October 7, in order that revised plans could be submitted by the applicant. Although revised plans were not submitted, it was noted that the Commission has received four letters pertaining to this development, three of which were included in the agenda package. Chairman Campos requested that the Recording Secretary read the fourth communication into the record. The Recording Secretary read into the record a letter from Dr. Robert D. Burchfiel of 642 E. Santa Clara Street, San Jose, a copy of which is attached hereto and made a part of these minutes. Commissioner Pack asked staff if there had been any conditions stated for the applicant, other than the usual, since no conditions had been included with the Staff write-up; did Staff suggest any kind of fence barrier or wall between the church property and the property at 219 Dillon Avenue. Mr. Stafford stated that Staff had discussed a possible masonry wall with the architect of the project; however, no specific condition had been set as yet. He then reviewed the location of the site for the Commission, noting that the area is zoned P-D (Industrial). Chairman Campos opened the public hearing and asked if anyone in the audience wished to speak for or against this item. No one wishing to speak, it was moved by Commissioner Kasolas, and seconded by Commissioner Meyer, that PD 80-06 be continued to the Planning Commission meeting of November 4, 1980. This motion was unanimously adopted. UP 80-27 This is the time and place fora public hearing R. G. Smithson, to consider the application of R. G. Smithson, Inc. Inc., for a use permit and approval of plans and elevations to allow construction of two automobile related structures on property known as 2885 S. Winchester Boulevard in an Interim (Commercial) Zoning District. -3- Commissioner Kasolas reported that the applicant had met with the Site and Architectural Review Committee this morning, and the Committee is recommending that this item be continued to the meeting of November 4, 1980. He indicated that the concerns expressed at the meeting were that this site had been previously approved for the construction of an office building and was now being proposed for undefined automobile related facilities (possibly repair); the plans indicate two long, narrow buildings with a good portion of the parking in the front; and how many automobile repair establishments could that end of Winchester Boulevard support. Commissioner Kasolas indicated that the applicant is in concurrence with the recommended continuance, and that the applicant's representative is in the audience. He emphasized that the Committee has reservations with the way the total package fits in with the area; and that the Committee is looking for something more than another parking lot. Commissioner Pack noted that Condition H in the Staff Comment Sheet does not apply to this application. She also felt that a project of this type should be carefully looked at in relation to impact on the neighborhood. Chairman Campos opened the public hearing and invited anyone in the audience to speak for or against this item. No one wishing to speak, it was moved by Commissioner Meyer and seconded by Commissioner Pack that UP 80-27 be continued to the Planning Commission meeting of November 4, 1980. This motion was unanimously adopted. UP 80-28 This is the time and place for a public hearing Valley Christian to consider the application of the Valley Christian Schools Schools fora use permit and approval of plans to locate a modular classroom facility on property known as 400 Llewellyn Avenue in a P-F (Public Facilities/Semi-Public) Zoning District. Commissioner Kasolas reported that the applicant had met with the Site and Architectural Review Committee this morning, and that the proposal was reviewed in detail with regard to location of the proposed building. He stated that the Committee feels comfortable with the Staff recommendation of approval on this matter, and with the conditions of approval listed in the Staff Comment Sheet. Commissioner Pack noted that Condition F does not apply. Commissioner Fairbanks stated that one additional concern of the Committee was that of noise from heating/cooling systems atop the modular classroom; however, the applicant has assured the Commission that there are alternate locations closer to the parking lot should noise become a problem. Commissioner Kasolas added that since this is a use permit, it could be returned to the Commission for review in the event of problems. It was also noted that the heating/cooling systems would probably be run only in the daytime. Chairman Campos queried Staff as to the length of time for this approval. -4- Mr. Stafford stated that the applicant has not given Staff a definite date when the temporary building would be removed; however, Staff would like to go on record that this building is considered only a temporary use, which is Staff's purpose in indicating a one-year time frame so that the use can be reviewed during this time for possible problems. Chairman Campos opened the public hearing and invited anyone in the audience to speak for or against this item. Mr. Reynolds, Principal of Valley Christian School, addressed the possible noise problem in relation to the heating/cooling system atop the modular building, stating that the unit will be located away from residential units. No one else wishing to speak, it was moved by Commissioner Kasolas and seconded by Commissioner Meyer that the public hearing be closed. This motion was adopted unanimously. Discussion Chairman Campos felt that this development should definitely be reviewed in one year. RESOLUTION N0. 1942 It was moved by Commissioner Kasolas that the Planning Commission adopt Resolution No. 1942 approving the application of Mr. Thomas Peterson on behalf of Valley Christian Schools for a use permit and approval of plans to locate a modular classroom facility on property known as 400 Llewellyn Avenue in a P-F (Public Facilities/ Semi-Public) Zoning District, as per conditions listed in the Staff Comment Sheet, seconded by Commissioner Meyer, and adopted by the following roll call vote: AYES: Commissioners: Pack, Meyer, Kasolas, Fairbanks, Campos NOES: Commissioners: None ABSENT: Commissioners: Kotowski, Dickson ZC 80-12 This is the time and place for a public hearing Schwenke, B. to consider the application of Mr. Bob Schwenke on behalf of Woodgate Development Co. for: (1) a zone change from R-2-S (Multiple Family Residential) to P-D (Planned Development/Medium Density Residential); and (2) approval of plans, elevations and development schedule to construct 18 condominiums on property known as 252 and 268 W. Rincon Avenue. -5- Mr. Stafford reviewed the application for the Commission noting that some of the concerns expressed in the Staff Comment Sheet had been addressed in this morning's Site and Architectural Review Committee meeting,. and because of revisions made by the architect, if the Commission should approve the project, Staff would be satisfied with that recommenda- tion. Commissioner Kasolas reported that the Site and Architectural Review Committee had been concerned with the circulation plan for both pedestrian and vehicular traffic on the site, and with the setbacks of the rear buildings as well as the window treatments. Since Staff has received revised plans subsequent to this morning's meeting, the Committee has not yet reviewed the changes and therefore does not have a recommendation. Chairman Campos opened the public hearing and invited anyone in the audience to speak for or against this item. Mr. Bob Schwenke, applicant, reviewed the plan changes for the Commission. He indicated that there had been an error made when. calculating the distance of separation between the rear structures; he then stated that the necessary distance between the two rear structures could be gained, if the front yard was reduced two feet, which would be consistent with the required setbacks. He further indicated that it would be possible to raise the height of the deck railings on the rear building, eliminating the view into the neighbors yards; and necessary light and ventilation could be gained by opening up the roofline on the rear building. Mr. Ed McCauley, 247 Cherry Lane, appeared before the Commission to plead for assistance in retaining his privacy on his property. Ms. Sheri Long, 261 Cherry Lane, appeared before the Commission to state her agreement with Mr. McCauley. Mr. Schwenke reiterated his concern for the neighboring properties, and felt that his proposed window treatment for the rear building would reserve the neighbors privacy and be an adequate compromise for the development. He stressed that the windows to the rear of the buildings would be bedrooms only. Mrs. Patty McCauley, 247 Cherry Lane, spoke against windows in the rear building, stating privacy as her concern. Commissioner Kasolas asked the applicant about the energy and safety levels of the building by not having more than one window in each unit. Mr. Schwenke stated that, from a fire safety standpoint, the window being proposed is the smallest allowed. No one else wishing to speak, Commissioner Kasolas moved that the public hearing be closed. This motion failed for lack of a second. Commissioner Fairbanks moved that ZC 80-12 be continued to the Planning Commission meeting of November 4, 1980 in order that the applicant could submit revised plans addressing the windows and decks impact on the R-1 properties to the rear of the proposed project. This motion was seconded by Commissioner Pack and adopted with a vote of 4-1-2, with Commissioner Kasolas voting "No". -6- Commissioner Pack stated her concern regarding the density on Rincon Avenue. It was her feeling that the Commission should try to work for the low end of the density range for remaining properties on this street. Commissioner Kasolas felt that if the Commission is going to enforce the low end of the density range, then the General Plan should be changed. Commissioner Pack felt that the reason for the range was to allow the Commission to use judgment in putting the proper development on a site. Mr. Helms indicated in relation to street improvements on Rincon Avenue, that this street is now at its ultimate improvement, and there are no plans to further improve it. Commissioner Meyer requested that staff identify current densities on either side of 252 and 268 W. Rincon Avenue, for the next meeting. MISCELLANEOUS Staff Report Continued report from the San Tomas Area Study San Tomas Committee regarding modified standard specifica- Area Study tions and details for streets. Committee Referral from Referral from the City Council regarding residential City Council developments in which an existing residence is proposed to remain. Commissioner Kasolas noted that since these two items involve policy setting and Commissioners Dickson and Kotowski are not present, perhaps these items should be continued to the Planning Commission meeting of November 4, 1980. It was moved by Commissioner Kasolas, seconded by Commissioner Pack, and unanimously adopted that Items Nos. 6 and 7, above, be continued to the Planning Commission meeting of November 4, 1980. ADJOURNMENT Commissioner Kasolas moved that the meeting be adjourned, seconded by Commissioner Pack, and unanimously adopted.
