MINUTES SPECIAL MEETING MORGA ANNEXATIONS PUBLIC HEARING SEPTEMBER 11, 1979 The Planning Commission of the City of Campbell convened this day in special session at the regular meeting place, the Council Chambers of the City Hall, 75 N. Central Avenue, Campbell, California. ROLL CALL Present Commissioners: Meyer, Dickson, Campos (7:44), Pack Vierhus, Kasolas, Chairman Samuelson; Planning Director Arthur A. Kee, Principal Planner Philip J. Stafford, City Attorney J. Robert Dempster, Recording Secretary Jeannine fade. Absent None. PUBLIC HEARING MORGA Annexations This is the time and place for a public hearing to consider the prezoning of certain properties which are being proposed for annexation to the City of Campbell under provisions of the Municipal Organization Act of 1977 (MORGA). Mr. Kee gave background information on the MORGA legislation, explaining that the City Council has determined that they wish to proceed with annexation of County islands within Campbell's Sphere of Influence under the MORGA legislation. He noted that the hearing tonight was not on annexation of properties, but on the prezoning of properties proposed to be annexed into the City. He stated that the recommendations made this evening by the Planning Commission would be forwarded on to the City Council for consideration at their meeting to be held on October 15, 1979 at 7:30 p.m. in the Council Chambers. The hearings on the actual annexation of these properties would probably not be held for three to four months, and those hearings would be held before the County's Local Agency Formation Commission (LAFCO) in the Administrative Offices at the County. He stated that there had been two informational hearings before the City Council on May 7 and 8, 1979, to alert persons residing in these island areas about the MORGA legislation. Commissioner Campos entered the Council Chambers at 7:44 p.m. Mr. Kee then introduced Mr. Philip J. Stafford, Principal Planner, who would be making presentations on the prezoning of properties in each of the 22 island areas within Campbell's Sphere of Influence. -2- Mr. Stafford explained that he would take one area at a time, and persons wishing to speak could speak at the time the particular area they are interested ~- is discussed rather than at the end of the meeting. At this time Chairman Samuelson opened the public hearing on the prezoning of these properties, and invited Mr. Stafford to make his first presentation. Shady Acres - 1979-9 Mr. Stafford explained the boundaries of this area, also noting the zoning of the surrounding properties (see Exhibit A, Page 1). He reported that at the present time the General Plan indicates "Low-Density Residential" for this area and the Planning Staff is recommending "R-1 (Single Family Residential)" prezoning for this area. Chairman Samuelson invited anyone in the audience to speak for or against this prezoning for this area. No one wishing to be heard, Commissioner Vierhus moved that the Planning Commission recommend to the City Council the prezoning of "R-1 (Single-Family Residential)" 'for Shady Acres 1979_g, This motion was seconded by Commissioner Pack and unanimously adopted. Eden - 1979-1 Mr. Stafford explained the boundaries of this area, also noting the zoning of the surrounding properties (see Exhibit A, Page 2). He reported that at the present time the General Plan indicates "Low-Medium Density Residential" for this area and the Planning Staff is recommending "R-M (Multiple Family Residential)" prezoning for this area. Commissioner Pack inquired if this proposed prezoning included the U-Save Liquor Store at the 'southwest corner of Rosemary and Winchester. Mr. Stafford responded that that parcel had already been prezoned and is at the Council level at the present time. Mr. Kee further stated that Council had heard second reading of the ordinance approving this prezoning at their meeting of September 10, 1979. Chairman Samuelson invited anyone in the audience to speak on this area. Mr. B. C. Rappe of 205 W. Rosemary Lane appeared before the Commission to present a petition signed by a majority of the property owners within this island re- questing that the prezoning of "R-1 (Single Family Residential)", rather than staff's recommendation of "R-M (Multiple Family Residential)" be placed on this area. He then inquired about the streets and wondered if the right of way would be changed. Mr. Kee stated that the prezoning of this property would not affect the right of way, however he suggested calling the Public Works Department regarding specific questions. - 3- Mr. Dave Wells of 147 W. Rosemary Lane (who had also signed the petition presented to the Commission) noted he appreciated being annexed into Campbell rather than San Jose and desired a prezoning of "R-1". Commissioner Kasolas inquired about how the General Plan designation of "Low- Medium Density Residential" for this area came about. Mr. Kee noted that it had been that way since 1970. No one else wishing to speak, Commissioner Vierhus moved that the Planning Commission recommend to the City Council the prezoning of "R-1 (Single-Family Residential) for Eden 1979-1, in accord with the property owners' request. This motion was seconded by Commissioner Vierhus and unanimously adopted. Minute Action Commissioner Pack-moved that an amendment to the Land Use Element of the General Plan for Eden 1979-1 from "Low-Medium Density Residential" to "Low Density Residential" be initiated should the City Council approve the recommendation of the Planning Commission at its meeting of October 15, 1979. This motion was seconded by Commissioner Pack and unanimously adopted. Latimer 1979-12 Mr. Stafford explained the boundaries of this area, also noting the zoning of the surrounding properties (see Exhibit A, Page 3). He reported that at the present time the General Plan indicates "Low-Density Residential" for this area and the Planning Staff is recommending "R-1 (Single-Family Residential)" prezoning for this area. Chairman Samuelson invited anyone in the audience to speak on this item. No one wishing to speak, Commissioner Pack moved that the Planning Commission recommend to the City Council the prezoning of "R-1 (Single-Family Residential)" for Latimer 1979-12. This motion was seconded by Commissioner Vierhus and unanimously adopted. *** McGlincev 1979-6 Mr. Stafford explained that this area consists of four lots on the southerly side of Michael Drive, and all four properties have been developed (see Exhibit A, Page 4). He reported that at the present time the General Plan indicates "High Density Residential" for this area and the Planning Staff is recommending "R-3-S (Multiple Family Residential)" prezoning for this area. Chairman Samuelson invited anyone in the audience to speak on this item. Mr. Philip Indovina of 2096 San Tomas Aquino Road (APN 413-44-030) appeared before the Commission to speak in favor of this prezoning. No one else wishing to be heard, Commissioner Vierhus moved that the Planning Commission recommend to the City Council the prezoning of "R-3-S (Multiple Family Residential)" for McGlincey 1979-6. This motion was seconded by Commissioner Meyer and unanimously adopted. *** - ~- McGlincey 1979-7 Mr. Stafford reported that these lots are located en the southerly side of Apricot Avenue, east of Union Avenue (see Exhibit A, Page 5). He reported that at the present time the General Plan indicates °'High Density Residential" for this area and the Planning Staff is recommending "R-3-S (Multiple Family Residential)" prezoning for this area. Commissioner Pack expressed her opposition to high density for this area. Chairman Samuelson invited anyone in the audience to speak on this item. No one wishing to be heard, Commissioner Dickson moved that the Planning Commission recommend to the City Council the prezoning of "R-3-S (Multiple Family Residential)" for McGlincey 1979-7. This motion was seconded by Commissioner Kasolas and carried with Commissioner Pack voting "No". *** McGlincey 1979-8 Mr. Stafford located the area on the map and explained the boundaries (see Exhibit A, Page 6). He reported that at the present time the General Plan indicates "High Density Residential" for this area and the Planning Staff is recommending "R-3-S (Multiple Family Residential)" prezoning for this area. Again, Commissioner. Pack expressed her opposition to a high density for this area. Chairman Samuelson invited anyone in the audience to speak on this item. No one wishing to speak, Commissioner Dickson moved that the Planning Commission recommend to the City Council the prezoning of "R-3-S (Multiple Family Residential)" for McGlincey 1979-8. This motion was seconded by Commissioner Kasolas and adopted with Commissioner .Pack voting "No". Rincon 1979-14 Mr. Stafford reported that this area is shown as "Low Density Residential" on the General Plan (see Exhibit A, Page 7) and the Planning Staff is recommending "R-1 (Single-Family Residential)" prezoning for this area. Chairman Samuelson invited anyone in the audience to speak for or against this item. No one wishing to be heard, Commissioner Pack moved that the Planning Commission recommend to the City Council the prezoning of "R-1 (Single- Family Residential)" for Rincon 1979-14. This motion was seconded by Commissioner Meyer and unanimously adopted. -5- Sunnyoaks 1979-15 Mr. Stafford explained that the five most southerly lots are shown as "Low- Medium Density Residential" on the .General Plan and the staff is recommending that they be prezoned "R-M (Multiple Family Residential)". The remainder of the area is shown as "Low-Density Residential" on the General Plan and staff is recommending that it be prezoned "R-1 (Single-Family Residential)" (see Exhibit A, Page 8). Chairman Samuelson invited anyone in the audience to speak for or against this item. Mr. Eric Tagular of Emery Street appeared before the Commission to inquire if any street changes were going to be made, and if any other changes were being considered. Mr. Kee explained that this was before the Commission only to consider prezoning; no changes are proposed. He informed Mr. Tagular that he could inquire about street improvements by calling the Public Works Department. Mr. Robert Dougherty of 1361 Burrows Road appeared to -express his concerns about the traffic problems in the area. He felt all of the area should remain R-1 until the traffic problems are resolved. Mr. Kee responded that the Public Works Department could answer specific questions regarding street improvements and advised Mr. Dougherty to call during office hours - 8 a.m. to 5 p.m. Ms. Barbara Jones of 400 Sunnyoaks Avenue appeared before the Commission to express her concern about the traffic and parking available; she expressed her desire for this area to remain R-1. No one else wishing to speak, Commissioner Dickson moved that the Planning Commission recommend to the City Council the staff recommendation of the prezoning of "R-1 (Single-Family Residential)" and "R-M (Multiple Family Residential)" for Sunnyoaks 1979-15. This motion was seconded by Commissioner Meyer and unanimously adopted. *** Lovell 1979-18 Mr. Stafford explained the boundaries of this area. He reported that at the present time the General Plan indicates "Low Density Residential" for this area and the Planning Staff is recommending "R-1 (Single-Family Residential)" prezoning. Chairman Samuelson invited anyone in the audience to speak on this item. Ms. Lupe Compean of 19519 Montevina Rd., Los Gatos, owner of 1164 Hazelwood Avenue, appeared before the Commission to express her desire for R-1 prezoning, noting that she would like for her property to be annexed into the City. -6- No one else wishing to speak, Commissioner Pack moved that the Planning Commission recommend to the City Council the prezoning of "R-1 (Single- Family Residential)"for Lovell 1979-18. This motion was seconded by Commissioner Campos and unanimously adopted. *** Lovell 1979-17 Mr. Stafford explained the boundaries of this area. He reported that at the present time the General Plan indicates "Low Density Residential" for this area and the Planning Staff is recommending "R-1 (Single-Family Residential)" prezoning (see Exhibit A, Page 10). Chairman Samuelson invited anyone in the audience to speak on this item. Mr. Tony Goodman of 1181 Hazelwood Avenue inquired about some of the properties being developed into apartments and wondered if there would be any changes made to these properties if annexed. Mr. Kee explained that if they are legal conforming uses in the County they would come into the City that way; however, if they are illegal they will come' into the City as illegal non-conforming uses. Mr. Goodman then inquired if the City would condemn some of the older, run- down homes once they were annexed. Mr. Kee responded that he was not aware of any plans of that nature. He then explained that the City currently has a program to rehabilitate older homes at a low interest rate and the coordinator of that program is Thom McCue who can be reached in the Planning Office. Mr. Goodman then explained that a number of people in this area are opposed to annexation into Campbell and will express these feelings at the October 15 City Council meeting. He noted that many parcels with older buildings, after having been annexed to the Town of Los Gatos,~were condemned and the property owners in this area don't want that to happen to their buildings. Dr. Edwin Pinto of 13901 Upper Hi 11 Drive, Saratoga, owner of APN 405-10-09, appeared before the Commission to state that he had submitted a letter to the Planning Department opposing the annexation since any costs thereof would create a financial hardship to him due to the proposed zoning. A copy of Dr. Pinto's letter is attached hereto and made a part of this record. He further noted that unless he were able to obtain a variance to keep the dwellings on his property he would not be in favor of this prezoning. No one else wishing to speak, Commissioner Dickson moved that the Planning Commission recommend to the City Council the staff recommendation of the prezoning of "R-1 (,Single-Family Residential)" for Lovell 1979-17. This motion was seconded by Commissioner Meyer and unanimously adopted. - 7- Lovell 1979-19 Mr. Stafford explained the boundaries of the area. He reported that at the present time the General Plan indicates "Lour Density Residential" for this area and the Planning Staff is recommending "R-1 (Single-Family Residential)" prezoning (see Exhibit A, Page 11). He further explained that there exists a commercial use in this area; the surrounding areas are R-M (currently Interim Zoned). Commissioner Kasolas felt that with the surrounding areas being R-M, this was in fact spot zoning since R-1 is being recommended. Mr. Kee explained that five or six years ago public hearings were held in this area and the property owners were strongly in favor of R-1 zoning, and at that time the General Plan was changed to "Low Density Residential". Chairman Samuelson invited anyone in the audience to speak for or against this prezoning. Mr. Joel Butler of 1113 S. San Tomas Aquino Road appeared before the Commission to explain that the area is desperately in need of better roads before considering annexation and prezoning. He felt the matter of streets should be considered first. Mr. Kee reported that Pollard Road is scheduled to be improved this coming year in the Capital Improvement Program, and also possibly San Tomas Aquino Road (particularly at the curve); however, he urged Mr. Butler to contact Mr. Helms of the Public Works Department for specific scheduling of these projects. No one else wishing to speak, Commissioner Pack moved that the Planning Commission recommend to the City Council the staff recommendation of the prezoning of "R-1 (Single-Family Residential)" for Lovell 1979-19. This motion was seconded by Commissioner Vierhus and adopted with Commissioner Kasolas voting "No" since he felt this area should be consistent with the surrounding areas on the three sides (R-M). *** Lovell 1979-20 Mr. Stafford explained the boundaries of the area. He reported that at the present time the General Plan indicates Low Density Residential for this area and the Planning Staff is recommending "R-1 (Single-Family Residential) prezoning (see Exhibit A, Page 12). Chairman Samuelson invited anyone in the audience to speak for or against this prezoning. No one wishing to speak, Commissioner Vierhus moved that the Planning Commission recommend to the City Council the staff recommendation of the prezoning of "R-1 (Single-Family Residential)" for Lovell 1979-20. This motion was seconded by Commissioner Pack and unanimously adopted. *** The Commission took a break at 9:00 p.m.; the meeting reconvened at 9:15 p.m. *** _g_ Bucknall 1979-13 Mr. Stafford explained the boundaries of the area. He reported that at the present time the General Plan indicates "Low Density Residential" for this area and the Planning Staff is recommending "R-1(Single-Family Residential)" prezoning (see Exhibit A, Page 13). Chairman Samuelson invited anyone in the audience to speak on this prezoning. No one wishing to speak, Commissioner Dickson moved that the Planning Commission recommend to the City Council the staff recommendation of the prezoning of "R-1 (Single-Family Residential)" for Bucknall 1979-13. This motion was seconded by Commissioner Meyer and unanimously adopted. .Quito 1979-21 Mr. Stafford explained the boundaries of the area. He reported that at the present time the General Plan indicates "Public, Semi-Public" for this area and the Planning Staff is recommending "Public Facilities" prezoning (see Exhibit A, Page 14). Commissioner Pack inquired if there had been any correspondence from the School District about this property. Mr. Kee noted that he had been in contact with the School District; however, no formal correspondence had been received. Commissioner Kasolas inquired if there were single-family dwellings currently on a portion of the School District or Catholic Church property. Mr. Kee reported that staff did not know at this time if single-family dwellings existed on either site. Commissioner Pack inquired if the Commission should consider an 0-S Overlay Zoning at this time for the School property. Mr. Kee stated that the Commission at a later date would be considering the 0-S Overlay Zoning for schools with parks and this probably would be best considered at that time rather than now. Chairman Samuelson invited anyone in the audience to speak on this area. No one wishing to be heard,Commissionerpack moved to continue this item until such time that staff could come back with a detailed report on whether or not single-family dwellings existed on either one of the properties considered. This motion was seconded by Commissioner Dickson. City Attorney Dempster noted the criticality of timing of this prezoning, stating that a hearing has been set before the City Council on October 15. He suggested that action on this particular item be postponed until later in the meeting in order that staff could research the question. Commissioner Dickson withdrew his second to the motion, and Commissioner Pack then withdrew her motion for a continuance of this item. -9- It was the consensus of the Commission to reconsider this area later during the meeting. **~ San Tomas 1979-23 Mr. Stafford explained the boundaries of the area. He reported that at the present time the General Plan indicates "Low Density Residential" for this area and-the Planning Staff is recommending "R-1 (Single-Family Residential)" prezoning (see Exhibit A, Page 15). Chairman Samuelson invited anyone in the audience to speak on this area. No one wishing to speak, Commissioner Meyer moved that the Planning Commission recommend to the City Council the staff recommendation of the prezoning of "R-1 (Single-Family Residential)" for San Tomas 1979-23. This motion was seconded by Commissioner Dickson and unanimously adopted. Quito 1979-22 Mr. Stafford explained the boundaries of the area. He reported that at the present time the General Plan indicates "Low Density Residential" for this area and the Planning Staff is recommending "R-1 (Single-Family Residential)" prezoning (see Exhibit A, Page 16). Chairman Samuelson invited anyone in the audience to speak on this area. Mr. Dale Lewis of 1776 Regina appeared before the Commission to express his desire for single-family prezoning of this area. No one else wishing to speak, Commissioner Dickson moved that the Planning Commission recommend to the City Council the staff recommendation of the prezoning of "R-1 (Single-Family Residential)" for Quito 1979-22. This motion was seconded by Commissioner Campos and unanimously adopted. *** San Tomas 1979-4 Mr. Stafford explained the boundaries of the area. He reported that at the present time the General Plan indicates "Low Density Residential" for this area and the Planning Staff is recommending "R-1 (Single-Family Residential)" prezoning (see Exhibit A, Page 17). Chairman Samuelson invited anyone in the audience to speak on this area. Mr. Butler of 1113 S. San Tomas Aquino Road appeared before the Commission to inquire about what will be done with the school. Mr. Kee reported that a decision has not been made at this point in time. -lo- No one else wishing to speak, Commissioner Meyer moved that the Planning Commission recommend to the City C,ou~~c~il the staff recommendation of the prezoning of "R-1 (Single-Family Residential)" for San Tomas 1979-4. This motion was seconded by Commissioner Pack and unanimously adopted. *** San Tomas 1979-5 Mr. Stafford reported that at the present time the General Plan indicates "Low Density Residential" and "Pubiic, Semi-Public" for this area and the Planning Staff is recommending "R-1 (Single-Family Residential)" and "P-F (Public Facilities)", respectively, prezoning (see Exhibit A, Page 18). Chairman Samuelson invited anyone in the audience to speak on this area. No one wishing to speak, Commissioner Pack moved that the Planning Commission recommend to the City Council the staff recommendation for prezoning of San Tomas 1979-5, seconded by Commissioner Vierhus and unanimously adopted. *** Lovell 1979-16 Mr. Stafford reported that at the present time the General Plan indicates "Low Density Residential", "Low-Medium Density Residential", and "Commercial" for this area and the Planning Staff is recommending °'R-1 (Single-Family Residential)", "R-M (Multiple Family Residential)", and "C-1 (Neighborhood Commercial)", respectively, prezoning (see Exhibit A, Page 19). Commissioner Kasolas expressed his concern about the non-conforming uses of this area should it be annexed, noting that if something should burn down, the property owner would not be able to rebuild. Commissioner Dickson noted that if something like that should happen, the property owner could apply for a variance in case of hardship. Mr. Jack Pamfield of Abbott Avenue appeared before the Commission to express his concerns about the street conditions of the area. Mr. Marvin Moore of E1 Sortono Drive appeared before the Commission to inquire about the annexation proceedings. Mr. Kee again explained the MORGA Act, noting that this evening's hearing was for prezoning only. No one else wishing to speak, Commissioner Dickson moved that the Planning Commission recommend to the City Council the staff recommendations for prezoning of Lovell 1979-16. This motion was seconded by Commissioner Pack. Commissioner Kasolas again expressed his concern about the nonconforming commercial uses in this area; he stated he would be in agreement with the staff's recommendations with the exception of the commercial area. Commissioner Pack was in agreement with Commissioner Kasolas' concerns, thereby rescinding her second to the motion. Commissioner Vierhus then seconded the motion to recommend the staff recommendations to the City Council for prezoning of Lovell 1979-16. Vote on Motion The motion for the staff recommendations to be forwarded to the City Council for this area was adopted with Commissioners Pack and Kasolas voting "No". Pollard 1979-10 Mr. Stafford explained the boundaries of the area. He reported that at the present time the General Plan indicates "Low Density Residential" for this area and the Planning Staff is recommending "R-1 (Single-Family Residential)" prezoning (see Exhibit A, Page 20). Chairman Samuelson invited anyone in the audience to speak on this area. Mr. Hollis Button of 1025 W. Parr Avenue appeared before the Commission to state that he is not in favor of annexing into the City, feeling that it would only increase taxes. Mr. Chester Eades of 1032 Audrey appeared to also express his desire to remain in the County. He did not feel there is a need to annex into the city. Mr. Pasentino of 1126 Steinway also appeared to express his preference to remain in the County. Mr. Kee explained that the hearing this evening is not on the annexation but on the prezoning of properties should they be annexed. He again noted that there would be a prezoning hearing before the City Council on October 15 at 7:30 p.m. in the Council Chambers to consider the Planning Commission's recommendations; however, the actual annexation hearings would not be held for another three months and that hearing would be held at the County. City Attorney Dempster then explained the Municipal Organization Act of 1977 to persons in the audience. No one else wishing to speak, Commissioner Vierhus moved that the Planning Commission recommend to the City Council the Staff recommendation for Pollard 1979-10, seconded by Commission er Pack and unanimously adopted. *** -12- Pollard 1979-11 Mr. Stafford explained the bouo~~~~a~; ,; ` ,,he area. He reported that at the present time the General Plan indicates "Low Density Residential", "Low- Medium Density Residential" and °'Commercial" for this area, and the Planning Staff is recommending "R-1 (Single-Family Residential)", "R-M (Multiple Family Residential)" and °`G-1-S (Neighborhood Commercial)", respectively, prezoning (see Exhibit A, Page 21). Chairman Samuelson invited anyone in the audience to speak on this area. Mr. R. K. Cushman of 1274 Walnut Drive (APN 405-24-041) expressed a desire for high density or commercial for his property. He indicated developing his property with possibility of access onto Winchester Blvd. Mr. Kee noted that the General Plan for this area indicates "Low-Medium Density Residential" and that there had been a request for higher density at the northeast corner of Hacienda and Walnut, however it was not approved. Much discussion ensued regarding a General Plan change and rezoning of Mr. Cushman's property. Mr. Dave Valkenaar, owner of the parcel at Walnut and Chapman, noted he would like for the area to remain low density, reporting the property owners are concerned about increased traffic problems and parking along Walnut. He noted he would be opposed to any higher density. Mr, Steven W. Schnur of 1425 Capri Drive felt the Commission did not have to go along with the prezoning; he is against annexation and felt the Commission should take a stand against annexing. City Attorney Dempster explained that the Commission is an advisory body and that the City Council had directed the Commission to initiate prezoning hearings for annexation. Mr. Ed Galt of 640 Wendell spoke for low density of the area. Discussion ensued regarding the two parcels on the easterly side of Walnut Drive proposed for R-M zoning. Commissioner Kasolas felt that should an application come before the Commission there could be a problem with "spot" zoning with one or both of these parcels. No one else wishing to be heard, Commissioner Pack moved that the Planning Commission recommend to the City Council the staff recommendation for Pollard 1979-11 with the exception of the two parcels on Walnut Drive (1252 and 1274 Walnut Drive) being recommended for R-1 rather than R-M. This motion was seconded by Commissioner Kasolas and adopted with Commissioners Meyer and Dickson voting "No". Minute Action Commissioner Pack moved .that an amendment to the Land Use Element of the General Plan for a portion of Pollard 1979-11 (APNs 405-24-041 and 405-24-042), from "Low-Medium Density Residential" to "Low Density Residential" be initiated should the City Council approve the recommendation of the Planning Commission at its meeting of October 15, 1979. This motion was seconded by Commissioner Vierhus and adopted with Commissioner Dickson voting "No". *** -13- Commissioner Vierhus left the Council Chambers at 10:50 p.m. *~~* Whiteoaks 1979-3 Mr. Stafford explained the boundaries of the area. He reported that at the present time the General Plan indicates "Low Density Residential", "Low- Medium Density Residential", "Medium Density Residential", and "Commercial" for this area, and the Planning Staff is recommending "R-1 (Single-Family Residential)", R-M (Multiple Family Residential)", "R-2-S (Multiple Family Residential)", and "C-1 (Neighborhood Commercial)", respectively, prezoning (see Exhibit A, Page 22). Mr. Kee explained briefly the background of this area, noting that one of the parcels in the County had been prezoned previously. Commissioner Pack expressed concern about the intersection of Whiteoaks and Hacienda, noting there is a terrible sight distance problem. Chairman Samuelson invited anyone in the audience to speak on this area. Mr. Leland, who lives at the corner of Shelley and Redding, appeared to express his desire for R-1 zoning; he noted that there are traffic problems at the access to Whiteoaks. Mr. Robert Cerruti of 1475 Parsons Avenue appeared before the Commission to speak in favor of lower density; he also-noted the problem of the Redding- Whiteoaks intersection. Mr. A. McClintock of 123 Redding Road also expressed his concern about the intersection of Whiteoaks and Redding. He then noted that he would like to see the Commission propose prezoning in accord with the General Plan. Mr. Bill Brown of 104 Redding Road appeared to explain that at one time he would have liked this area to be zoned R-1; however, with all the townhouses in the area, he is in favor of higher density in order to sell his property. No one else wishing to be heard, Commissioner Pack moved that the Planning Commission recommend to the City Council the staff recommendations for Whiteoaks , 1979-3 except for the R-2-S area which would be recommended for R-M. This motion was seconded by Commissioner Kasolas. Discussion of Motion Commissioner Dickson stated that even though he would like to see a lower density for this area, he is in favor of staff's recommendation noting that this land use and zoning have been this way for quite some time. Commissioner Samuelson was in agreement with Commissioner Dickson's thoughts. Commissioner Pack stated that she has been in favor of lower density in the past for this area, and continues to feel that it should be of a lower density. -14- Amendment to Motion Commissioner Dickson moved to amend the original motion recommending to the City Council all of staff's recommendations for Whiteoaks 1979-3. This motion failed for lack of a second. Vote on Motion AYES: Commissioners: Meyer, Campos, Pack, Kasolas NOES: Commissioners: Dickson, Samuelson ABSENT: Commissioners: Vierhus Minute Action Commissioner Pack moved that an amendment to the Land Use Element of the General Plan for a portion of Whiteoaks 1979-3 (APNs 413-23-040, 041, 042, 044, and 045 on P.eddinn P,oad, respectively) from "Medium Density Residential" to "Low-Medium Density Residential" be initiated should the City Council approve the recommendation of the Planning Commission at its meeting of October 15, 1979. This motion was seconded by Commissioner Kasolas, and adopted with Commissioner Dickson voting "No". *** At this time the Commission returned to Quito 1979-21 on this evening's agenda. Quito 1979-21 Commissioner Dickson moved that the Planning Commission recommend to the City Council the staff recommendation of the prezoning of Quito 1979-21, upon staff determination regarding the houses located on the subject parcels. This motion was seconded by Commissioner Kasolas and unanimously adopted. RESOLUTION N0. 1817 Commissioner Dickson moved that the Planning Commission adopt Resolution No. 1817 recommending prezoning of certain properties proposed to be annexed to the City of Campbell, as shown on Exhibit A, attached.
