MINUTES AUGUST 1, 1878 The Planning Commission of the City of Campbell convened this day in regular session at the regular meeting place, the Council Chambers of the City Hall, 75 North Central Avenue, Campbell, California. ROLL CALL Commissioners: Campos, Dickson, Samuelson, Vierhus, Kasolas, Chairman Pack; Secretary Arthur A. Kee; Present Senior Planner Philip J. Stafford; Engineering Manager Bill Helms; City Attorney J. Robert Dempster; Recording Secretary Jeannine Wade. Absent None APPROVAL OF Commissioner Vierhus moved that the minutes of the MINUTES regular meeting of July 18, 1978 be approved, seconded by Commissioner Samuelson and unanimously adopted. COMMUNICATIONS Mr. Kee infor med the Commission that items received relate to specific items on the agenda and would be discussed at the time the item is considered. At this time Chariman Pack stated that, with the Commission's approval, Item No. 12 would be considered before Item No. 9 since Mrs. Fairbanks was in the audience and wished to speak on that item. ARCHITECTURAL APPROVALS g 7$-27 Application of Mr. Marvin A. Bamburg, A.I.A., for Bamburg, M. approval of plans to add a duplex to an existing single-family development located on property known as 236 N. Central Avenue in an R-M (Multiple Family/ Low-Medium Density Residential) Zoning District. Commissioner Vierhus reported that this item had been reviewed by the Site and Architectural Review Committee this morning, and is recommending approval subject to the conditions listed in the Staff Comment Sheet with an added condition that CC&R's are to be submitted to the Public Works Department for approval. Mr. Kee stated that staff is also recommending approval. He indicated that a communication had been received this morning from the applicant which stated that this project had been referred to as a "duplex" in the application, however it should have been referred to as "condominiums." He indicated that the plans before the Commission were for two condominium units which would be constructed in the rear portion of an 11,200 square foot lot, and there is an existing single-family structure which will remain. He reported that the Architectural Advisor is of the opinion that the design is acceptable. After much discussion, Commissioner Vierhus moved that S 78-27 be approved subject to the following conditions which includes the added Condition No. 8 "CC~R's to be submitted to the Public Works Department for approval": 1. Property to be fenced and landscaped as indicated and/or added in red on plans. 2. Landscaping plan indicating type and size of plant material, and location of hose bibs or sprinkler system to be submitted for approval of the Planning Director prior to application for building permit. 3. Fencing plan indicating location and design details of fencing to be submitted for approval of Planning Director prior to application for building permit. 4. Landscaping and fencing shall be maintained in accordance with the approved plan. 5. Applicant to either (1) post a faithful performance bond in the amount of $3,000 to insure landscaping, fencing, striping of parking areas within three months of completion of construction, or (2) file written agreement to complete landscaping, fencing and striping of parking areas prior to final Building Department clearance. 6. All mechanical equipment located on roofs to be screened as approved by the Planning Director. 7. Elevations of carport structure to be approved by the Planning Director. 8. CC~R's to be submitted to the Public Works Department for approval. The applicant is notified as part of this application that he/she is required to meet the following conditions in accordance with Ordinances of the City of Campbell and Laws of the State of California. A. All parking and driveway areas to be developed in compliance with Section 21.50 of the Campbell Municipal Code. All parking spaces to be provided with appropriate concrete curbs or bumper guards. 6. Underground utilities to be provided as required by Section 20.16.070 of the Campbell Municipal Code. -2- C. Plans submitted to the Building Department for plan check shall indicate clearly the location of all connections for underground utilities including water, sewer, electric, telephone and television cables, etc. D. Sign application to be submitted in accordance with provisions of the sign ordinance for alt signs. No sign to be installed until application is approved and permit issued by the Building Department. (Section 21.68.070 of the Campbell Municipal Code.) E. Ordinance No. 782 of the Campbell Municipal Code stipulates that any contract for the collection and disposal of refuse, garbage, wet garbage and rubbish produced within the limits of the city of Campbell shall be made with Green Valley Disposal Company. This requirement applies to all single-family dwellings, multiple apartment units, to all commercial, business, industrial, manufacturing, and construction establishments. F. Trash container(s) of a size and quantity necessary to serve the development shall be located in area(s) approved by the Fire Department. Unless other- wise noted, enclosure(s) shall consist of a concrete floor surrounded by a solid wall or fence and have self-closing doors of a size specified by the Fire Department. All enclosures to be constructed at grade level. G. Applicant shall comply with all appropriate State and City requirements for the handicapped. H. Noise levels for the interior of residential units shall comply with minimum State (Title 25) and local standards as indicated in the Noise Element of the Campbell General Plan. PUBLIC WORKS DEPARTMENT I. Pay storm drainage area fee of $198. J. Provide a grading and drainage plan for the review of the City Engineer. K. Obtain an excavation permit to relocate the existing driveway approach and modify the existing drop inlet. The applicant is notified that he/she shall comply with all applicable Codes or Ordinances of the City of Campbell which pertain to this development and are not herein specified. This motion was seconded by Commissioner Samuelson and unanimously adopted. At this time Chairman Pack expressed her concern about the traffic conditions on Central Avenue, noting that there was barely enough room for two cars to pass on the street. Mr. Helms noted that at the present time the Public Works Department is trying to de-emphasize this as a collector; the present count is approximately 4,500 cars per day. He further noted that he felt there were things that could be done to substantially bring the volume down and the Public Works Department has agreed to discuss some of these alternatives with the City Council. '.: :: :C - 3- PUBLIC HEARINGS ZC 78-7 This is the time and place for a continued public Wilson, A. hearing to consider the application of Mr. Alfred M. Wilson for: (l) a change of zoning from R-2-S (Multiple Family/Medium Density Residential) to P-D (Planned Development/Medium Density Residential), and (2) approval of plans, elevations., and development schedule to allow construction of five townhomes on property known as 257 41. Rincon Avenue. Commissioner Vierhus reported that the applicant had met with the Site and Architectural Review Committee this morning. He stated that the Committee is recommending approval of the plans as submitted; the original proposal had been for seven units, and the current proposal is for the construction of only five units with the elimination of tandem parking. He noted that the Committee is recommending the addition of the condition that "Revised elevations to be approved by the Planning Director upon recommendation of the Architectural Advisor.'" Mr. Kee noted that staff is recommending approval and further stated that in order for the units not to face the single-family dwellings adjacent to the property, the developer has placed the units on the opposite side of the lot. Commissioner Vierhus stated that rather than one foot of landscaping being placed adjacent to the driveway, an additional foot of landscaping will be placed adjacent to the units in order that it might be more easily maintained. Chairman Pack invited anyone in the audience to speak for or against this item. No one wishing to be heard, Commissioner Dickson moved that the public hearing be closed, seconded by Commissioner Samuelson and unanimously adopted. RESOLUTION N0. 1717 Commissioner Vierhus moved that the Planning Commission adopt Resolution No. 1717 recommending that the City Council change the zoning from R-2-S (Multiple Family/ Medium Density Residential) to P-D (Planned Development/ Medium Density Residential) for property known as 257 W. Rincon Avenue (ZC 78-7), seconded by Commissioner , Dickson and unanimously adopted by the following roll call vote: AYES: Commissioners: Campos, Dickson, Samuelson, Vierhus, Kasolas, Pack NOES: Commissioners: None ABSENT: Commissioners: None -4- RESOLUTION N0. 1718 Commissioner Vierhus moved that the Planning Commission adopt Resolution No, 1718 recommending that the City Council approve th.e plans, elevations, and development schedule to allow construction of five townhomes on property known as 257 W. ZC 78-9 This is the time and place for a continued public Schwoob, T. hearing to consider the application of Messrs. Profit, S. Thomas Schwoob and Spencer Profit for a change of zoning from R-2-S (Multiple Family/Medium Density Residential) to P-D (Planned Development/Medium Density Residential) for property known as 338 W. Rincon Avenue. Mr. Kee reported that staff is recommending a continuance of this application to the Planning Commission meeting of September 5, 1978 since the applicant has requested a continuance to that time in order to submit the site approval along with the rezoning application. There being no one in the audience wishing to speak on this item, Commissioner Campos moved that ZC 78-9 be continued to the September 5, 1978 Planning Commission meeting, seconded by Commissioner Samuelson and unanimously adopted. J~ i4 .• ZC 78-10 This is the time and place for a continued public (1) May Investment, hearing to consider: Inc. (2) City of Campbell (1) The application of May Investment, Inc., for prezoning of three lots, APNs 413-13-30, 44, and 43, known as 808 McGlincey Lane, 595 Union Avenue, and 571 Union Avenue, for P-D (Planned Development) Zoning; and (2) The application of the City of Campbell for prezoning of property located on the southerly side of McGlincey Lane and westerly of Union Avenue, known as APNs 413-13-28, 29, and 80, and 413-48-36, 66, 67 and 63) for M-1-S (Light Industrial), R-1 (Single-Family Residential), and P-D (Planned Development) Zoning. -5- Mr. Kee explained to the Commission that this application should be considered in two parts, He gave some background on Area 1 by stating that the City Council (at its July 24 meeting) considered the Planning Commission's recom- mendations for possible amendments to the Land Use Element of the General Plan for this area; the Council endorsed the Commission's recommendation that called for "Low-Medium Density Residential" for 595 and 571 Union Avenue. He went on to say that staff is recommending P-D zoning for these two. parcels in accord with the applicant's (May Investment,lnc.) request and because of the additional control it will give the City in regulating the eventual development of the area (in addition, the property owner indicated his intention to build townhouse units on the lots). Mr. Kee noted the P-D zoning would accommodate this type of development. He stated that the property known as 808 McGlincey Lane is currently shown as "Industrial" on the Land Use Element of the General Plan and due to the fact that the Council took no action on this lot staff is recommending M-1-S (Light Industrial) zoning, since the zoning must be consistent with the Land Use Element of the General Plan. Area 2 Mr. Kee noted that the prezoning for Area 2 was initiated by the City after an app}ication had been filed for prezoning of Area 1. At its July 24 meeting the Council heard new evidence from the owners of the large parcel fronting on McGlincey and basically the owners were requesting that an "Industrial" land use be shown for the entire property, and that the "Low Density Residential" land use be eliminated. He stated that after considering this new evidence the Council took action to refer Area 2 back to the Planning Commission for additional testimony, and that staff would be agendizing this before the Planning Commission on August 15; if the Commission makes a recommendation to the Council at that time it would be considered by the Council on August 28 at the earliest, and for this reason staff is recommending that the prezoning for Area 2 be continued until after the Council has had an opportunity to arrive at a decision regarding the land use for the area. Commissioner Dickson inquired if since this is a prezoning to P-D whether he was correct in assuming that no plans would be presented at this time. Mr. Kee responded affirmatively; no plans need be submitted at this juncture. Chairman Pack inquired what the purpose of prezoning was at this time, expecially since it was recommended for P-D. Mr. Kee stated that the applicant has indicated to the Commission and Council that he would ultimately like to build townhouses on the site and in order to do that he would need a P-D zone. The City Council did not wish to see plans at the time of the General Plan hearings. -6- Chairman Pack invited anyone in the audience to speak. on this items Mr. Fred Wagener of 690 Parkdale Drive appeared before the Commission to state that nothing has been done in the Union Avenue area in regard to the traffic, and the traffic problems will only become worse by additional development in the area. Chairman Pack inquired about the status of the improvement of Union Avenue. Mr. Helms responded that it is proposed to improve all of Union Avenue from Campbell Avenue to the southerly city limits by a Local Improvement District proceeding whereby all of the property owners are charged for improvements, and what it takes is a petition signed by 60 percent of the property owners. He further explained that as each of the properties develops it is required that they enter into agreements to form the District. Mr. Lee Browne of 1454 DeTracey, San Jose (representing the owner of Area 1) appeared before the Commission to ask for a favorable rendering on the P-D zoning in order that plans could be submitted to the Planning Department accordingly. He indicated the owner had hoped the Commission could take action this evening. Mr. Steve Werthman of 2211 Central Park Drive inquired what the status was of the~area in which his property is located (Area 2). Mr. Kee responded that Area 2 has been referred back to the Planning Commission and additional testimony could be heard at the August 15 Planning Commission meeting at which time the Commission would again be considering the area. He further indicated that there were no changes recommended for his property (it is currently Low Density Residential), however they did not want to overlook any area. No one else wishing to be heard, Commissioner Dickson moved that the public hearing be closed for Area 1 of ZC 78-10, seconded by Commissioner Vierhus and unanimously adopted. Commissioner Dickson then moved that Area 2 of ZC 78-10 be continued to the Planning Commission meeting of September 5, 1978, seconded by Commissioner Samuelson and unanimously adopted. Commissioner Dickson inqured of Mr. Kee about the prezoning of this property. Mr. Kee responded that the ordinance states that prezoning would work the same way as regular zoning, however it is required to prezone before any annexation. Commissioner Dickson questioned the P-D zoning at this juncture since the ordinance states that "more desirable development and use of land" should be evidenced before a P-D is issued. 7- Mr. Kee stated that it would be in the best interest of the City to have the P-D zoning for better control, and it would be more compatible than the R-M zoning. He further indicated that a P-D permit was not being issued at this time; only the zoning was being considered. He stated that in order to have the P-D permit issued plans, elevations, and development schedule must be approved by the Commission and Council,. Commissioner Dickson stated he felt the P-D should demonstrate that what is proposed is better than existing zoning. City Attorney Dempster explained that the P-D zoning gives the City added protection. Commissioner Dickson explained that his concern was that the City is going more and more toward P-D which takes free enterprise type operations away from the people. Chairman Pack recalled that there had been an "S" approval for that area, and inquired if it would still be in effect if this zone change occurred. Mr. Kee responded that if the time limit runs out the applicant would need to apply for an extension; if he chooses to go ahead with it, it would be considered a valid site approval. Area 3 Mr. Stafford displayed a map of the area and noted that at the time of a prezoning for annexation in this area it was recommended by the Planning Commission that the area be zoned R-1, and the City Council did uphold the Planning Commission's recommendation to change from Low-Medium to Low Density the properties currently in the city of Campbell. Chairman Pack recollected that it had been staff's recommendation to prezone the area R-M, however after hearing testimony from the adjacent property owners it was decided to prezone the area R-1 since they felt the area had a rural character which shouid be preserved. Chairman Pack invited anyone in the audience to speak for or against this item. Mr. Jerrel D. Bonds of 1165 Smith Avenue appeared before the Commission to speak against the lower density. He stated he felt that a higher density should be allowed; and that it takes a lot of time to maintain that much area. Mr. Winston C. Long of 1177 Smith Avenue also spoke in favor of retaining a higher density for the area. He stated that there are no traffic problems on Smith Avenue, it is relatively quiet street. Mr. Randy Ilich of 1822 Palo Santo, representing his mother, stated that his mother owns 1143 Smith Avenue and there are currently six units on the site. He indicated that she is dependent upon this property for income and if it were rezoned and the buildings were destroyed by fire they would not be able to rebuild that many units on the site thus leaving his mother without an income. He felt the property should remain R-M. Mr. Scelline of 1182 Smith Avenue spoke in favor of the lower density, noting however that he could understand why his neighbors were in favor of higher density. He felt the traffic was pretty heavy; cars used the street as a speedway. He also felt that people wanted to make a profit and leave the area. -10- Mr. Kee gave additional background on this area by reading to the Commission and persons i.n the audience the minutes of the. March 21, 1978 Planning Commission meeting which noted that the property owners were in favor of a lower density. Much discussion ensued regarding the possibility of leaving a portion of Area 3 at a higher density and reducing the density only for the parcel (1142 Smith) on the south side of Smith Avenue. No one else wishing to be heard, Commissioner Vierhus moved that the public hearing be closed, seconded by Commissioner Dickson and unanimously adopted. RESOLUTION N0. 1722 Commissioner Dickson moved that the Planning Commission adopt Resolution No. 1722 recommending that the City Council change the zoning of 1142 Smith Avenue from R-M to R-1, based on evidence received at the public hearing, seconded by Commissioner Vierhus and adopted by the following roll call vote: AYES: Commissioners: Campos, Dickson, Samuelson, Vierhus, Pack NOES: Commissioners: Kasolas ABSENT; Commissioners: None Mr. Kee noted at this time that the originally proposed change for R-1 had initiated the General Plan change effected on June 26, 1978 and since the Commission is now recommending R-M the General Plan would again need to be changed in order that the proposed zoning could be consistent with the General Plan. Commissioner Kasolas stated that the reason he voted "no" was the fact that Lot No. 15 (1142 Smith Avenue) had not been included in the area remaining R-M. Chairman Pack requested that copies of the minutes reflecting the bases for the above decision be forwarded to the City Council along with the Planning Commission's recommendation. 4 PD 75-4 This is the time and place for a continued public Campbell Building hearing to consider the application of the Campbell and Investment Building and Investment Company, Inc., for approval Company, Inc. of plans, elevations, and development schedule to allow construction of an office building on property known as 54 N. Central Avenue in a P-D (Planned Development/Commercial) Zoning District. Mr. Kee explained that since the City Council delayed action on the first Parking District at their July 14, 1978 meeting, it is hoped that they will take action after construction has begun on the second District., which should be sometime in August, He noted that staff is therefore recommending a continuance of this item until the second Planning Commission meeting in September. Commissioner Dickson moved that PD 75-4 be continued to the September 19, 1978 Planning Commission meeting, seconded by Commissioner Samuelson and unanimously adopted. '.~: is ~. PD 78-7 This is the time and place for a continued public Peisker, H. hearing to consider the application of Mr. Hans Peisker for approval of plans, elevations and development schedule to allow construction of a warehouse and office facility on property known as 116 Railway Avenue in a P-D (Planned Development/ Industrial) Zoning District. Mr. Kee explained that staff had recommended denial of this application without prejudice, however the applicant has since requested an extension to the September S, 1978 Planning Commission meeting since he has hired a new architect for the project. Commissioner Samuelson moved that PD 78-7 be continued to the September 5, 1978 Planning Commission meeting, seconded by Commissioner Vierhus and unanimously adopted. .~ a a GP 76-2-C This is the time and place for Campbell Elementary hearing to consider the future School Site Elementary School site located as 51 E. Campbell Avenue. Mr. Kee noted that staff is recommending a continuance December 5, 1978 in order that more information wilt b a continued public use of the Campbell on property known of this item to available. Commissioner Vierhus moved that GP 76-2-C be continued to the December 5, 1978 Planning Commission meeting, seconded by Commissioner Samuelson and unanimously adopted. a .~ MISCELLANEOUS Referral from the Referral from the City Council regarding closure of City Council schools in the community and loss of open space. Surplus School Sites -12- Chairman Pack noted that Mrs. Fairbanks had expressed a desire to appear before the Commission on this item. Mrs. JoAnn Fairbanks of 1565 Hacienda Avenue, Campbell appeared before the Commission to express her concern about the delay of this matter. A copy of her letter to the Commission, dated July 30, 1978 is attached hereto and made a part of these minutes. Mr. Kee explained that the reason for the delay was in order that this could be considered in conjunction with the Open Space Element and Ordinance, which has been referred to the Council for comment. Chairman Pack noted to Mrs. Fairbanks that the School District would have to advertise the sale of this type of land at least 60 days prior to sale since it is a public facility; therefore, the City would no doubt be taking action before that time. At this time Commissioner Dickson moved that this item be deferred until September 19, 1978 in order that it could be considered in connection with the proposed Open Space Ordinance, seconded by Commissioner Kasolas and unanimously adopted. Mr. Kee noted to Mrs. Fairbanks that she could call the Planning Office at any time to check on the status of this item, and staff would let her know at what time it will again come before the Commission. ~4 J` L TS 78-8 Tentative subdivision map; Lands of Paulson Lands of Paulson APN 305-38-02 Mr. Kee reported that on December 27, 1977 the City Council adopted Ordinance No. 1133 approving plans, elevations, and development schedule to allow construction of a seven-unit townhouse development on a 0.40 acre site (PD 77-27) and the map submitted was deemed necessary in order to separate the original lot into seven townhouse lots and one common ownership lot. He further noted that the proposed map is consistent with the approved site plan and the Land Use Element of the General Plan. Commissioner Vierhus moved that TS 78-8 be recommended for approval to the City Council and the Commission find that it is in conformance with the General Plan, seconded by Commissioner Samuelson and unanimously adopted. a .~ Gp 7$-g Referral from the City Council to consider revisions Circulation to the Circulation Element of the General Plan. Element -13- At this time Mr. Kee noted that the Santa Clara County Trails and Pathways Element does not appear in the text of the Element, however it does appear on the Circulation Element map. J. TA 78-3 Referral from the City Council to consider a proposed Parking-Loading text amendment relating to Chapter 21.50 (Parking and Loading). Mr. Kee noted to the Commission that this had been continued from the July 18, 1978 meeting in order that it could be referred to the Site and Architectural Review Committee and other interested parties for review and comment. He stated that a request had been received from one of the interested parties (Mr. Phil Burns) asking that this item be continued for two weeks in order to allow additional time for review. Commissioner Dickson moved that TA 78-3 be continued to the Planning Commission meeting of August 15, 1978, seconded by Commissioner Kasolas and unanimously adopted. J. .4 J. Staff Report Staff report on the 236 Federally subsidized housing San Tomas Garden project located at 825 South San Tomas Aquino Road in Apartments an R-2-S (Multiple Family/Medium Density Residential) Zoning District. Mr. Kee reported that this has become an item which is reported on semi-annually,- and that on July 21, 1978 an inspection of the site was made and the project as a whole appeared to be adequately maintained. Commissioner Dickson moved that this report be acknowledged and filed, seconded by Commissioner Samuelson and unanimously adopted. ~4 J` ~L .. l f~_ Staff Report Staff report regarding the traffic conditions at Traffic at Redding and Whiteoaks Road, Redding and Whiteoaks Chairman Pack asked Mr. Helms for a report on this area. Mr. Helms stated that he was not present at the July 18 Planning Commission meeting at which time this subject was discussed, however he has done some research and felt he could answer most the the Commission's concerns. He started out by stating that there have been no accidents reported in the City for this area; this intersection is partly in the City and partly in the County, nor does the County have. any accident history for this intersection. The traffic volumes show that there are between 4,000 and 6,000 vehicles per day on Whiteoaks. Past records indicate that speeds are not excessive in this area; and, in fact, when this area last appeared before the City Council the speed limit was dropped from 35 to 30 miles per hour. He indicated that the only problem he could determine might be a site distance problem if a van or truck were parked near the intersection on the curve. The County has indicated that they will monitor the area, and if a problem develops they wi'11 report back. He noted to the Commission that if any changes develop, he would keep them apprised. Chairman Pack thanked Mr. Helms for his report. J. J. .4 ITEMS BROUGHT UP BY COMMISSIONERS Commissioner Dickson stated that he felt the P-D ordinance should be reviewed, he had some concerns regarding the use of the P-D zoning. At this time Chairman Pack appointed Commissioners Dickson and Kasolas to serve on a committee to review this ordinance with staff. J. J.
