MINUTES AUGUST 2, 1977 The Planning Commission of the City of Campbell convened this day in regular session at the regular meeting place, the Council Chambers of the City Hall, 75 North Central Avenue, Campbell, California. ROLL CALL Commissioners: Hebard, Campos, Vierhus, Pack, Samuelson, Lubeckis, Chairman Dickson, Secretary Arthur A. Kee; Present Senior Planner Bruce Powell; City Attorney J. Kee ciarifiea the motion to adjourn for the July 5th adjourned meeting to read: "Commissioner Hebard stated that the second was made by Commissioner Samuelson. Commissioner Hebard moved that the minutes be approved indicating that Commissioner Samuelson seconded the motion to adjourn. Motion seconded by Commissioner Samuelson and unanimously adopted." Commissioner Pack moved that the Planning Commission minutes of the July 19th meeting be approved as amended, seconded by Commission Samuelson and unanimously adopted. COMMUNICATIONS: Mr. Kee advised that the communications received relate to specific items on the agenda. ARCHITECTURAL APPROVALS "S" 76-42 Continued application of Mr. Allen DeGrange for relief DeGrange, Allen from Condition No. 1 of an approval of plans to construct an emergency animal clinic on property known as 1657 South. Bascom Avenue in a C-2-S (General Commercial) Zoning District. Mr. Kee advised that the staff has been in contact with Mr. DeGrange and he advised that the owners of the project have reached an agreement with the Santa Clara Valley Water District and are withdrawing their request. The staff recommends denial without prejudice, which would remove the item from the agenda. Commissioner Vierhus moved that removal of Condition #1 of "S" 76-42 be denied without prejudice, seconded by Commissioner Pack and unanimously adopted. PUBLIC HEARINGS UP 77-10 This is the time and place for continued public Fischer, G. C. hearing to consider the application of Mr. Gordon C. Fischer for a use permit to allow conversion of part of an industrial building into a restaurant and bar as provided in Section 21.32.040 (1) of the Zoning Code. Said conversion is proposed for a building being constructed on property known as 1040 Dell Avenue in a M-1-S (Light Industrial) Zoning District. Chairman Dickson asked for staff comments. Mr. Powell explained the site layout and advised that it is staff's opinion that the on-site parking is adequate for the proposed use. The applicant was present at the Architectural Review Committee meeting and the revised plans were reviewed. The requested use is allowed in this Coning District with a Use Permit. Commissioner Campos advised that the Architectural Review Committee met with the applicant and reviewed the plans and the revised parking for the proposed restaurant use. The committee recommends approval. Chairman Dickson advised that this is a continued public hearing and he asked if anyone in the audience wished to speak for or against the Use Permit. There being no one wishing to be heard, Commissioner Vierhus moved that the public hearing be closed, seconded by Commissioner Pack and unanimously adopted. RESOLUTION No. 1630 Commissioner Vierhus moved that the Planning Commission adopt Resolution No. 1630 approving UP 77-10 (application of Gordon C. Fischer) subject to the conditions recommended by staff, seconded by Commissioner Pack and adopted by the following roll call vote: AYES: Commissioners: Hebard, Campos, Vierhus, Pack, Samuelson, Lubeckis Chairman Dickson. NOES: Commissioners: None. ABSENT: Commissioners: None. ZC 77-13 This is the time and place for public hearing to White.0aks 77-4 consider the prezoning of properties proposed for Prezoning annexation to the City of Campbell under proceedings known as White Oaks 77-4 as R-3-S (High Density Residential). Said properties are known as 3545, 3555, 3595, 3645, and 3675 S. Bascom Avenue. Chairman Dickson asked Mr. Kee for his comments. Mr. Kee advised that the proposed annexation is composed of 7.47 acres and is presently zoned R-1-8 in the County. The Land Use Element of the General Plan reflects this area for high density residential. The proposed zoning of R-3-S would conform to this density. The prezoning is required before the Council - 2 - can take action to annex the property. Mr. Kee reviewed the surrounding land uses and advised if the total area under this annexation is developed to the maximum density it would provide for 201 new residential units. Additional trips per day rated at six per high density residential units would create an additional 1,206 trips per day. Bascom Avenue is improved at three lanes of traffic for each direction with an "A" level holding capacity of 30,000 cars per day, and at present the trips per day in this area are running approximately 60% of capacity. Mr. Kee further advised that the Local Agency Formation Commission has accepted a Negative Declaration for this proposed annexation. Mr. Powell presented an aerial photograph indicating the surrounding developments. Commissioner Pack asked Mr. Kee what would happen if the area were zoned something other than high density. i•ir. The General Plan is the policy adopted by the City Council indicating how the City will develop. Commissioner Pack questioned the fact that LAFCO had accepted a Negative Declaration for the area and she asked if high density development would not impact the area with regard to traffic. She asked if an EIR is being required that would speak to noise, traffic and air pollution. Mr. Kee advised that at this time they do not know what is being proposed for development of the area. After the development plans are filed, then staff would review them and make a determination. It would be possible to develop the area with single family homes, which would be in accord with high density land use. Commissioner Pack asked what can be done after it is zoned high density. Mr. Kee advised that the staff is recommending in accord with the adopted Council Policy which is high density. The General Plan of the City says the area should be high density. The State law requires that zoning and the General Plan be consistent. Commissioner Pack stated that when the General Plan was adopted, Bascom Avenue had not reached the proportion of traffic it carries today. She was of the opinion that possibly the Commission should take a look at the Bascom Avenue area. Mr. Kee advised that when there is an application for annexation the staff can only advise them as to what the General Plan indicates for the area. If it shows high density, the staff recommends high density. The LAFCO staff reached the conclusion that it appears that there will not be significant impact levels of service on Camden and Bascom Avenues and has accepted a Negative Declaration for this proposed annexation. Chairman Dickson declared the public hearing open and asked if anyone wished to speak for or against the prezoning for White Oaks 77-4. - 3 - Mr. L. R. Liebman, 50 Shelley Avenue, reviewed the surrounding uses in San Jose and he was concerned about the traffic that would be funneled out through Shelley Avenue to Bascom Avenue. Mr. Helms responded by stating that it is most difficult to figure how much of the traffic is going out through the interior streets. Bascom Avenue is presently operating at approximately 50 or 60i of its capacity and can handle the additional traffic generated by the proposed developments. Mr. Liebman asked that there be traffic control preventing left hand turns onto Shelley. Mr. Helms advised that the area would be monitored and after developments have occurred and problems have developed, then measures would be taken to correct them. It is difficult to determine what kind of traffic patterns might be required. Mr. Liebman stated he would like to go on record as requesting two entrances, one on White Oaks and one on Bascom, when the area comes up for subdivision. Mr. Oliver Buehner, 3645 S. Bascom Avenue, asked what his tax rate would be if the zoning goes through. Mr. Kee advised Mr. Buehner that if he would contact the Planning Office, he would attempt to get this information for him. Commissioner Campos asked if the other side of Bascom Avenue in the City of San Jose is high density. Mr. Kee advised that directly across from the proposed annexation there is commercial and residential land use in San Jose. Commissioner Campos asked if Bascom Avenue is designed to handle high density traffic, and how it will affect the intersection. Mr. Helms stated that it has been determined that multiple family housing generates between six and seven automobile trips per day per unit. A 100 unit development would generate between 600 and 700 trips per day and Camden and Bascom Avenues are designed to handle a capacity of 75,000 cars per day. Commissioner Hebard stated that this is a zoning matter - not an anneoU~i~o. but he questioned the fact that this is a piece of property fronting Bascom Avenue and the only way the City of Campbell can service the area is to go through San Jose. Commissioner Hebard moved that the public hearing be closed, seconded by Commissioner Vierhus and unanimously adopted. RESOLUTION No. 1631 Commissioner Hebard moved that the Planning Commission adopt Resolution No. 1631 recommending that theWhite Oaks Council adopt an ordinance approving ZC 77-13, 77-4 Prezoning, seconded by Commissioner Vierhus and adopted by the following roll call vote: -- AYES: Commissioners: Hebard, Campos, Vierhus, Sarruelson, Lubeckis, Chairman Dickson. NOES: Commissioner: Pack. ABSENT: Commissioner: None. MISCELLANEOUS Request: Request of Mr. William C. Hagen for an adjustment Hagen, W. C. in the side yard setback requirement from 9'-O" to 5'-0" to allow a second story addition on property known as 53 Shereen Place in a R-1 Zoning District. Chairman Dickson asked Mr. Kee for his comments. Mr. Kee advised that this item was referred to the Architectural Review Committee at the last Planning Commission meeting. The Architectural Review Committee met with the applicant and reviewed the plans. Commissioner Campos advised that the committee reviewed the plans for the proposed addition and recommends approval of the requested adjustment in the side yard setback requirement. Mr. Kee advised that it was the Architectural Advisor's opinion that the addition would be an improvement. Commissioner Vierhus moved that the request of Mr. W. C. Hagen for an adjustment in the required side yard setback be approved, seconded by Commissioner Samuelson and unanimously adopted. Staff Report: Staff report on the 236 Federally subsidized housing San Tomas project located at 825 South San Tomas Aquino Road Garden Apartments in a R-2-S Zoning District. Mr. Kee reported that the staff inspected the apartment complex on Juty 25th and it was observed that most of the damaged fencing which surrounds the property has been repaired. The staff makes periodic inspections of the property and advises the resident manager when they are on the premises. The item will be on the agenda again at a later date. Appointments: Chairman Dickson asked for volunteers to serve on Historical Heritage the Historical Heritage Preservation Committee. Preservation Commissioner Hebard stated that he would serve on the Committee. Chairman Dickson appointed Commissioner Vierhus to also serve on the Committee. Chairman Dickson reported that the Youth Commission has requested that the Planning Commission assist in locating a skate board park for them. He also reported on the activities of the Civic Improvement Commission in the formation of the Historical Heritage Preservation Committee. Discussion on the Commissioner Hebard stated that he would like to have Land Use Element of the Planning Staff advise the people in the Lovell and the General Plan White Oaks areas that they can ask fora General Plan review for that area even though they are not in the City of Campbell. -5- Commissioner Pack asked if there wasn't something that could be done about the high density zoning in the City. She was of the opinion that there were too many high density apartments going into the City, and she thought that the Commission should take a look at the General Plan. Mr. Kee stated that the Commission should direct staff to contact the people and advise them that this is an area that could be considered for another category the next time the General Plan is heard. Commissioner Campos stated that if this is going to be done he would like to see some coordinated effort by San Jose. There is going to be continued growth in cities surrounding Campbell which will create traffic problems. Commissioner Vierhus moved that the Planning Staff be directed to survey the area. Motion seconded by Commissioner Hebard. Mr. Kee advised that the City is in the process of annexing approximately 13 acres. The Staff car. on 1.y advise the proponents of an annexation as tc ~~!ha*_ the General Plan indicates, which is the policy of the City Council. The proponents of the annexations have followed every rule set forth by the City. City Attorney Dempster advised that the General Plan is the policy of the City Council and the Commission makes recommendations to the City Council if they want Council policy changed. The proponents are proposing annexation on the basis of the Council's policy, and if hearings are scheduled to consider changing the General Plan while these annexations are in progress, the City would not be acting in good faith. Mr, Kee stated that there is a substantial annexation about to be filed in the Lovell area and staff represented to the proponents of this annexation exactly what the General Plan indicates. If the General Plan is to be changed, there will be a problem with the annexation. Commissioner Hebard withdrew his second to the motion. Commissioner Vierhus withdrew his motion. Mr. Kee stated that the staff could advise the people who appeared before the Commission that there are the mechanics for changing the General Plan. The State has mandated that changes to the General Plan can be considered three times a year and the people can request that the General Plan be reviewed. Chairman Dickson directed the staff to follow through and so advise. the people in the subject areas. 2335 Winchester Blvd. Mr. Powell reported that he had inspected the convenience center at 2335 S. Winchester Boulevard. The problem of the fencing of the trash enclosure is the responsibility of the Fire Department and they are working to abate the problem through the City Attorney's office. The land- scaping wes checked and it is staff's opinion that it is - being maintained. -6 - ADJOURNMENT Commissioner Samuelson moved that the be adjourned, seconded by Commissioner and unanimously adopted.
