PC Min 02/20/1979PLANNING COMMISSION CITY OF CAMPBELL, CALIFORNIA TUESDAY, 7:30 PM MINUTES FEBRUARY 20, 1979 The Planning Commission of the City of Campbell convened this day in regular session at the regular meeting place, the Council Chambers of the City Hall, 75 North Central Avenue, Campbell, California. ROLL CALL Present Commissioners: Dickson, Pack, Vierhus, Kasolas; Secretary Arthur A. Kee, Senior Planner Bruce R. Powell, Engineering Manager Bill Helms, City Attorney J. Robert Dempster, Recording Secretary Jeannine Wade. Absent Commissioners: Meyer, Campos, Chairman Samuelson. Commissioner Pack noted that since the Chairman and Vice Chairman were both absent, she would be chairing the meeting this evening. APPROVAL OF MINUTES Commissioner Kasolas moved that the minutes of the regular meeting of February 6, 1979 be approved as submitted, seconded by Commissioner Vierhus and unanimously. COMMUNICATIONS Mr. Kee noted that communications received relate to specific items on the agenda and would be considered at the time the item is discussed. ARCHITECTURAL APPROVALS s 79-3 Application of Messrs. Dennis Rawson and Glen Rawson, D. Kral for approval of plans to allow construction Kral, G. of a warehouse/industrial building on property known as 941 S. McGlincey Lane in an M-1-S (Light Industrial) Zoning District. Commissioner Kasolas reported that the applicant had met with the Site and Architectural Review Committee this morning, and the Committee is recommending approval of this application subject to the conditions listed in the Staff Comment Sheet. He further noted that the applicant was in agreement with the conditions as listed. Commissioner Vierhus moved that S 79-3 be approved subject to the following conditions: -2- 1. Landscaping plan indicating type and size of plant material, and location of hose bibs or sprinkler system to be submitted for approval of the Planning Director prior to application for building permit. 2. Landscaping and fencing shall be maintained in accordance with the approved plan. 3. Applicant to either (1) post a faithful performance bond in the amount of $3,000 to insure landscaping, fencing, and striping of parking areas within three months of completion of construction, or (2) file written agreement to complete landscaping, fencing and striping of parking areas prior to final Building Department clearance. 4. Applicant to submit a letter, satisfactory to the City Attorney limiting the use of the property to: 952 square feet of office use, 1568 square feet of speculative industrial use, and 5480 square feet of warehouse use. 5. All mechanical equipment located on roofs to be screened as approved by the Planning Director. The applicant is notified as part of this application that he/she is required to meet the following conditions in accordance with Ordinances of the City of Campbell and Laws of the State of California. A. All parking and driveway areas to be developed in compliance with Section 21.50 of the Campbell Municipal Code. All parking spaces to be provided with appropriate concrete curbs or bumper guards. 6. Underground utilities to be provided as required by Section 20.16.070 of the Campbell Municipal Code. C. Plans submitted to the Building Department for plan check shall indicate clearly the location of all connections for underground utilities including water, sewer, electric, telephone and television cables, etc. D. Sign application to be submitted in accordance with provisions of the sign ordinance for all signs. No sign to be installed until application is approved and permit issued by the Building Department. (Section 21.68.070 of the Campbell Municipal Code.) E. Ordinance No. 782 of the Campbell Municipal Code stipulates that any contract for the collection and disposal of refuse, garbage, wet garbage and rubbish produced within the limits of the City of Campbell shall be made with Green Valley Disposal Company. This requirement applies to all single-family dwellings, multiple apartment units, to all commercial, business, industrial, manu- facturing, and construction establishments. -3- F. Trash container(s) of a size and quantity necessary to serve the development shall be located in area(s) approved by the Fire Department. Unless otherwise noted, enclosure(s) shall consist of a concrete floor surrounded by a solid wall or fence and have self-closing doors of a size specified by the Fire Department. All enclosures to be constructed at grade level. G. Applicant shall comply with all appropriate State and City requirements for the handicapped. FIRE DEPARTMENT H. Provide one on-site fire hydrant on the property. I. Provide one 2A-IOBC fire extinguisher for each leased space. PUBLIC WORKS DEPARTMENT J. Pay storm drainage area fee of $314. K. Obtain an excavation permit to install a driveway approach. The applicant is notified that he/she shall comply with ail applicable Codes or Ordinances of the City of Campbell which pertain to this development and are not herein specified. This motion was seconded by Commissioner Dickson, and unanimously adopted. S 79-4 Application of Mr. Paul S. Heath for approval Heath, P. of plans to construct three residential units on the rear of property known as 1177 Smith Avenue in an R-M (Multiple Family/Low Density Residential) Zoning District. Commissioner Kasolas reported that this application was not reviewed by the Site and Architectural Review Committee; however, the matter was discussed with the applicant and the Committee indicated to him that it was the position of the Committee to recommend that this item be referred to the San Tomas Task Force and be continued to the Planning Commission meeting of March 6, 1979, with the specific understanding that this item be reviewed as expeditiously as possible by the Task Force, and if this item could not be reviewed in time for the March 6, 1979, Planning Commission meeting, then it would be considered at the March 20 meeting since the 60-day time limit would be March 21, 1979. Mr. Paul Heath, applicant, appeared before the Commission to state that he would like the application reviewed as quickly as possible. He further stated that he did understand that it should be reviewed by the Task Force. Commissioner Vierhus moved that S 79-4 be referred to the San Tomas Task Force, requesting that this item be reviewed as expeditiously as possible, and be continued to the Planning Commission meeting of March 6, 1979. This motion was seconded by Commissioner Dickson. - 4- Commissioner Kasolas felt that the motion should be amended to include a provision for continuing this item to the March 20 meeting in case the Task Force would not have a recommendation by March 6. City Attorney Dempster indicated that an amendment to the motion would not be necessary as the item would be automatically continued from the March 6 meeting to the March 20 meeting. The motion made by Commissioner Vierhus and seconded by Commissioner Dickson to refer this item to the Task Force and be continued to the Planning Commission meeting of March 6, 1979, was unanimously adopted. .~ _~ _~ s 79-5 Application of Mr. Allan M. Harris and the Harris, A. Universal Development and Investment Company for approval of plans to construct an office building on property known as 62 S. San Tomas Aquino Road in a C-2-S (General Commercial) Zoning District. Commissioner Kasolas reported that the Site and Architectural Review Committee reviewed this application this morning and is recommending approval subject to the conditions listed in the Staff Comment Sheet. He noted that the applicant was in agreement to the conditions. Commissioner Dickson moved that S 79-5 be approved subject to the following conditions: 1. Property to be fenced and landscaped as indicated and/or added in red on plans. 2. Landscaping plan indicating type and size of plant material, and location of hose bibs or sprinkler system to be submitted .for approval of the Planning Director prior to application for building permit. 3. Fencing plan indicating location and design details•of fencing to be submitted for approval of Planning Director prior to application for building permit. 4. Applicant is notified as part of this application that he/she is required to meet the following conditions in accordance with Ordinances of the City of Campbell and Laws of the State of California. Roof covering shall be fire-retardant (Sec. 1704. - 1976 Uniform Bldg. Code). FIRE DEPARTMENT I. Provide 2A-IOBC fire extinguishers. J. Relocate fire hydrant to north side of garage level ramp. -6- PUBLIC WORKS DEPARTMENT K. Dedicate right-of-way to a 45-foot half-street on San Tomas Aquino Rd. L. Pay storm drainage area fee of $1,008. M. Enter into an agreement and post surety to install street improvements across frontage. N. Pay the plan examination and construction inspection fee. 0. Provide a grading and drainage plan for the approval of the City Engineer. P. Relocate the existing power pole to behind the future curb. The applicant is notified that he/she shall comply with all applicable Codes or Ordinances of the City of Campbell which pertain to this development and are not herein specified. This motion was seconded by Commissioner Vierhus and unanimously adopted. _~ .~ PUBLIC HEARINGS S 79-1 A. Continued public hearing to consider Angel, L. interpretation of Zoning District boundary and make minor modification. B. Continued application of Mr. Larry J. Angel and Vali Associates for approval of plans to construct a commercial building on property known as 1777 S. Bascom Avenue in a C-2-S (General Commercial) Zoning District. Mr. Kee reported that the Zoning Ordinance requires that a zoning district boundary adjustment be considered by the Planning Commission at a public hearing. Acting Chairman Pack invited anyone in the audience to speak for or against this item. No one wishing to be heard, Commissioner Kasolas moved that S 79-1(A) be continued to the March 6, 1979, Planning Commission meeting. This motion was seconded by Commissioner Dickson and unanimously adopted. Commissioner Kasolas then reported that the applicant, Mr. Larry Angel, had requested a continuance of portion (B) of this application to the March 6, -- 1979, Planning Commission meeting. He further noted that the Architectural Advisor as well as staff had some concerns about this application and a meeting had been scheduled for the applicant to meet with the staff to resolve some of these concerns before the end of this week. - 7- Commissioner Kasolas moved that S 79-1(B) be continued to the March 6, 1979, Planning Commission meeting, seconded by Commissioner Dickson. and unanimously adopted. . .~ ., UP 79-1 This is the time and place for a continued Winston, D. public hearing to consider the request of Mr. David Winston and Martin Oil Service, Inc. for a use permit to allow the sale of secondary support products at property known as 851 E. Hamilton Avenue in a P-D (Planned Development/ Commercial and/or Industrial) Zoning District. Mr. Kee reported that the applicant had submitted a letter indicating the potential products to be sold at the subject site. He noted that this list of products met with the approval of the City Attorney. A copy of this letter, dated February 13, 1979, is attached hereto and made a part of these minutes. Acting Chairman Pack inquired about the enforcement of the sale of these products. Mr. Kee responded that it would be the responsibility of the Planning Department to enforce the conditions of the use permit. Commissioner Dickson noted that in all fairness to the applicant he felt this item should be continued since he could not vote in favor of this item. He stated that it might have a better opportunity of being granted if a full Commission were present. He felt (1) the list was only of "potential" items which he felt was not complete, (2) he felt there were no controls, and (3) he did not care for these kinds of uses. Much discussion ensued regarding the sale of these types of items at a service station such as this. Commissioner Vierhus moved that UP 79-1 be continued to the March 6, 1979, Planning Commission meeting, seconded by Commissioner Kasolas and unani- mously adopted. . .~ .,. MISCELLANEOUS TS 79- 3 Lands of May Investment Co. Tentative Subdivision Map: Lands of May Investment Co., Inc. APN 413-13-30, 43 & 44 Mr. Kee reported that at its regularly scheduled meeting of February 12, 1979, the City Council adopted Ordinance No. 1211 approving the applicant's plans, elevations, and development schedule to allow construction of 36 patio homes on property known as 571 and 595 Union Avenue in a P-D (Planned Development/ Low-Medium Density Residential) Zoning District. Condition "P" of Ordinance No. 1211 required the applicant to process and file a tract map. The attached map would meet this requirement. The Gene rat Plan indicates Low-Medium Density Residential (between 6 and 13 units per acre) for this area. The approved plans would be developed at a density of 11.45 units per acre. - 8- Commissioner Vierhus moved that the Planning Commission find that the proposed tract map is in conformance with the General Plan, and recommend that the City Council approve this map subject to the conditions listed in the Staff Comment Sheet. This motion was seconded by Commissioner Dickson and unanimously adopted. a a TS 79-4 Tentative Subdivision Map: Lands of Wilson Lands of Wilson APN: 305-31'6• Mr. Kee reported that at its regularly scheduled meeting of September 11, 1978, the City Council adopted Ordinance No. 1186 approving the applicant's plans, elevations, and development schedule to allow construction of five townhomes on property known as 257 W. Rincon Avenue in a P-D (Planned Development/Medium Density Residential) Zoning District. Condition "R" of Ordinance No. 1186 required the applicant to process and file a tract map. The attached map would meet this requirement. The General Plan indicates Medium Density Residential (between 14 and 20 units per acre) for this area. The approved plans would be developed at a density of 14.3 units per acre. Commissioner Dickson moved that the Planning Commission find that the proposed tract map is in conformance with the General Plan, and recommend that the City Council approve this map subject to the conditions listed in the Staff Comment Sheet. This motion was seconded by Commissioner Vierhus and unanimously adopted. a Staff Report Noise Ordinance Acting Chairman Pack noted that there were several recommendations for modification which she felt should be made and suggested that this item be continued. Mr. Kee stated that there would not be a problem with a continuance; staff is soliciting comments at this time. Commissioner Vierhus moved that the draft Noise Ordinance be continued to the March 20, 1979, Planning Commission meeting, seconded by Commissioner Kasolas and unanimously adopted. ~;~t ADJOURNMENT Commissioner Dickson moved that the meeting be adjourned, seconded by Commissioner Kasolas and unanimously adopted.
