MINUTES DECEMBER 19, 1978 The Planning Commission of the City of Campbell convened this day in regular session at the regular meeting place, the Council Chambers of the City Hall, 75 North Central Avenue, Campbell, California. APPROVAL OF MINUTES Commissioner Vierhus moved that the minutes of the regular meeting of December 5, 1978 be approved as submitted, seconded by Commissioner Samuelson and unanimously adopted. COMMUNICATIONS Mr. Kee reported that communications received relate to specific items on the agenda and would be considered at the time the item is discussed. ARCHITECTURAL APPROVALS S 78-14 Continued application of Mr. Guy Ruscigno for approval Ruscigno, G. of plans to construct a 14-unit apartment project on property known as 166 and 180 Shelley Avenue in an R-M (Multiple Family/Low-Medium Density Residential) Zoning District. Mr. Kee reported th at the applicant had submitted a request for extension of this application to the January 16, 1979 Planning Commission meeting in order that revised plans could be submitted. Commissioner Dickso n moved that S 78-14 be continued to the Planning Commission meeting of January 16, 1978, seconded by Commissioner Samuelson and unanimously adopted. :; :: ;: S 78-40 Application of Mr. Dana Pefferle for approval of Pefferle, D. plans to construct an office building on property known as 197 E. Hamilton Avenue in a C-1-S (Neighborhood Commercial) Zoning District. -2- Commissioner Vierhus reported that the applicant had met with the Site and Architectural Review Committee this morning, and after reviewing the plans and adding condition No. 1, "Parking reserve indicated on site plans may be required to be installed if the Planning Commission determines there is need for additional parking at a future date," the Committee is recommending approval of this application. The Committee felt that the four existing trees on the site should remain if at all possible and until such time as the parking is needed it would not be necessary to remove the trees. Commissioner Dickson moved that S 78-40 be approved subject to the following conditions: 1. Parking reserve indicated on site plans may be required to be installed if the Planning Commission determines there is need for additional parking at a future date. 2. Landscaping plan indicating type and size of plant material, and location of hose bibs or sprinkler system to be submitted for approval of the Planning Director prior to application for building permit. 3. Fencing plan indicating location and design details of fencing to be submitted for approval of Planning Director prior to application for building permit. 4. Landscaping and fencing shall be maintained in accordance with the approved plan. 5. Applicant to either (1) post a faithful performance bond in the amount of $5,000 to insure landscaping, fencing, and striping of parking areas within three months of completion of construction, or (2) file written agreement to complete landscaping, fencing and striping of parking areas prior to final Building Department clearance. 6. All mechanical equipment located on roofs to be screened as approved by the Planning Director. The applicant is notified as part of this application that he/she is required to meet the following conditions in accordance with Ordinances of the City of Campbell and Laws of the State of California. A. All parking and driveway areas to be developed in compliance with Section 21.50 of the Campbell Municipal Code. All parking spaces to be provided with appropriate concrete curbs or bumper guards. B. Underground utilities to be provided as required by Section 20.16.070 of the Campbell Municipal Code. C. Plans submitted to the Building Department for plan check shall indicate clearly the location of all connections for underground utilities including water, sewer, electric, telephone and television cables, etc. D. Sign application to be submitted in accordance with provisions of the sign ordinance for all signs. No sign to be installed until application is approved and permit issued by the Building Department. (Section 21.68.070 of the Campbell Municipal Code.) E. Ordinance No. 782 of the Campbell Municipal Code stipulates that any contract for the collection and disposal of refuse, garbage, wet garbage and rubbish produced within the limits of the city of Campbell shall be made with Green Valley Disposal Company. This requirement applies to all single-family dwellings, multiple apartment units, to all commercial, business, industrial, manufacturing, and construction establishments. -3- F. Trash container(s) of a size and quantity necessary to serve the development shall be located in area(s) approved by the Fire Department. Unless otherwise noted, enclosure(s) shall consist of a concrete floor surrounded by a solid wall or fence and have self-closing doors of a size specified by the Fire Department. All enclosures to be constructed at grade level. G. Applicant shall comply with all appropriate State and City requirements for the handicapped. FIRE DEPARTMENT H. Provide an automatic fire extinguishing system, including garage. I. Provide 2A-IOBC fire extinguishers. PUBLIC WORKS DEPARTMENT J. Pay storm drainage area fee of $489. K. Obtain an excavation permit for driveway installation and any other work in the public right of way. L. Provide evidence of right to tie into the adjoining property's storm system satisfactory to the City Engineer. BUILDING DEPARTMENT M. Walls less than 40' to property line shall be minimum 1 Hr. construction (Section 2203) . The applicant is notified that he/she shall comply with all applicable Codes or Ordinances of the City of Campbell which pertain to this development and are not herein specified. This motion was seconded by Commissioner Campos and unanimously adopted. .,. ~. .~ S 78-41 Application of Mr. David R. Schrader for approval Schrader, D. of plans to construct an industrial building on property known as 213 Cristich Lane in an M-1-S (Light Industrial) Zoning District. Commissioner Vierhus reported that the Site and Architectural Review Committee is recommending approval of this application, calling specific attention to Conditions Nos. 2, 3 and 9. He noted that the concerns of the Architectural Advisor had been resolved and the applicant was in agreement with the suggestions made by the Advisor. Commissioner Samuelson moved that S 78-41 be approved subject to the following conditions: 1. Revised elevations to be approved by the Planning Director upon recommendation of the Architectural Advisor. 2. Property to be fenced and landscaped as indicated and/or added in red on plans. -4- 3. Landscaping plan indicating type and size of plant material, and location of hose bibs or sprinkler system to be submitted for approval of the Planning Director prior to application for building permit. 4. Fencing plan indicating location and design details of fencing to be submitted for approval of Planning Director prior to application for building permit. 5. Landscaping and fencing shall be maintained in accordance with the approved plan. 6. Applicant to either (1) post a faithful performance bond in the amount of $3,000 to insure landscaping, fencing, and striping of parking areas within three months of completion of construction, or (2) file written agreement to complete landscaping, fencing and striping of parking areas prior to final Building Department clearance. 7. Applicant to submit a letter, satisfactory to the City Attorney, limiting the use of the property to: 1,200 square feet of office use, 1,800 square feet of speculative industrial use, and -0- feet of warehouse use. 8. All mechanical equipment located on roofs to be screened as approved by the Planning Director. 9. Rear of property to be oiled and screened. The applicant is notified as part of this application that he/she is required to meet the following conditions in accordance with Ordinances of the City of Campbell and Laws of the State of California. This motion was seconded by Commissioner Meyer and unanimously adopted. ~ ~ ~ S 78-42 Application of Mr. Dale O'Toole and Vasona Associates O'Toole, D. for approval of plans to construct 20 condominium units Vasona Assoc., on property known as 101 Redding Road in an R-2-S (Multiple Family/Medium Density Residential) Zoning District. Commissioner Vierhus reported that the Site and Architectural Review Committee met with the applicant this morning, and the Architectural Advisor's concerns (primarily regarding the roof line) were resolved. The Committee is recommending approval subject to the conditions listed in the Staff Comment Sheet. At this time Mr. Kee noted that the General Plan indicates that up to 14-20 units per acre would be allowed on this property, and the density of this development is only 16.5 units per acre. Chairman Pack inquired about Redding Road and the ingress and egress onto Whiteoaks; she mentioned that this location had been discussed previously and wondered if there was still a problem at this location. Engineering Manager Helms responded that there had been a site obstruction problem, however it fell within the County's Jurisdiction and the County was going to contact the property owner regarding the trimming of the bushes. Commissioner Dickson moved that S 78-42 be approved subject to the following conditions: 1. Provide one street fire hydrant. J. Provide one on-site fire hydrant connected to a fire service. K. Provide 2A-IOBC fire extinguishers. PUBLIC WORKS DEPARTMENT L. Process and file a tract map. M. Provide a copy of the preliminary title report. N. Pay the storm drainage area fee in the amount of $941. 0. Dedicate right of way to 30 feet from centerline of Redding Road. P. Enter into an agreement to install street improvements or Join a local improvement district in the future and provide surety to guarantee the improvements. -7- Q. Obtain an excavation permit for any work in the public right of way. The applicant is notified that he/she shall comply with all applicable Codes or Ordinances of the City of Campbell which pertain to this develop- ment and are not herein specified. This motion was seconded by Commissioner Samuelson and unanimously adopted. ~ :: ~ PD 78-10 Closed public hearing (referral from the City Council) Perfecto, C. to consider the application of Carlos and Maria Perfecto for approval of plans, elevations and development schedule to allow construction of a residence on the rear of property known as 109 South Fourth Street in a P-D (Planned Development/Medium Density Residential) Zoning District. Mr. Kee reported that at the November 27, 1978 City Council meeting this item was referred back to the Planning Commission, at the applicant's request, in order that revised plans could be considered. He noted that when this item was last reviewed by the Commission the applicant had not appeared before the Commission nor had he submitted revised plans; thus, the Commission rendered a recommendation of denial of this application to the City Council. He further reported that the revised plans call for the construction of only one single-family dwelling and the previously submitted plans had called for the addition of two residential units at the rear of the property. Commissioner Vierhus reported that the Site and Architectural Review Committee is recommending approval of the revised plans subject to the conditions listed in the Staff Comment Sheet. He stated that the revised plans were much improved over the previously submitted plans. Much discussion ensued regarding the manner in which the City Council referred this item back to the Commission, and whether or not a public hearing should have in fact been reopened. City Attorney Dempster advised the Commission that the City Council could refer an application back to the Commission without having to hold a public hearing on the item. He explained that the public hearing is still open at the Council level, and a final decision on the item would be made after the Commission makes a recommendation. He further noted that this is the manner in which the Council chose to handle it. It was the consensus of the Commission that concern should be expressed to the Council regarding the manner of procedure of this referral, since questions had been raised about the public hearing status. Commissioner Vierhus moved that PD 78-10, application of Mr. Carlos Perfecto, be approved subject to the conditions listed in the Staff Comment Sheet, seconded by Commissioner Samuelson and unanimously adopted. ~ ~ ~ ZC 78-15 Request of Jackson Homes for approval of revised Jackson Homes site plans and elevations for five single-family Jackson, T. detached homes on property located at 1428 and 1440 W. Hacienda Avenue. Commissioner Vierhus reported that the Site and Architectural Review Committee, after reviewing the revised site plans this morning with the applicant, is recommending approval. He noted that all the concerns of the Architectural Advisor have been resolved. -8- Mr. Powell displayed the plans and reviewed the red-lined areas with the Commission. Commissioner Dickson moved that ZC 78-15, request of Jackson Homes, be approved, seconded by Commissioner Meyer and unanimously adopted. PUBLIC HEARINGS PD 78-23 This is the time and place fora public hearing Knight, R. to consider the request of Mr. Roger K. Knight Arthur Development and the Arthur Development Company for approval of plans, elevations, and development schedule to allow construction of a fast-food restaurant with a drive-thru window on property known as 771 W. Hamilton Avenue in a P-D (Planned Develop- ment/Commercial) Zoning District. Commissioner Vierhus noted that the Site and Architectural Review Committee is recommending a continuance of this item until the January 16, 1979 Planning Commission meeting in order that a revised traffic circulation pattern can be worked out. He noted that this restaurant will be replacing a service station tl-iat has been closed. Cammissioner Campos inquired how the traffic circulation pattern would be modified. Mr-. Helms responded that one of the problems encountered was an ingress/egress problem; and there is a driveway located too close to Hamilton Avenue. CI-iairman Pack declared the public hearing open and invited anyone in the audience to speak for or against this item. No one wishing to be heard, Commissioner Vierhus moved that PD 78-23 be continued to the January 16, 1979 Planning Commission meeting, seconded by Commissioner Samuelson and unanimously adopted. ;~: ;~ PU 78-24 This is the time and place for a public hearing May Investment Co. to consider the application of May Investment Company for approval of plans, elevations and development schedule to allow construction of 36 patio homes on property known as 808 McGlincey Lane and 571 and 595 Union Avenue in a P-D (P) (Prezoned Planned Development/Low-Medium Density Residential) Zoning District. Cammissioner Vierhus reported that the Site and Architectural Review Committee, ai-ter meeting with the applicant this morning, is recommending a continuance to the first meeting in January in order that concerns of the Traffic Engineer could be; reso 1 ved . Chairman Pack declared the public hearing open and invited anyone in the audience to speak for or against this item. -9- Mr. Robert Buechel of 989 Dry Creek Road, Campbell appeared before the Commission to express his concern about the storm drains overflowing which abut his property, and noted that any further development of the area would exceed the capacity of these storm sewers. He further noted that when the drains overflow the water runs down his driveway, flooding his garage and basement. Mr. Helms stated that this area is not within the City of Campbell, therefore he is not familiar with the drainage system. He reported, however, that the problem would be checked out before approving this application. Judy Bristow of 940 Dry Creek Road appeared to express her concern about the increased amount of traffic generated in the area and the safety of children crossing Dry Creek Road to attend school. She inquired if a one-way street would be feasible. Mr. Helms stated that it is planned to have a two-lane street with a continuous 2-way, left turn lane. He noted that staff didn't feel a one-way street would be appropriate for the area. Mr. Kee noted at this time that the density had recently been changed by the Planning Commission and City Council; density was reduced from 27 units per acre to 13 units per acre (maximum) which was a considerable change in the land use on this parcel. No one else wishing to be heard, Commissioner Vierhus moved that PD 78-24 be continued to the January 2, 1979 Planning Commission meeting, seconded by Commissioner Samuelson and unanimously adopted. ;ti :: ZC 78-20 This is the time and place for a continued Fontaine, P. public hearing to consider the application of Mr. Paul E. Fontaine and the Barnes-Fontaine Development Company for: (1) a change of zoning from R-1 (Single-Family/Low Density Residential) to P-D (Planned Development/Low Density Residential), and (2) approval of plans, elevations, and develop- ment schedule to allow the addition of four single- family residences to an existing single-family development located on property known as 1300 and 1310 Harriet Avenue. Commissioner Vierhus reported that after meeting with the applicant this morning, the Site and Architectural Review Committee is recommending approval subject to the conditions listed in the Staff Comment Sheet with the addition of Condition "V" under Public Works which should read "Move driveway as redlined on plans" and noting that Condition No. 2 requires that the landscape plan come back to the Planning Director. Commissioner Dickson expressed his concern about the long driveways on recent applications. Chairman Pack inquired about the use of surrounding properties. Mr. Kee noted that the surrounding property is mostly residential. -IU- Commissioner Campos also expressed his concerns about long driveways, stating he felt they were glorified alleyways. He further noted that there would be the possibility of abandoned cars and jurisdiction. Mr. Kee noted that the driveway would be covered by the CC&R's which are a requirement of the subdivision map. Chairman Pack declared the public hearing open and invited anyone in the audience to speak for or against this item. Ms. Wilfred Mason, who lives at the corner of Hacienda and Freda, expressed her appreciation to the Commission for their concern about the long narrow driveways, since there have been many developments going in recently in that area. Kathryn Hale of 1190 Glenblair Way, Campbell, expressed her opposition to the many zone changes in the area. She felt since this area is currently under study by the City Council, future zone changes should not be considered until some groundwork is determined. Mr. Kee noted to the Commission that at last evening's Council meeting a discussion was held regarding a moratorium in the San Tomas Area; however, applications in process should continue along since there is not a moratorium at this time. He noted that the City Attorney and himself were requested to report back to the City Council at the next meeting regarding a moratorium. No one else wishing to be heard, Commissioner Dickson moved that the public hearing be closed, seconded by Commissioner Meyer and unanimously adopted. RESOLUTION N0. 1758 Commissioner Vierhus moved that the Planning Commission adopt Resolution No. 1758 recommending a change of zoning from R-t (Single-Family/Low Density Residential) to P-D (Planned Development/ Low Density Residential) for property known as 1300 and 1310 Harriet Avenue, seconded by Commissioner Samuelson and unanimously adopted by the following roll call vote: AYES: Commissioners: Campos, Meyer, Dickson, Samuelson, Vierhus, Pack NOES: Commissioners: None ABSENT: Commissioners: Kasolas RESOLUTION N0. 1759 Commissioner Vierhus moved that the Planning Commission adopt Resolution No. 1759 recommending approval of plans, elevations, and development schedule to allow the addition of four single-family residences to an existing single- family development located on property known as 1300 and 1310 Harriet Avenue with added condition No. "V" to read "Move driveway as redlined on plans," seconded by Commissioner Samuelson and unanimously adopted by the following roll call vote: AYES: Commissioners: Campos, Meyer, Dickson, Samuelson, Vierhus, Pack NOES: Commissioners: None ABSENT: Commissioners: Kasolas a ~_ .~ The Commission took a break at 9:00 p.m.; the meeting reconvened at 9:10 p.m. .4 GP 76-2-C This is the time and place for a continued public Campbell Elementary hearing to consider the future use of the Campbell School Site Elementary School site located on property known at 51 E. Campbell Avenue. Mr. Kee noted that this item was continued from the Planning Commission meeting of May 16 in order to allow additional time for consideration of the Open Space Element of the General Plan and an Open Space Ordinance; at a recent meeting of the Council, both the Element and Ordinance were adopted. He further reported that on December 11 the Council took action to request a 90-day extension of time on the deadline for submitting a proposal; in addition, the Council requested that the Grammar School Task Force members continue to be available to serve on this Task Force during the anticipated 90-day period. Since it is likely that there will continue to be an exchange of information between the City and the School District in the next three months, staff is recommending that this item be continued until such time as more information is available (April 1979)• Commissioner Dickson moved that GP 76-2-C be continued to the second meeting in April 1979, seconded by Commissioner Meyer and unanimously adopted. a ~ .~ MISCELLANEOUS TS 78-14 Tentative Subdivision Map: Lands of Kulick Lands of Kulick APN: 405-20-029 Mr. Kee stated that as a condition of approval of an ordinance adopted approving the applicant's plans, elevations, and development schedule to construct a six-unit townhouse development on property known as 1189 Bracebridge Court, a tract map must be filed and the map submitted would meet this requirement. Commissioner Vierhus moved that the Planning Commission find that the proposed tract map is in conformance with the General Plan, and that the Commission recommend that the Council approve this map subject to the conditions listed in the Staff Comment Sheet, seconded by Commissioner Samuelson and unanimously adopted. ;~ -t2- TS 78-16 Tentative Subdivision Map: Lands of Maslesa. Lands of Maslesa APN: 279-40-029 Mr. Kee reported that as a condition of approval of an ordinance adopted approving the applicant's plans to add a duplex condominium to an existing single-family development located on property known as 236 N. Central Avenue, a tract map must be filed and the map submitted would meet this requirement. Commissioner Samuelson moved that the Planning Commission find that the proposed tract map is in conformance with the General Plan, and that the Commission recommend that the Council approve this map subject to the conditions listed in the Staff Comment Sheet, seconded by Commissioner Vierhus and unanimously adopted. ~. Ad Hoc Committee Referral from the City Council to appoint a San Tomas Area representative to the Ad Hoc Committee for the San Tomas Area. Chairman Pack appointed Commissioner Campos to serve on the subject committee, and appointed Commissioner Dickson as the alternate. Staff Report Staff report on the 236 Federally subsidized San Tomas Gardens housing project located at 825 South San Tomas Apartments Aquino Road in an R-2-S (Multiple Family/Medium Density Residential) Zoning District. Mr. Kee noted that reports had been received from both the Police and Fire Departments. Chairman Pack inquired if the memo from the Fire Department had also been sent to the Police Department. Mr. Kee stated that he would see to it that the Police Department receives a copy of the memorandum. Commissioner Vierhus then moved that the subject report be acknowledged and filed, seconded by Commissioner Samuelson and unanimously adopted. .4 .4 .1. Nomination of Officers Planning Commission - 1979 Chairman Pack called for nominations for Chairman of the Planning Commission for 1979. Commissioner Vierhus nominated Commissioner Samuelson to serve as Chairman for 1979, this was seconded by Commissioner Meyer. Commissioner Vierhus moved that nominations for Chairman be closed, seconded by Commissioner Meyer and unanimously adopted. Commissioner Vierhus then nominated Commissioner Campos to serve as Vice Chairman for 1979, this was seconded by Commissioner Samuelson. -13- Commissioner Vierhus moved that nominations for Vice Chairman be closed, seconded by Commissioner Samuelson and unanimously adopted. It was announced that a white ballot vote would be held at the next Planning Commission meeting. J. J. .4 ANNOUNCEMENTS Chairman Pack welcomed and introduced a guest in the audience, former Planning Commissioner Don Hebard. At this time the Chairman announced the Planning Commission get-together to be held at her home on Friday, December 29, 1978, beginning at 7 p.m. She noted that each member would be sent a reminder of the date.
