The Planning Commission of the City of Campbell convened this day in regular
session, at the regular meeting place, the Council Chambers of the City Hall,
75 North Central Avenue, Campbell, California.

Commissioner Pack corrected the minutes of March 1, 1977,
page 18 - Condition Four should read "Landscaping plan
to be brought back to the Planning Commission."
APPROVAL OF MINUTES Commissioner Campos moved that the minutes of the
P~1arch 1, 1977 meeting be approved as corrected, seconded
by Commissioner Pack and unanimously adopted.
COMMUPJICATIONS Mr•. Kee reported that the communications received relate
to specific items on the agenda and would be taken up
at the appropriate time.
ARCHITECTURAL APPROVALS
"S" 76-23 Continued application of F. James Miller, on behalf of
f~li l l er, F. J . the U-Save Rockery, fc ~ a~~: ~~~~.' of plans to change the
a-Save Rockery location of landscaping for a rockery-nursery to be
located on property known as 500 Railway Avenue in a
M-2-S (Heavy Industrial) Zoning District.
Commissioner Pack reported that the applicant was not present at the Architectural
Review Committee meeting and the committee recommends continuance in order that
the applicant can come back with revised plans. The applicant has indicated that
he wanted to retain the cyclone fence and slat it. The Architectural Review
Committee was not in favor of this.
Mr. Kee reported that the applicant is in agreement with the continuance.
Comni.ssioner Hebard moved that "S" 76-23 be continued to the next regularly
scheduled meeting, seconded by Commissioner Vierhus and unanimously adopted.
"S" 76-45 Application of Mr. E. L. Finch, and Control Data Corporation,
Pinch, E. L. for an extension of time for an approval of a request to
Control Data Corp. place two trailers on property known as 700 West Hamilton
Avenue in a C-2-S (General Commercial) Zoning District.

Commissioner Pack reported that the Architectural Review Conunittee met with the
applicant arrd would recoirrrrre-rd approval subject to the conditions as stated in
the staff report.
Commissioner Hebard stated that this extension will be approximately ten months
from when the approval was granted arrd the building is now occupied. He asked
what the justification was for the extension?
Mr. Kee responded by advising that the applicant's business is expanding more
than he can keep up with arrd the additional space is needed at this time. Staff
has indicated to the applicant that another continuance could not be recommended
unless additional facilities were under construction and staff has emphasized
this to the applicant. Staff has also recommended that a new faithful performance
bond be posted with the City to insure removal of the trailers on or before
October 4, 1977. Also, Condition No. 2 reads: Applicant to meet all requirements
of the Building Department.
Commissioner Dickson asked if the construction was still going on.
Mr. Kee advised that to his knowledge the building is not completely finished.
The company is in the transition period at this time.
Commissioner° Pack stated that the company has projected a good neighbor policy
in that they have provided a great deal of landscaping to buffer their development
from the surrounding residential property. Their business is growing rapidly
and their only alternative is to use the trailers and on that basis the committee
felt that the Cornm-ission could grant the requested use of the trailers. The
applicant has tried to follow the "letter of the law".
Commissioner Vierhus moved that "S" 76-45 be approved subject to the following
conditions:
1. Applicant to post a new faithful performance bond with the City to insure
removal of trailers on or° before October 4, 1977.
2. Applicant to meet all requirements of the Building Department.
This motion was seconded by Commissioner Campos and unanimously adopted.
"S" 77-1 Continued application of Mr. Robert Carl Firato for
Firato, R. C. approval of plans to convert two retail shops into a
disco for young adults on property known as 476 East
Campbell Avenue in a C-2-S (General Commercial) Zoning
District.
Commissioner Pack reported that the committee reviewed this application with
the applicant and P~r•. Polizzi at some length and the recommrendation of the
committee is to go along with the staff's recommendation of denial of the
plans as presented. The applicant has indicated that he was agreeable to this
and could come back with revised plans and with the legal description of all
the property involved and with a letter from the property owners stating that
the applicant has a right to the application. The parking shown on the plan
is not adequate.
Commissioner Vierhus stated that the record should show that rre abstained
from discussion on this item.

Mr. Kee advised that Mr. Polizzi, representing the applicant, was in the audience
and wished to be heard.
Mr. Polizzi, 1479 Camden Avenue, representing the landowner and Mr. Firato,
stated that they have tried to work out a feasible parking plan. He stated that
his concern was to yet a feeling from the Commission as to the use of the three
parcels of property for parking. The proposed use requires 38 parking spaces.
He stated that the landowner was willing to give the required parking providing
mini storage warehouse buildings could be constructed on the outer edge of the
property. He asked for an indication from the Corrunission that this would be
possible.
Mr. Kee pointed out on the map the area along Dillon Avenue which is shown for
industrial land use and this proposal would provide commercial parking in an
industrial zone. The applicant would have to apply for a P-D permit. If the
Commission vaould be reluctant to recommend the parking in conjunction with the
building as shown on the plan, than the applicant would not proceed with thier
request. It would require the filing of a PD application for the parking on
the industrial property.
Mr. Kee advised that the previous plan showed the parking in the industrial area
and the Public Works Department and staff reviewed that plan and considered it
to be workable. However, he would have to obtain a PD permit since the property
is in the PD zone and the land use on the General Plan is shown for industrial.
Mr. Polizzi asked the Corm~ission as to their feeling if they came in with a P-D
application for parking and showing a couple mini storage buildings on the
property.
Mr. Kee advised that the Commission could approve parking that is off-site. It
would be a policy determination on the part of the Commission and the Council.
Chairman Dickson stated that he could not give an approval for something they
are going to submit. The plans may be feasible, but he stated that he was
not going to say he would approve them without seeing the plans.
Commissioner Campos stated that he shared Chairman Dickson's concern. The
proposed plan is not before the Commission and he was not sure what a mini
storage building looked like. He stated that he would not want to pass judgment
on a plan that is not before the Commission. He stated he would like to see a
definite plan.
Commissioner Pack stated that the revised plan was reviewed by the committee
and the committee recommends denial of the revised plan.
Commissioner Hebard stated that the plans marked "revised" are the ones before
the Commission and if they are approved by the Commission and Council, what
does that do to the future industrial use of the pr-operty?
Commissioner Pack reported that the plans marked "revised" could not be approved
because the parking is not proper.
Mr. Polizzi stated that 38 parking spaces are required for the proposed use and
they cannot get that much parking on the one lot and he asked the Commission what
their feeling would be to use adjoining industrial property for° commercial parking.

Chairman Dickson stated that the plan has sufficient parking but would require
the applicant to get parking in a P-D area.
Mr. Kee stated that if he makes the application, it would be up to the Commission
and Council to approve it and -they would have to make certain findings in
doing so.
Chairman Dickson stated that once this is done, the property is indicated for
parking for a commercial use.
Mr. Kee advised that future industrial uses would be allowed.
Chairman Dickson stated that the applicant is requesting to use the property
for parking now and maybe later on he can come back and get approval for
industrial use.
Commissioner Hebard stated that the staff's reconmendation is based on parking
only, but the Commission has had communications from others that speak to
other aspects of this development. He stated that the parking may be academic,
but he would hate to have the applicant spend another two or four weeks in
time and expenses in trying to work out the parking problem when there are
other aspects that need to be addressed.
Commissioner Campos stated that any discussion would be moot until the parking
is revolved.
P•1r. Kee reviewed the communications that have been received from the Parks
and Recreation Commission, Civic Improvement Commission, the Youth Commission,
and the Chief of Police.
Commissioner Hebard stated that the staff's reconvnendation speaks only to
parking.
Mr. Kee stated that is correct. The staff's reconvnendation prior to this one
was for approval of the project. The reason for that is that the Ordinance
would permit this kind of use in the C-2-S Zoning District and he read from
the Ordinance the permitted uses in the C-2-S Zoning District. It would not
require a use permit, or a special permit of any kind. The reason the applicant
is before the Commission is because of the increase in the intensity of use.
In the staff's opinion, this proposal was are increase in the intensity of
use and, therefore, required site and architectural approval. The use wound
require 38 parking spaces and in order to provide that much parking, Mr. Polizzi
withdrew the application and advised that they would prepare another plan.
Commissioner Hebard moved that "S" 77-1 be denied without prejudice, seconded
by Commissioner Lubeckis and unanimously adopted. (Commissioner Vierhus abstained},
"S" 77-2 Continued application of Mr. Richard Alexander for
Alexander, R. approval of plans to construct a two-story, three-unit
apartment complex on property known as 1535 Van Dusen
Avenue in a R-h1 (Low-Medium Density Residential) Zoning
District.

Commissioner Pack reported that the Architectural Review Committee discussed
this application and Mr•. Kee presented what had transpired at the Transportation
Commission meeting on March 14, 1977. Commissioner Hebard was also in attendance
at that meeting arx~lasked that he remark on what transpired. She advised that
the convnittee does recommend approval of the application.
Commissioner Hebard advised that Supervisor Diridon would appear before the
Commission and carry the Commission's comments to the Planning Commission. He
advised that Supervisor Diridon will be present shortly after 9:00 p.m. and he
requested that this item be continued until he is present.
Chairman Dickson asked the applicant if he would agree to this.
P1r. Jacobsen, A.I.A. representing Mr. Alexander, stated that he did not have
prior. notice of Supervisor Diridon's appearance and he has scheduled another
meeting which he s~ould attend at this time. If they had known about this
earlier, he could have arranged the other meeting accordingly.
Commissioner Pack asked Mr. Jacobsen if he felt that he should be in attendance
for discussion on the item.
Mr. Jacobsen stated that it would depend on the discussion the Commission is
going to get into.
Commissioner Hebard stated that he doubted the appearance of Supervisor Diridon
would change anything that was discussed at the Transit Committee meeting.
However, Supervisor Diridon felt he wanted to present the Board's position
personnaly.
Commissioner Campos was of the opinion that they should proceed with the
application. He stated he was not saying that they shouldn't hear Supervisor
Diridon, but the applicant is present and the committee is ready with a recommendation.
Commissioner Hebard moved that "S" 77-2 be tabled until 9:30 p.m.
Seconded by Commissioner Lubeckis and failed by the following roll call vote:
AYES: Commissioners: Hebard, Lubeckis.
NOES: Commissioners: Campos, Vierhus, Pack, Dickson.
ABSENT: Commissioners: Samuelson.
Cummissioner Vierhus moved that the plans be approved. No second.
Chairman Dickson asked for the Architectural Review Committee comments.
Commissioner Pack stated that the Ar°chitectural Review Committee reviewed this
application and recommends approval as submitted, subject to the conditions
recommended by staff. She requested that Mr. Kee report as to the Transit
Commission's meeting.
Mr. Kee reported on the discussions at the Transit Commission meeting and a test
case which resulted in the City of Saratoga. The city denied the application
and it was taken to court and on appeal to a higher court, the city was directed

to issue a building permit. If the City approves this application, it would
pave the way for the City to contact the State and advise them what has happened.
The Corridor is definitely a State project - it is not a local project. The
Transit Commission recommended that the State be requested to permit the County
to proceed with the preparation of the Environmental Impact Report Study
required for the preservation of the West Valley Tra~~~spurtation Corridor and
that criteria for purchase of right-of-way for "hardship" situations be developed.
Also, the commission made the recommendation that Supervisor Diridon make the
presentation to the Planning Commission.
Cornntissioner Hebard stated that there was some concern expressed by the Transit
Director that there were rumors to the effect that possibly the State was
about to abandon the West Valley right-of-ways.
Mr'. Pott had said that this one piece of property was important to them in that
it would be a way to find out just what the State's intentions were in the
West Valley Corridor and whether they were abandoning it or just abandoning it
to the County. There was some discussion as to what they might ask the City
Planning Commission to do. There might be some subsequent action that the
Planning Conmmission could take if they approved the project. If they approved
the project, they were to immediately notify the State and the Transit District
that they would expect a building permit to be applied for very shortly and
the City would notify them as soon as the application for building permit is received.
Commissioner Vierhus stated that in light of the previous report, it might be wise
to wait for Supervisor Diridon.
Commissioner Hebard moved that "S" 77-2 be tabled until 9:30 p.m. Seconded by
Commissioner Vierhus and failed by the following roll call vote:

NOES: Commissioners: Campos, Pack, Dickson.
ABSENT: Commissioners: Samuelson.
Commissioner liebard asked to see the plans.
Mr. Kee presented the plans and an aerial showing the location of the subject
property. Staff has recommended approval of the project. Contrnissioner Hebard
stated that he had no argument with the plans and the recommendation of the
Architectural Review Committee, but he would not. support a motion to approve
until after the Commission receives the comments from the Transit District.
Chairman Dickson asked Mr. Kee if the recomrmendation to be made by Supervisor
Diridon wasn't presented at the Transit District Commission meeting.
Commissioner Kee stated there was no recommendation from the Board. There
was considerable discussion on what action the Planning Conrrttission might pursue.
There was direction to Mr. Pott to pursue an Environmental Impact Report for
the preservation of the corridor and to establish criteria for the purchase of
right-of-way of "hardship" situations. He did not recall any specific
recommendation to this body for either approval or disapproval.
Commissioner Campos moved for approval of "S" 77-2 subject to conditions
recommended by staff. Motion seconded by Commissioner Pack.

did not want to vote until the Conunission hears the report from Supervisor
Diridon. He stated he would abstain.

Commissioner Pack moved that the staff be directed to send a letter to the County
of Santa Clar-a and the State advising them that the application of Richard
Alexander has been approved. Motion seconded by Commissioner Vierhus and adopted

Approval subject to the following conditions:
1. Width of the two-bedroom units to be reduced 0'3"; width of the three-bedroom
unit to be reduced 0'6"; setback to north property line to be 8'6".
2. Property to be fenced and landscaped as indicated and as added in "red" on
plan.
3. Landscape plan indicating type of plant material, location of hose bibs
or sprinkler system and type of fencing to be submitted for approval of
the Planning Director at time of application for building permit.
4. Landscaping shall be maintained in accordance with the approved landscape
plan.
5. Faithful performance bond in the amount of X3,000 to be posted to insure
landscaping, fencing and striping of parking ar-ea within three (3) months
of completion of construction, or a~rplicant may file written agreement
to complete landscaping, fencing and str-iping of parking area prior to
final Building Department clearance.
The applicant is notified as part of this application that he is required to
meet the following conditions in accordance with Ordinances of the City of
Campbell.
A. All parking and driveway areas to be developed in compliance with Section 21.50
of the Campbell Municipal Code. All parking spaces to be provided with
appropriate concrete curbs or bumper guar-ds.

B. Underground utilities to be provided as required by Section 20.16.070 of
the Campbell Municipal Code.
C. Plans submitted to the Building Department for underground utilities including
water, sewer, electric, telephone and television cables, etc.
D. Sign application to be submitted in accordance with provisions of the sign
ordinance for all signs. No sign to be installed until application is
approved and permit issued by the Building Department.
E. Ordinance No. 782 of the Campbell Municipal Code stipulates that arry
contract for the collection and disposal of refuse, garbage, wet garbage
and rubbish produced within the limits of the City of Campbell shall be
made with Green Valley Disposal Company. This requirement applies to all
single family dwellings, multiple apartment units, to all commercial,
business, industrial, manufacturing, and construction establishments.
F. Trash container(s) of a size and quantity necessary to serve the development
shall be located in area(s) approved by the Fire Department. Unless other-
wise noted, enclosure(s) shall consist of a concrete floor surrounded by
a solid wall or fence and have self-closing doors of a size specified by
the Fire Department. All enclosures to be constructed at grade level.
G. Applicant shall meet all State requirements for the handicapped..
PUBLIC WORKS REQUIREMENTS
H. Dedication to 45' one-half street righrt-of-way on Pollard Road.
I. Agreement and bond for construction of future street improvements to
be furnished by applicant.
J. Applicant to pay storm drainage area fee in the amount of $175.00.
FIRE DEPARTMENT
K. Provide "2A-IOBC" fire extinguishers.
The applicant is notified that he shall comply with all applicable Codes or
Ordinances of the City of Campbell which pertain to this development and are
not herein specified.
"S" 77-7 Application of Gordon C. Fischer for approval of plans
Fischer, Gordon C. to construct an industrial building on property located
at 1040 Dell Avenue in a M-1-S Zoning District.
Commissioner Pack reported that tine applicant did not appear at the committee
meeting. However, the Architectural Review Committee reviewed the application
and would recommend approval subject to the attached conditions.
."1r. Kee reported that the staff recommendation is also for approval.
Chairman Dickson noted that the staff corr>tnents in the write-up are that the
landscaping is minimal.
Mr. Kee reported that the landscaping has been increased and marked in "red"
on the plans.

Commissioner Pack moved that "S" 77-7 be approved subject to the following
conditions:
1. Property to be fenced and landscaped as indicated and as added in "red" on the
plans.
2. Landscape plan indicating type of plant material, location of hose bibs or
sprinkler system and type of fencing to be submitted for approval of the
Planning Director at time of application for building permit.

This motion was seconded by Commissioner Lubeckis and unanimously adopted.
"S" 77-8 Application of Mr. Roland W. Wacker for approval of
Wacker, Roland W. plans to construct an industrial building on property
known as 581 Division Street in a CM:B-80 (Controlled
Manufacturing - 80,000 square feet minimum lot size)
Zoning District.
Commissioner Pack reported that the application was reviewed with the applicant
and his neighbor, who will be joining in the building. The committee recommends
continuance so revised plans can be submitted. The plans were not complete
enough.
Mr. Kee advised that this is in accord with the staff recommendation and the
applicant is in agreement with the continuance.
Commissioner Pack moved that "S" 77-8 be continued to the next regularly scheduled
meeting, seconded by Commissioner Campos and unanimously adopted.
PUBLIC HEARINGS
PD 75-4 This is the time and place for continued public hearing
Campbell Building on the application of Campbell Building and Investment
& Investment Company Company, Inc. for approval of plans, elevations, and
development schedule to allow construction of an office
building on property known as 54 North Central Avenue
in a P-D (Planned Development/Commercial) Zoning District.
Mr. Kee advised that the staff has received a corrrmunication requesting a continuance
for thirty days.
Commissioner Campos moved that PD 75-4 be continued to the April 19, 1977, meeting,
seconded by Commissioner Vierhus and unanimously adopted.

of the Commission, the next item on the agenda would be Item No. 11.
PD 77-5 This is the time and place for public hearing to
Prodis Associates consider the application of Prodis Associates for
approval of plans, elevations, and development schedule
to allow construction of 28 townhouses on property
known as 105 Duncanville Court in a P-D (Planned Development/_.
High Density Residential) Zoning District.
Chairman Dickson asked for the report of the Architectural Review Committee.
Commissioner Pack reported that the Architectural Review Committee met with the
applicant and recommends approval of the application in accordance with the
staff recommendation.

~~~~~_) Commissioner Hebard stated that he would abstain from discussion on this matter
due to conflict of interest.
Mr. Kee presented an aerial map showing the location of the subject property
and advised that the application is for 28 townhouse units on a 1.66 acre
parcel of land. The resulting density is approximately 17 units per acre. Tire
area is shown on the General Plan as High Density (27 units per gross acre).
It is the staff's opinion, and that of the alternate architectural advisor,
that this project represents good principles of site design and will enhance
the general area.
Commissioner Pack stated that the site plans are very good arrd the development
is not at as high a density as would be permitted under the General Plan.
Commissioner Vierhus asked that the elevations be presented for review by the
Commission.
Chairman Dickson declared the public hearing open and asked if anyone wished
to speak for or against the application.
There being no one wishing to be heard, Commissioner Vierhus moved that the
public hearing be closed, seconded by Commissioner Pack and unanimously adopt~Y,i

RtSOLUTION N0. 1584 Commissioner Vierhus moved that the Commission adopt
Resolution No. 1584 recornmerrding that the City Council
adopt an Ordinance approving PD 77-5, application of
Prodis Associates, subject to the conditions recommended
by staff, seconded by Commissioner Pack and adopted
by the following roll call vote:

Chairman Dickson announced that the next item for consideration would be

UP 77-3 This is the tune and place for public hearing to
Harris, consider the application of Sister Geraldine Harris
Sister Geraldine for a use permit to allow a small family residential
care home (six or less persons in need of care) on
property known as 100 El Caminito Avenue in a R-1
Zoning District.
Chairman Dickson asked Mr. Kee for his continents.
Mr. Kee stated that a communication had been received from Douglas and Helen
Harville which he requested the Recording Secretary read. (Letter on file in
the Planning Office). The letter requested that no change in the R-1 zoning
be made.
f1r. Kee stated that the applicant is requesting approval of a residential care
home for the developmentally disabled. The proposed site is zoned single
family residential and located approximately 400 feet from Winchester Blvd.
The home is well-kept and not visually different from the other homes on the
street. Discussions with the County Department of Social Services reveals
that the City of Campbell has no residential care hoirres for• small family or
large family (more than six) for the developmentally disabled. Mr. Kee
referred to an excerpt from the California Public Welfare and Institutions Code
which provides that a use permit cannot be used to deny an application but
can add conditions that are necessary to protect the health and safety of
the residents. Mr. Kee advised that he had talked with the City Attorney in
the preparation of the report to the Commission and he may have some comments
on the State requirements for small family homes.
Chairman Dickson declared the public hearing open and asked if anyone in the
audience wished to speak for the application.
Ms. Gayle Lee, Los Gatos, stated that she has lived in the Santa Clara County
for 21 years and is a professional social worker and has worked with the
Social Welfare Department for 15 years. She stated that she is the owner of
the subject property. She stated that the City of Campbell has a responsibility
to its citizens to give serious consideration to taking care of people needing

residential care. Campbell does not have a single residential small family
care home in the entire coiruuunity. She stated that Sister Geraldine has 15 years
experience in working with developmentally handicapped. The handicapped have
the same rigi~t as everyone else to have the same whole quality of life.
Ms. Sandy Blinn, social worker,, Stated that ~I~e has worked with Hope Workshop
for the past five and a half years and during that time she has come to love
the people she works with. Being retarded doesn't mean that the people have
stopped growing - they still have room for growth. She stated that Campbell
needs to address itself to the small family-type care, which would mean a
regular-type life style for the retarded person. The house will not look any
different than any other house and it doesn't have to feel any different. She
was fully in support of what Sister Geraldine is doing.
Commissioner Lubeckis asked where the six people would come from that would
live in the house.
Ms. Blinn stated that there are workers at the County in a special unit that
deal with the developmentally handicapped.
Ms. Lee advised that ttre handicapped come from all social and ethnic groups.
Anyone is free to go to Sister Geraldine.
Commissioner Campos stated that reference was made earlier that these family
type homes in San Jose were located in the downtown ghetto and he asked how
the area became a ghetto?
~1s. Lee stated that most of the homes are located in the dowtown area, off
Santa Clara Street to the south and near San Jose State College. She stated
that Sister Geraldine could better answer that question.
Commissioner Lubeckis asked if Sister Geraldine would discriminate against
welfare persons?
Ms. Lee stated that most handicapped people are supported by Social Security
Insurance and some of the people living in the home may be receiving Social
Security Insurance benefits.
Commissioner Campos asked Ms. Lee if it was her interpretation that if a city
does not provide for the care of the handicapped, that they are discriminating?
Ms. Lee stated it was her opinion that each COnrlrlUnlty has the responsibi lity
to all their citizens and there is no kind of support system for the handicapped
in this community. Sister Geraldine is asking for a use permit to allow a
home in a whole area for six or less people.
Chairman Dickson asked for a definition of the developmentally handicapped?
Ms. Blinn stated that developmentally handicapped would mean those persons
who are mentally retarded, epileptic, neuologically handicapped, and cerebral
palsy persons.
Sister Geraldine Harris, applicant, stated that in response to the letter that
was sent in regard to changing the zoning on the property, there will be no
change of zoning. The area is one family residential and would allow a residt~~.?

care home for six or less persons. The zoning is not being changed in any way.
She stated that she felt very strongly about giving good living conditions to
the handicapped people. The idea of spreading out into smaller residential
surroundings remain. If these change, then you can no longer offer good living
conditions to the handicapped.
Commissioner Pack asked how she proposed to finance the project.
Sister Geraldine Harris advised that she i~as received a loan from her Order
and through S.S.I. The present rate through S.S.I. is $285 for each
resident.
Commissioner pack asked if this proposal was under the auspices of her Order -
under the Church.
Sister Geraldine stated that it was a personal thing. She is borrowing money
from the Order. The Order is not sponsoring it - it is a private thing.
Conunissioner Lubeckis asked how can you delineate mentally handicapped. A mentally
handicapped person can be very dangerous - you can never tell how disturbed he
is. How will you decide?
Sister Geraldine stated that she would decide. She will make the final decision
as to who will live there. She asked if Commissioner Lubeckis was speaking from
experience.
Cornmissiorier Lubeckis stated that he was speaking from events that have happened
in the world. How far will a mentally disabled person go?
Sister Geraldine stated that she has worked for 20 years ire a Junior Nigh School
and has worked with the mentally retarded and she has never experienced anything
other than gentleness from these people. She stated she has never been in a
situation where a person has been hurt. She stated that he was expressing
feeling that has no substance.
Conmissioner Lubeckis stated that he merely was expressing his concern.
Chairman Dickson asked how many people would be on the premises.
Sister Geraldine stated that there will be six residents and herself and she
will have a responsible substitute help. She stated that the residents will
be involved in adult development programs and in a few cases, the community
may employ a handicapped person. They will be out of the house during the
normal working hours. If someone were ill, she would have a substitute staff
who would come in and be with them. She stated that she is responsible for
them 24 hours a day.
Mr. John Oneta, 1143 Paula Drive, stated that Sister Geraldine has devoted her•
life to helping mentally retarded persons and there is a difference between
mentally retarded and mentally disturbed people. Sloe will be the same as being
the head of a small family and she would like to provide a decent place for them
to live. He stated that he would be proud as a citizen of Campbell to have
them living in Campbell.

Chairman Dickson asked if anyone wished to speak in opposition to the application,
and if so, if they would limit their conmrents to two or three minutes.
Mr. Richard O'Connor, 110 El Carninito, stated that he has lived there 27 years
and has enjoyed the single family street. Most of the residents on E1 Carninito
object to this development and asked that those people in the audience who were
opposed to stand. He read a list of persons living on the street who were also
opposed to the application. He stated that they have read the justification
statement submitted by Sister Geraldine and there is no way that anyone can tell
the level of disability. He stated that there is no one who can guarantee them
the level of mental handicap that these people are going to have. He stated
that whether there is one or a hundred persons living in a mentally handicapped
institution, it is a mental institution. He stated that if he sold his home,
he would have to tell the prospective buyer that there is a mental institution
next door. This is a single family area and it would downgrade the value of
the property. He stated that his final plea is that the building remain a
single family dwelling.
Mr. Henry Karmen, 190 W. E1 Canrirrito, stated that this area has been under
discussion within the past two or three years and a zone change was attempted
on a piece of property to change it to PD for multiple family dwellings. At
that time the residents of the area protested and the area remained single family.
He requested that the Commission deny the use permit.
Mr. Jack Weir, 133 El Caminito Avenue, stated that they have single family
dwellings on that street and he objects to a business operation on the street.
He stated he was in business and he conducted his business in a commercial area.
Chairman Dickson advised the members of the audience of the State's ruling
on this particular type of use and he read the section of the Government Code
(Section 5116). The State has said that this is a residential use.
Mr. Weir stated that he still objects.
Ms. Lee stated that the objections seem to be centered around property values.
Another is the definition of "home". She stated that family living can be
defined in many ways. There are not enough adequate facilities for the mentally
retarded in the State and the State has returned the care of the mentally
retarded to the corrniunity. They do not say that they have to be concentrated
in a small area. They have as much right to walk down the street, use the
parks, etc. as anyone else.
City Attorney Dempster stated that it is possible members of the audience do
not realize the handicap the Planning Conrrnission is placed under. The State
law dictates the use and the Planning Commission's hands are tied. The section
of the code says "shall". It does say that the Commission can impose certain
conditions if they have evidence placed before them to indicate that those
conditions are required. There cannot be an assumption that something can happen.
Mr. Norman Lamb, 103 El Caminito, asked how the Connnission would know whether
or not this home was adequate for yo~arrg people. They do not even know how old
the occupants will be. Has the State looked at the home? tie was of the opinion
that the Commission has the right to refuse the permit. Why is the use permit
even required?

City Attorney Dempster stated that he can hear what the people are saying, but
the Conynission has to obey the State laws. The law says that no conditions
shall be imposed on such homes which ar•e more restrictive than those imposed
on other similar dwellings in the same zones unless such additional conditions
are necessary to protect the health anti safety of tfre residents. He stated
that the law is pretty self-explanatory and the Commission must have information
and evidence when they start to impose conditions. P1r. Dempster stated that
the State law overrides the City's Ordinance and the State law says you "shall".
Chairman Dickson stated that he would have to assume that City laws are not
in agreement with State laws.
P•1r. Dempster stated they are not.
Commissioner Campos stated that the City Attorney is saying they must have
evidence to impose conditions - how do they get the evidence?
Mr. Dempster stated that after they are in the house and if something should
happen, that would be the evidence required.
Mr. H. A. Weitzel, 191 E1 Caminito Avenue, stated that this use will become a
small business and this is a residential area and no businesses are allowed.
Mr. Henry Karmen stated that it is unfair to say that the people in Campbell
do not take care of the people in the City. He said they were willing to
and believe that they should do this on a reasonable basis. There are other
places in the City, such as Pollard Road.
Chairman Dickson declared a recess at 10:20 p.m. The greeting reconvened at
10:30 p.m.
Chairman Dickson asked if anyone else wished to speak against the application.
Sister Margaret Hoffman, teacher at Notre Dame High School, stated she lived
in downtown San Jose and belonged to the samre order as Sister Geraldine and
she would speak in rebuttal to tf~e gentleman who just spoke. She stated that
much is lacking in the care of people who are orientally retarded. She stated
that the older generation was raised in fear of the mentally disabled and
she cited cases where her high school students have worked with the mentally
disabled and their fears turned to love for• them and after graduation, some
of them continued to visit with them.
She stated that people need education and understanding in the care of the
mentally disabled and what Sister Geraldine is doing will give all of us an
opportunity for quiet growth.
Mr. O'Connor asked that the item be continued for thirty days so the residents
may take a real good look at the situation.
Mr. Bruce Hodgin, 100 W. Rincon, #209, stated that he did not come to the
meeting to speak on this matter but having had the opportunity of listening to
the discussion, he felt obligated to speak. He stated that he iras a mentally
retarded sister who is now age 41 but has the mental capability of a 10 or 12
year old. Fie stated that he has never seen hatred from her, but he has seen
it thrown at her. It is a hatr°ed out of ignorance. He stated that. she has been

in institutions and hospitals and tire policy has changed from one administration
to another. They are not mentally disturbed, they are mentally handicapped.
He stated that he could not condemn the people speaking against the application.
Some are speaking from a position of ignorance and stupidity - one that they
grew up with. He would ask the Commission to remember that these people are
citizens - they can't vote - they can't make a decision.
Commissioner Lubeckis replied that he did not like Mr. liodgin's implication of
ignorance or idiots, and stated that some of his remarks were insulting.
Mr. Hodgin apologized and stated his reir-arks were not intended for Commissioner
Lubeckis.
Commissioner Vierhus stated that they have a serious problem and a very important
one as far as the conununity is concerned, and he would move that the hearing
be continued for thirty days, in order to get the best possible conditions.
Commissioner Pack asked Sister Geraldine if the people are going to be employable.
Sister Geraldine advised that some of the people could be employed at the "Hope"
Workshop. Some could be employed in community jobs. A home such as the one
proposed can serve to prepare the individuals to live by themselves. They will
learn food preparation, how to manage money, etc. It could help them to move
out and live on their own.
Commissioner Pack asked if the applicant would be agreeable to having a lesser
number.
Sister Geraldine stated that the house has four bedrooms and two bathrooms.
She doubted that she could give them the kind of food, clothing, and care that
she would like to give them if there were only two or four persons living there.
She is renting the house and the soonest she can get a license from the County
is the middle of next month. She asked that the Commission not put this off
for thirty days. She is living on a loan and she cannot pay rent indefinitely.
She stated that as far as the danger is concerned, she would never put herself
in a position where she felt any physical danger. She would be the first one
to suffer physical danger. She would ask that the people in the neighborhood
would show a kindness toward her people. Society has rejected the handicapped
and their needs are just as great as ours. She stated that the things that
she has heard tonight has hit her very hard. Sloe stated that there are 200
people working at the Hope Workshop and there has never been any difficulty.
She felt very strongly that the neighborhood feels the way they do. She stated
that she would hope that there would be kindness shown to handicapped people.
City Attorney Dempster advised the Commission that he would recommend that
they consider putting a conditi-~n on the approval of a review in six months.
He discussed this with the owner of the pr•oper•ty and she indicated that this
wound not be a problem. He stated that in six months they can review the
application and can hear from the neighbors. He stated that anyone in
disagreement with the law should take it up with the legislature. He suggested
that in the six month time, they will have had some experience to work with.
He assured Sister Geraldine that in the six months she would not have to ask
for a renewal of the use permit. It would be a review of the use permit.

Sister Harris asked that under the State law, does the City have the right to
place the conditions? There is no change in zoning.
City Attorney Dempster advised that Section 5116 of the California Public Welfare
and Institutions Code provides that conditions may be placed on the use permit
if they are necessary to protect the health and safety of the residents.
Commissioner Hebard asked Mr. O'Connor what he had in mind in requesting the
continuance.
Mr. O'Connor stated that it is apparent that the neighbors have made no progress
and he would like to yet together and discuss the law and have it interpreted
for them.
Mr. Oneta again spoke in favor of the use permit. Fie was of the opinion that
the use permit is to protect the residents of the home and he had not heard
anything to indicate that there is any danger.
Chairman Dickson asked if anyone else wished to be heard. There being no one,
Commissioner Hebard moved that the public hearing be closed, seconded by
Commissioner Pack and unanimously adopted.
RESOLUTIOfd N0. 1585 Commissioner Pack moved that, in view of what the
Commission has heard and in view of what the City
Attorney has indicated is the State law, Resolution
No. 1585 be adopted approving UP 77-3, application
of Sister Geraldine Harris, to allow a small family
residential care home on property known as 100
El Canrinito Avenue subject to the conditions recommended
by the staff and with the added condition that the
project be reviewed by the Planning Commission in six
months, seconded by Commissioner Campos.
Chairman Dickson asked for discussion on the motion.
Chairman Dickson stated he was going to vote as instructed by the City Attorney,
but it did not necessarily reflect his feelings.
Commissioner Vierhus stated that the Commission has no choice because of the
ruling from the City Attorney.
Commissioner Lubeckis stated that he has tfre choice of not voting at all - to
abstain. He stated that he could not yo against the State law, nor go against
the neighbors' wishes.
City Attorney Dempster advised that the Commission weigh the issue and he
did not necessarily agree that they should abstain. He stated that he was not
telling the Commission anything - he was just advising them what the State
law says.
Commissioner Hebard stated that he supports the motion. The State law is very
clear and the Commission has followed that and have imposed some additional
conditions for the health and safety of the residents. They have done what
was expected of them.

Supervisor Diridon apologized for arriving late. He stated that the County
was not able to support the request of Campbell to purchase the property in
question. It was probably one of the most important decisions that the Board
will have to rrrake with regard to the West Valley Corridor. The West Valley
Corridor is a State project and it is important that it continue to be a
State project. He stated that approximately 65 percent of the land has been
purchased in the Corridor and there has been increasing pressure from the
landowners to use their land. He stated that if the State is sincere in
protecting the Corridor, they will step forward and buy the land. The Valley
needs that Corridor.
Commissioner Pack stated that for the record, she would like Supervisor Diridon
to know that the Commission is sorry they could not wait for him to be in
attendance. They did approve the application before them. She did feel that
a hardship was being caused for the applicant. She thanked Supervisor Diridon
for his report.
Commissioner Hebard stated that they supported the Board of Supervisors and the
Transit Directors and he thought it most important to have communication between
them. He stated that. the Corrnnission took action in response to the Transporta-
tion Agency and it was gratifying to know that their commitment was taken
seriously. He thanked Supervisor Diridon for coming before them to explain the
Board's action.
Supervisor Diridon stated that he appreciated Commissioner Hebard and Mr. Kee
attending the Board meeting. He stated that if the State does buy this land,
it would be a signal that the State is interested in protecting the West
Valley Corridor.
Commissioner Hebard stated that the City Council should know what has tr•anspir•ed.
He moved that the staff be directed to get this matter on the City Council agenda
so they can have a formal report, seconded by Commissioner Pack and unanimously
adopted.
Supervisor Diridon asked that the Transportation Agency be advised as to what
transpires.

UP 77-2 This is the time and place for public hearing to consider
Hodgin, Bruce E. the application of Mr. Bruce E. Hodgin for a use permit
and approval of plans to convert an existing residence
into an office building on property known as 106 West
Campbell Avenue in a P-0 (Professional Office) Zoning
District.
Commissioner Pack reported that the Architectural Review Committee met with the
applicant. They were in agreement that the application should be considered
by the full Conunission, since it is on a conversion. As Chairman of the
Architectural Review Committee, she reconnnended approval of the application.
Chairman Dickson asked Mr. Kee for his comments.
Mr. Kee reviewed the revised plans that were brought before the Architectural
Review Committee. The entrance area has been changed and there is more detail
treatment around the windows. There has also been a slight change in the
pedestrian access to the entrance. He presented colored renderings to show
the roof color which is being proposed.
Chairman Dickson announced that this is a continued public hearing and he
asked the applicant if he wished to be heard.
Mr~. Bruce Hodgin, applicant, stated that he intends to use this converted
residence for his real estate office and other offices who will share his
receptionist. The future development to the west will be a new professional
office, which will share the driveways and parking. He will grant easements
for access. He was agreeable to the roof color.
Chairman Dickson asked if anyone else wished to be heard.
Commissioner Pack moved that the frear,ing be closed, seconded by Commissioner
Lubeckis and unanimously adopted.
RESOLUTION N0. 1586 Commissioner Pack moved that the Commission adopt
Resolution No. 1586 approving UP 77-2, application
of Bruce E. Hodgin, subject to the conditions recommended
by staff, seconded by Commissioner Lubeckis.
Commissioner Hebard stated that his feelings were that a conversion of a
residence to an office should be a conversion on both the inside and outside
and he said he would follow his previous action in opposing dwelling conversions
unless they are truly conversions.
Commissioner Pack stated that she would like to have it noted that it is
within the realm of the COlnmisslon to make recommendations for changes in
buildings architecturally. This does fail within the architectural section
of the Ordinance and the Commission can make suggestions for changes. The
Ordinance states that residences beiny converted should look like office buildia

Connnissioner Campos asked what is a true conversion? He did not see this as
a true conversion, but with the guidelines used in approving conversions, he
would go along with it. It was not clear to him what a true conversion is.
Commissioner Vierhus was in agreement with Conmrissioner Campos. There are no
hard and fast rules as to what a conversion is. In his opinion, sometimes a
residential appearance is a more aesthetic improvement in the community than
a box-like office. He was of the opinion that the Commission should be
flexible.
Commissioner Lubeckis asked if this conversion would compliment the surrounding
buildings.
Mr. Kee advised that it was the opinion of the staff, as well as the Architectural
Advisor, that this conversion would be in line with previous conversions.

Commissioner Pack reported that the Architectural Review Committee recommends
continuance in order that revised plans inay be submitted. The staff also
recommends continuance and the applicant is in agreement.

this application. The applicant was not present at the committee meeting. The
committee recommends the approval of the application subject to the conditions
recommended by staff.

Commissioner Hebard stated this is in a PD Zone and he would like to see how
a hexagonal building would be compatible with an old Spanish-style house.
Commissioner Pack stated that she had the same concerns, but likened it to a
gazebo in the back of are old Victorian mansion.
Commissioner Campos stated that the proposed buildiny will be set back to the
rear of the original building and its primary use will be fora conference room,
lunch room for employees, and it would not take away from the existing parking.
Chairman Dickson asked Mr. Kee what was on the surrounding lots.
Mr. Kee presented an aerial photo showing the location of the subject property
and the surrounding developments. The total area of the proposed building is
approximately 500 feet.
Commissioner Pack stated that the colors are in accord with the design, there
are no windows facing out to adjoining structures Gnd there i5 quite a lot of
landscaping on the property.
Commissioner Hebard stated that he was not going to oppose this application.
The Architectural Advisor says that it is an attractive structure, but he
would feel more comfortable if he said it were compatible with other structures
on the site.
Mr. Kee stated that he will call that concern to the attention of the
Architectural Advisor.
Commissioner Pack -moved that the public hearing be closed, seconded by

G.P. 76-2-C This is the time and place for continued public hearing
West Valley to consider the future use of the West Valley College
College Site Site.
Mr. Kee advised that the staff recommends continuance on this public hearing
to the second meeting in May. The reconm~endation for continuance to the second
meeting in May is to allow the Council to take action, if any, to amend the

meeting, seconded by Commissioner Pack arrd unanimously adopted.

Staff Report Guidelines for implementing the California Environmental
Quality Act of 1970.
Mr. Kee stated that a letter was received from the State on December 28, 1976,
outlining the changes to the guidelines for implementing the California
Environmental Quality Act of 1970 and it would be helpful if the Commission
could approve the amended guidelines as presented by staff and forward them
on to the City Council for adoption.
The staff has attempted to get the City i°equir•ements in accord with the State
requirements.
Commissioner Hebard moved that the City Council adopt the resolution prepared
by staff amending the guidelines for• implementing the California Environmental
Quality Act of 1970, seconded by Commissioner Vierhus and adopted by the
following roll call vote:

Comunissioner Nebard moved that the Planning Corrunission approve the list of
consultants submitted by staff approved for the preparation of Environmental
Impact Reports for the City of Campbell, seconded by Commissioner Campos.
Commissioner Pack abstained from voting due to a possible conflict of interest.
Comrrissior~er Campos asked what the procedure would be if someone wished to
submit the name of a consultant to be added to the approved list.
Mr. Kee stated that if an applicant has a consultant he wishes to use, and
he is a recognized consultant, the staff would bring it to the Commission for
approval. If the Commission had a consultant they wished to have added to
the list, they could also vote to add him to the approved list.

NOES: Commissioners: None.
ABSENT: Commissioners: Samuelson.
ABSTAIN: Commissioners: Pack.
Chairman Dickson announced that he has been asked to be the liaison between
the Commission and other commissions and he gave a brief report of the other
commissions' activities.
ADJOURNMENT Commissioner Lubeckis moved that the meeting be
adjourned, seconded by Commissioner Pack and unanimously
adopted. The meeting was adjourned at 12:15 a.m.
