MINUTES AUGUST 19, 1976 The Planning Commission of the City of Campbell convened this day in regular session, at the regular meeting place, the Council Chambexs of the City Hall, ?5 North Central Avenue, Campbell, California. Powell; City Attorney J, Robert Dempster; Engineering Manager Bill Helms; Recorder Phyllis Acker Absent Commissioners: Hebard, Samuelson MINUTES Commissioner moved that the minutes of the August 5, 1976 meeting be approved as received, seconded by Commissioner Dickson and unanimously adopted. COMMUNICATIONS Mr. Kee reported that the only communications received relate to specific items on the agenda and will be taken up at the time the appropriate item is discussed. ARCHITECTURAL APPROVALS "S" 76-20 Commissioner Pack reported that the Kawahara, Lee Architectural Review Committee met Carl N. Swenson with Mr. Kawahara and recommends approval Company of his application on behalf of the Carl N. Swenson Company for approval of plans to construct a third-floor addition to an office building located on property known as 700 West Hamilton Avenue in a C-2-S (General Commercial) Zoning District subject to the conditions recommended by staff and with the added condition to indicate the. redesign of the parking area. The center strip will be used for compact cars and the applicant is in agreement with the conditions. Commissioner Dickson moved that "S" 76-20 be approved subject to the conditions recommended by staff and with the addition of condition No. 6 to read: "Parking layout to be revised as indicated on Exhibit "A". Motion seconded by Commissioner Pack and unanimously adopted. 1. Property to be fenced and landscaped as indicated and as added in "red" on plans. 2. Revised landscape plan indicating type of plant material, location of hose bibs or sprinkler system and type of fencing to be submitted for approval of the Planning Director at time of application for building permit. 3, Landscaping shall be maintained in accordance with the approved landscape plan. 4. Faithful performance bond in the amount of $3,000 to be posted to insure landscaping, fencing and striping of parking area within .three (3) months of completion of construction, or applicant may file written agreement to complete landscaping, fencing and striping of parking area prior to final Building Department clearance. 5, All mechanical equipment located on roofs shall be screened as approved by the Planning Director. 6, Parking layout to be revised as indicated on Exhibit "A". The applicant is notified as part of this application that he is required to meet the following conditions in accordance with Ordinances of the City of Campbell. A. All parking and driveway areas to be developed in compliance with Section 21.50 of the Campbell Municipal Code. All park- ing spaces to be provided with appropriate concrete curbs or bumper guards. B. Underground utilities to be provided as required by Section 20.16.070 of the Campbell Municipal Code. C. Plans submitted to the Building Department for plan check shall indicate clearly the location of all connections for underground utilities including water, sewer, electric, telephone and television cables, etc. D. Sign application to be submitted in accordance with provisions of the sign ordinance for all signs. No sign to be installed until application is approved and permit issued by the Build- ing Department. E. Ordinance No. 782 of the Campbell Municipal Code stipulates that any contract for the collection and disposal of refuse, garbage, wet garbage and rubbish produced within the limits of the City of Campbell shall be made with Green Valley Disposal Company. This requirement applies to all single family dwellings, multiple apartment units, to all commercial, business, industrial, manufacturing, and construction establish- ments. - 2 - F. Trash container(s) of a size and quantity necessary to serve the development shall be located in area(s) approved by the Fire Department. Unless otherwise noted, enclosure(s) shall consist of a concrete floor surrounded by a solid wall or fence and have self-closing doors of a size specified by the Fire Department. All enclosures to be constructed at grade level. G. Applicant shall meet all State requirements for the handicapped. BUILDING DEPARTMENT H. Roof covering (not shown) shall be one hour. Table 17-A. PUBLIC WORKS DEPARTMENT I. File and process parcel map. J. Balance of storm drainage area fee at $765 per acre. FIRE DEPARTMENT K. Provide an automatic fire extinguishing system if other than Type I (one) construction. L. Provide a manual fire alarm system. M. Provide "2ABC" fire extinguishers. The applicant is notified that he shall comply with all applicable Codes or Ordinances of the City of Campbell which pertain to this development and are not herein specified. "S" 76-21 Application of Mr. Norman Coleman for Coleman, Norman approval of plans to construct a four- unit apartment building on property known as 620 Gamma Court in a R-2-S (Multiple Family/Medium Density Residential) Zoning District. Commissioner Pack reported that the applicant did not appear at the Architectural Review Committee meeting, and unless the appli- cant is in the audience, the committee would recommend the con- tinuance of "S" 76-21 to the next regular meeting. Chairman Lubeckis asked if the applicant was present. He was not. Mr. Kee stated that the staff would recommend approval of the proposed development subject to the conditions outlined in the staff report. However, the Architectural Review Committee did have some questions they wished to discuss with the applicant and the staff would concur with-the continuance recommendation. Commissioner Dickson moved that "S" 76-21 be continued to the September 2, 1976 meeting, seconded by Commissioner Pack and unanimously adopted. - 3 - "S" 76-22 Application of Mr. Russell Matesso, on Matesso, Russell behalf of the Prune Yard, for approval of plans to convert existing regular size parking stalls to compact size parking stalls on property known as 1865 and 1901 South Bascom Avenue in a C~2-S and C-2-0 (General Commercial) Zoning District. Mr. Kee reported that the staff recommends approval of the revi- sion to the parking at the Prune Yard. The applicant would put a slurry seal over the parking area and restripe the entire area. The code has been amended to allow for up to 30$ of the parking area to be used for compact stalls. Commissioner Pack stated that the Architectural Review Committee agreed tv the approval of the application in accord with the staff recommendation. However, the final circulation plan is to be approved by the Director of Public Works. Mr. Helms advised that the Public Works Department is in agreement with the condition. Commissioner Dickson moved that "S" 76-22 be approved subject to the conditions recommended by staff and the added condition to read: "The final circulation plan to be approved by the Public Works Director." Motion seconded by Commissioner Pack and unanimously adopted. 1. Approval of all spaces east of the Towers buildings subject to the following conditions: a. No parking shall be allowed adjacent to fire hydrants. 1. Hydrant at northwest corner of complex by "Daisy Bug". 2. Hydrant at Gran Plaza by "Stough Gifts". b. Replace old hydrant with new "76" type across from Bank of America. c. "No Parking-Fire Lane" shall be painted: on the east curb of the northbound driveway. 1. On the curbs of the driveways by the Gran Plaza and by Pool, Patio and Things. 2. The final circulation plan to be approved by the Public Works Director. Chairman Lubeckis introduced Joseph Elliott, the Public Works Director, and on behalf of the Commission welcomed him to the Planning Commission meetings. - 4 "S" 76-23 Application of Mr. F. James Miller, Miller, F. James on behalf of the U-Save Rockery, for U-Save Rockery approval of plans to construct a rockery on property known as 500 Railway Avenue in a M-2-S (Heavy Industrial) Zoning District. Mr. Kee reported that the staff recommends approval of the application subject to the conditions outlined in the staff report. Commissioner Pack referred to condition #5 in the staff report which requires the xemoval of existing ConMat roof sign. It was the committee's recommendation that the roof sign be painted out and she asked Mr. Miller if he had any further comments regarding this sign. Mr. F. James Miller, representing U-Save Rockery, advised that this condition deals with a ConMat sign. The sign is in an area which is not going to be utilized by U-Save-the building that has the sign on it is under separate ownership. Mr. Miller requested that condition No. 5 be deleted from the conditions of approval. He stated that they would be willing to work with the City to see what can be done about the removal of the sign. Commissioner Pack stated that the landscaping was discussed at the committee meeting and it was requested that the landscaping be continued from the subject site to the mobile home park. This would coordinate the landscaping across the entire property and the landscaping will be seen from the freeway. The applicant did indicate that he was in>favor of this condition. Mr. Miller stated that they would have no objection to the condi- tion of continuing the landscaping to the mobile home park for continuity. After discussion on the ConMat sign, City Attorney Dempster advised that the City is in no position to force the applicant to do something about a sign over which he has no control. Commissioner Dickson recommended that condition No. 5 be deleted. Commissioner Dickson moved that "S" 76-23 be approved subject to the conditions recommended by staff, with the deletion of condi- tion No. 5, seconded by Commissioner Campos. Mr. Miller stated that he had discussed condition H with Mr. Leonardi, of the Fire Department, and was advised this condition was a code requirement, and this will be worked out with the Fire Department and Water Company. Motion adopted unanimously. 1. Landscape plan indicating type of plant material, location of hose bibs or sprinkler system and type of fencing to be sub- mitted for approval of the Planning Director at time of application for building permit. - 5 - 2. All mechanical equipment located on roofs shall be screened as approved by the Planning Director. The applicant is notified as part of this application that he is required to meet the fallowing conditions in accordance with Ordinances of the City of Campbell. A. All parking and driveway areas to be developed in compliance with Section 21.50 of the Campbell Municipal Code. All park- ing spaces to be provided with appropriate concrete curbs or bumper guards. T. Provide "2ABC" fire extinguishers. Sec. 13.301 (b) U.F.C. J. Remove all underground (abandoned) gasoline tanks. Sec. 15.217 (d) U.F.C. The applicant is notified that he shall comply with all applicable Codes or Ordinances of the City of Campbell which pertain to this development and are not herein specified. PUBLIC HEARINGS V 76-3 This is the time and place for public Goguen, R. hearing to consider the request of M.M.P. Precision Mr. R. Goguen, on behalf of M.M.P. Precision, for a variance to allow a reduction in the required side yard setback of 50 feet to 20 feet (as required by Section 21.30.080 of the Campbell Municipal Code) for construction of a new building to be located on property known as 1610 Dell Avenue in a CM:B-80 (Controlled Manufacturing) Zoning District. Chairman Lubeckis asked Mr. Kee for his comments. Mr. Kee advised that the staff recommends approval of the requested variance based on the following reasons: 1. The unique shape of the lot makes the site layout very awkward using the standard CM setback. 2. This variance will not be materially detrimental to the public welfare or injurious to property and improvements in the district in which the property is located. The subject property is an irregular flag-shaped lot with an average width of 176 feet. Staff is aware of no other lot in the CM Zone with this unusual shape and .considers this parcel unique. Granting this variance would give relief to the applicant without setting a precedent that would have to be repeated for other lots in this zoning district. Commissioner Dickson asked Mr. Kee to point out the uses that surround the property. Mr. Kee advised that the entire property is surrounded by Flood Control property, with the exception of the street side. Chairman Lubeckis declared the public hearing open and asked if anyone wished to speak for or against the requested variance. - 7 - There being no one present wishing to be heard, Commissioner Pack moved that the public hearing be closed, seconded Say Commissioner Campos and unanimously adopted. RESOLUTION NO.. 1531 Commissioner Rack moved that Resolution No. 1531 be adopted approving V 76-3 (application of R. Goguen) based on the findings that the requested variance is in accordance with the checklist for granting variances, the unique.- shape of the lot makes the site layout very awkward using the standard CM setback and that this variance will not be materially detrimental to the public welfare or injurious to property and improvements in the district in which the property is located. Garcia, Garcia, Norman C. and the Creative Design Company, for approval of plans to construct an industrial building on property known as 1610 Dell Avenue in a CM:B-80 (Controlled Manufacturing) Zoning District. Mr. Kee advised that the staff recommends approval of the application subject to the conditions outlined in the staff report. Commissioner Pack reported that the Architectural Review Committee recommends approval as recommended by staff and the applicant is in agreement with all the conditions. There is a space for 21 parking stalls which will be held in reserve and which will be landscaped at this time. The elevation plans looked very good and the Architectural Advisor stated that the plans reflect a clean simple design. Commissioner Pack moved that "S" conditions recommended by staff, and unanimously adopted. 76-16 be approved subject to the seconded Dy Commissioner Campos 1. Approval of "V" 763. 2. Owner to sign an agreement satisfactory to the City Attorney, stating that additional parking will be provided, as shown on the site plan, if the Planning Commission determines that a need exists. g ,. 3. Property to be fenced and graded in accordance with Santa Clara Valley Water District specifications. 4. Property to be fenced and landscaped as indicated and as added in "red" on plans. 5. Landscape plan indicating type of plant material, location of hose bibs or sprinkler system and type of fencing to be submitted for approval of the Planning Director at time of application for building permit. 6. Provide a "2ABC" fire extinguisher for each leased space. M. Entry gate shall be provided with the means of rapid entry, e.g.,soft lead lock, light chain, etc., so fire engines will not be impaired in gaining entry to grounds. The applicant is notified that he shall 'comply with all applicable Codes or Ordinances of the City of Campbell which pertain to this development and are not herein specified. UP 75-1 This is the time and place for public Ruffenach, Karen hearing to hear evidence on the con- sideration of revocation of Use Permit 75-1, boarding home for the aged, (6 ambulatory persons) on property known as 1285 West Campbell Avenue in a R-2-S (Multiple .Family-Medium Density Residential) Zoning District. Chairman Lubeckis asked Mr. Kee for his comments. Mr, Kee advised that this item .was noticed for public hearing at the request o€ the Fire Marshal for consideration of the revocation of the use permit. The staff recommends that the Planning Commission review the comments of the Fire Marshal and rise permit holder, Karen Ruffenach, and render a decision. Chairman Lubeckis asked for Fire Marshal Leonardi's comments. Mr. Leonardi stated that the property at 1285 West Campbell Avenue is being used as a residential care home for up to six ambulatory aged guests. The lower half of the fourplex has been converted to the residential care home and the upper level is still being rented out a~ apartment units. The applicant is operating without - 10 - a fire clearance from the Fire Department in violation of the staffing requirement set forth in Section 1.05, Title 19 of the California Administrative Code. The applicant does not have a staff member on the premises 24 hous a day. At night time the one staff member is located in a separate building. The appli- cant is also using the building at 1285 West Campbell Avenue to feed the guests from an adjacent residential care home, located at 1265 West Campbell Avenue and which is operating without a valid use permit. Tt is on this basis that the Fire Department recommends that the use permit be revoked. The applicant is in violation of the law. Chairman Lubeckis asked if the .applicant wished to be heard. Mr. James Ruffenach, husband of the applicant, stated that a year ago the two places were licensed by the Fire Department, the Social Services, and the Planning Commission granted a use permit for 1285 West Campbell Avenue. He stated that at that time, before he made the investment in the property, he went to the various agencies and received approval and now a year later the Fire Department comes out and condemns the property. He stated that it is not unusual to have the person in charge at night sleeping in another building; in fact, the Social Services representative said this was a good idea. They do have an intercom system that can be used by the people in the home to call in case of an emergency. The people living there are ambulatory and can walk and get around by themselves. He stated that he understands that it is the Fire Marshal's job to uphold the laws, but he could not understand why this is happening now, after he has invested in the property and worked at it for over a year. He stated that at night time there are usually two persons in the upstairs apartment, but that he actually pays one person to stay at night, and that, according to the Social Services Department is sufficient. He stated that he would like to have a continuance in order to consult his attorney to find out if there is something that he can do to save the occupancy. Commissioner Campos asked Mr. Ruffenach if the two people in attendance at night were professional people. Mr. Ruffenach stated that they are not required to hire professional people. The people living in the home are ambulatory and could live in an apartment or house, but they are not able to cook and take care of themselves properly. Mr. Carl Evans, 2305 South Winchester Boulevard, stated that his mother is in the home and although she is 84 years of age she is quite capable of coming and going on her own, but is not able to take care of herself and cook properly. He stated that she is gefiting good care at this home, and if the occupancy permit is revoked, he will have a hard time finding another place for her. He stated that the building is safe and clean or he would not have his mother there. Mr. Kee advised the Commission that the use permit was granted for 1285 West Campbell Avenue subject to four conditions and - 11 - condition No. 1 states, "Applicant shall obtain Fire Department permit to operate an institutional occupancy" and condition No. 2 states, "Building must comply with provisions of the California Administrative Code Title - 19". There is a law that requires that someone be there 24 hous a day and that requirement i5 not within the realm of the Commission and not for discussion by the Commission. The Commission should consider whether or not the applicant is complying with the con- ditions of the use permit and Mr. Leonardi is saying that the applicant is not complying. City Attorney Dempster advised that this matter could be continued for 30 days and in that time a meeting could be held with the appli- cant and his attorney, the Fire Marshal, Planning Director and himself to try and resolve the matter. Commissioner Dickson asked if both locations were included in the original application. Mr. Ruffenach stated that he did not think so. He came down to get a use permit for the first building and a week later he acquired the other building, and he forgot about a use permit for that building. However, he did have the Fire Department, Health Department and Social Services Department out for clearance. Commissioner Dickson stated. that use permits are granted to permit someone to do something that is not ordinarily allowed, and this is a new piece of information. City Attorney Dempster advised the applicant that he should go to the Planning Department and process an application for a use permit for the second building. Fire Marshal Leonardi stated that he did meet with Mrs. Ruffenach and did have discussion about the people living next door. He called the State about their requirements for residential care homes and also the Health Department. He stated that one thing he would like to make clear is that he is acting as an agent for the Social Services Department. As a part of their clearance they state that residential care homes must have fire clearance and the fire clearance was denied on the basis "not enough staff". The State requires that there be a competent staff on duty 24 hours a day, and when he went back to make the inspection he saw that the person wasn't staying on the premises, but was living upstairs in another unit. 'Phe applicant has said that he does not want to comply by having someone on the premises 24 hours a day. The Fire Department has said that the person staying upstairs should move downstairs in the residential care home. The applicant should apply for another use permit for the residence at 1265 West Campbell and put a staff person in each building at night. The matter could be resolved right now if the applicant would agree to put the staff member in the subject buildings. - 12 r Mr. Ruffenach stated the reason the person has not been in the home is that the Social Services Department told them this was the way to do it. He stated that other homes in the area operate this way. After further discussion, Commissioner Campos moved that UP 75-1 be continued for 30 days. Motion seconded by Commissioner Dickson and unanimously adopted. City Attorney Dempster advised the applicant to contact the Planning Staff immediately and start processing the use permit application for 1265 West Campbell Avenue. UP 76-11 This is the time and place for public Stellrecht, Karl W. hearing to consider the application of Mr. Karl W. Stellrecht for a use permit and approval of plans to convert an existing residence into an office building on property known as 2265 South Winchester Boulevard in a C-2-S (General Commercial) Zoning District. Chairman Lubeckis asked for the report of the Architectural Review Committee. Commissioner Pack reported that the Architectural Review Committee discussed this application with the applicant and in view of some changes in the plans that the applicant is considering, the committee recommends continuance in order that revised plans can be submitted. The committee recommends continuance for two weeks. Mr. Kee advised that the staff is in agreement with the continuance. Chairman Lubeckis declared the public hearing open. Commissioner Campos moved that UP 76-11 be continued to the September 2, 1976 meeting, seconded by Commissioner Pack and unanimously adopted. G.P. 76-2-C This is the time and place for continued public hearing to consider the future use of the West Valley College Site. Mr. Kee stated that the staff recommends continuance to the second Planning Commission meeting in September as staff will have more information for the Commission at that time. Commissioner Pack moved that G.P. 76-2-C be continued to September 2, 1976, seconded by Commissioner Campos. Commissioner Pack requested that the staff keep in touch with Dr. Salsbury on the status of the sale of the property. Mr. Kee advised that staff would direct a letter to Dr. Salsbury requesting a response as to the status of the property. - 13 - Motion adopted unanimously. MISCELLANEOUS Parking Report Survey of Residential Requirements in other communities. Chairman Lubeckis asked Mr. Kee for his comments. Mr. Kee stated that this report was requested by the Commission at its last meeting and a survey of other cities' parking requirements has been prepared for the Commission's review. However, the Commission may wish to continue this item to the next meeting so the full Commission can review it. Commissioner Dickson stated that he would like to see more information incorporated in the survey. He requested that the staff look at apartment developments in the City to see if there are problems. Mr. Kee advised that the staff would review some existing apart- ment developments and add the information to the report. Commissioner Pack moved that the Parking Report be continued to the next regular meeting of the Planning Commission, seconded by Commissioner Dickson and unanimously adopted. Capital Improvement Community Development Task Force Program Recommendations Mr. Kee stated that this item was continued from the last meeting so the Commission could review the Community Development Task Force recommendations and make comments and recommendations to the City Council. Commissioner Dickson stated that with regard to No. 8 - Preservation of Fire Station, he believed that if the original structure could have been preserved, then it would have significant historical value. He dial not think, in the case of Fire Station #1, that this was true. He was of the opinion that it would be more appropriate to have a plaque on the site-the building that is there now has no resemblance to the original building. Commissioner Pack stated that the Civic Improvement Commission is particularly interested in preserving this building, although they realize that it would be too costly to maintain as such. Possibly it could be put to some other use than just a historical building. It is possible that the building will be removed by the parking district. Commissioner Dickson stated that, in his opinion, there was nothing historical about the present building. Mr. Helms advised that the City Council has agendized the question of whether or not the fire station should remain, or whether it should be considered for another use until such time as the fire station is relocated. That item has been continued to some future 14 - date. The staff has made a presentation to the City Council indicating what the effect would be if the building were to remain. However, no decision has been made as yet. Commissioner Campos stated that he would tend to agree with Commissioner Dickson~s comments. So much depends on the park- ing district, the cost factor, etc. He stated that he did not recall that the State has designated this building as a.histori- cal site. He asked Mr. Kee if this is a referral, or is the Commission to take any action. -, Mr. Kee advised that the City Council has asked for comments on any of the items listed in the Community Development Task Force recommendations. No recommendations are required. Commissioner Pack referred to Item No. 4-Housing Rehabilitation, and asked Mr. Kee if the new position recently approved by the City Council would come out of the H.C.D. funds and would it have any impact on the funding for housing rehabilitation. Mr. Kee stated that, in his opinion, it would have a significant impact. He advised there would be money from this year's alloca- tion that would be going toward that person's salary. He stated that it would be appropriate if the Commission agrees with the recommendation, that a larger portion should be allocated to housing rehabilitation. Commissioner Pack stated that the recommendations as stated have been very well thought out and she was of the opinion that the Commission should indicate to the City Council that the items have been reviewed b,~ the Commission. Commissioner Dickson referred to Item John D. Morgan Park. He stated he was park development along with the school should be exercised and someone should range plans to see if the school sites in the future. #5-School/Park Development- in concurrence with the sites. However, caution be looking into the long- are going to be retired Commissioner Campos referred to No. 1-Parking District and Mall Development. He stated that his concern was that this should be within the jurisdiction of the Planning Commission to formulate future plans. Commissioner Pack stated that the Planning Commission has no juris- diction over funding--the purpose of that committee would be to work on the funding. The Goals Committee felt that something more ~hoiild he done with the downtown area and wanted to see a mall development. The Goals Commitee came up with an on-going committee that would have representation from various areas-the Planning Commission, down- town merchants, Chamber of Commerce, etc. to study what kind of a mall would be the best kind for Campbell and also to gather funding information. - 15 - Item #'I-Commissioner Campos stated that anytime Citywide beautification is involved, ha would hope that there will be communication between the Commissions and that the Planning Commission will receive input from the Civic improvement Commission as to the Commission's role in City-wide beautifi- cation. Mr. Kee advised that he had been in contact with the Beautification Committee Chairman and offered to appear before that Committee and assist them in any way possible and explain the requirements of the zoning code and the policies of the Planning Commission and City Council. Mr. Kee stated that the question of the fire station is coming up very soon before the Council. The intent of the request from the City Manager was to get the Commission's comments and he suggested that the Commission send the comments that have been made on to the Council and then send future comments if they wish to continue the item. Commissioner Dickson moved that the Planning Commissioners' comments be forwarded on to the City Council with the statement that further comments will be made at the Commission's next meeting. Motion seconded by Commissioner Campos and unanimously adopted. Historical and Community City Council referral to all Commissions Facilities on the need for historical and community Council Referral facilities for the City of Campbell. Chairman Lubeckis asked Mr ., Kee for his comments. Mr. Kee advised that during the recent public hearings on the disposition of the Fire Station #l, it was suggested that it might be preserved as a historical community facility. The City Council then directed all advisory commissions to report on the need for additional facilities and if there is a need where they might be located. Staff has attached a copy of the October 28th minutes to the staff report for the Commission's review. Staff recommends that the Planning Commission make a recommendation as to the need for additional historical/community facilities and their possible location. Commissioner Pack stated that this item has been studied by the Goals Committee and the other committees and commissions. It seemed to her that the study should start with the Goals Committee. Commissioner Dickson stated that as a citizen of Campbell he would agree that them is a need for historical and community facilities in Campbell, but he did not agree with the retention of Fire Station #l. As a Planning Commissioner, he stated that he did not think there was anything histor~.cally significant with the fire station as it exists. However, he did think there was historical significance in the site. He was of the opinion that the pity did need the facility, but he did not think that Fire Station #1 was the place for it. • 16 - Commissioner Pack stated that she was in agreement with Commissioner Dickson's second comment. The Commissioner should make recommenda- tions on anything that comes up with regard to the zoning ordinance. Mr. Kee stated that the City does have a Public Facilities Element of the General Plan and there is no indication at this time that the Element should be opened for public hearing. Tf new community facilities are desired, then that would be the time for public hearing. Commissioner Campos stated that the City of Campbell is in need of historical facilities, but he would have strong resergations _. about the Fire Station #1 being so designated. The cost factor to the citizens of Campbell would be a consideration. Commissioner Pack asked about the parking district with regard to Fire Station #1. Mr. Helms advised that the staff has made an analysis on the question of whether or not the fire station should be retained and, as yet, no recommendation has been made one way or the other. Some feel strongly that it should be removed and others feel that it should stay. After some discussion, Commissioner Dickson moved that the Commission recommend that the Civic Improvement Commission make recommendations to the City Council and then the Commission would stand ready to act on any referrals to the Commission from the City Council. Motion seconded by Commissioner Pack. Commissioner Campos questioned whether this was the normal procedure. If the Civic Improvement Commission refers an item to the City Council and they approve it, then the Commission would be acting after the fact. Can the Commission request that before the Council takes action, that they refer the item to the Planning Commission? Commissioner Dickson advised that the Council has the right to approve. Mr. Kee advised that on any element of the General Plan there would have to be a public hearing before the Planning Commission before it could be amended. The fire station is shown on the Public Facilities Element as a public facility. The City Council has asked if it should remain at its location, or should it be removed. This is the first request of the Gity Council and the other request they have made is whether or not the Commission feels there is a need for other community facilities. There are other uses that could go in the fire station that would comply with the Element, such as a museum. Motion adopted unanimously. - 17 - Resolution of Comm~.ssioner Dickson moved that the Appreciation Resolution of Appreciat~,on for Commissioner Stewart be continued to the next regular meeting of the Planning Commission, seconded by Commissioner Pack and unanimously adopted. Committee Chairman Lubeckis announced that this Appointments item would be continued to the next regular meeting when the full Commission will be in attendance.
