COMMUNICATIONS i~1r. Kee reported that the only communications received relate to specific items on the agenda and would be read when the appropriate item is considered. ARCHITECTURAL APPROVALS Commissioner Pack reported for the Architectural Review Committee. "S" 74-36 Application of Daniel A. O'Kiefe for approval of O'Kiefe, Daniel A. modifications to a previously approved site plan for a body shop which was constructed on property known as 261 McGlincey Lane in a M-1-S (Light Industrial) Zoning District, Commissioner Pack reported that the committee recommends denial. without prejudice in accordance with the.staff recommendation. The applicant was not present at the committee meeting, hlr. Kee advised the applicant was notified of the morning and everting meeting times and a copy of the staff report was sent to him. Vice Chairman llickson reported that the committee reviewed the modi- fications to the previously approved plan and it is their opinion that the parking l.~~pout is unwor}:able. The committee was i.n agree- ment with the staff recommendation of denial without prejudice. - 1 -- The applicant, 1~Ir. O'Kiefe, was present and stated that he was not notified of the morning meeting of the Architectura]. P.eview Committee. t~Ir. }<ee advised that the letter sent to P~Jr. O'Kiefe indicates the time of the morning meeting and the regular meeting of the ?Tanning Commission. He suggested that the item be continued to the next meeting in order that the applicant could meet with the Architectural Review Committee. Commissioner Hebard moved that "S" 74--36 be continued to the April 15 meeting, seconded by Commissioner Samuelson and unanimously adopted. Dobbs for approval of plans to construct a William Flagg's Restaurant on property known as 1555 South Bascom Avenue in a C-2-S (G~neral Commercial) Zoning District subject tc the conditions recommended by staff. There was some discussion as to the equipment to be located on the roof of the building and the applicant explained that there is a fairly deep recessed section that the equipment will be located in and it will not be visible from the ground. Commissioner Hebard moved that "S" 76-6 be approved subject to the conditions recommended by staff, seconded by Commissioner Samuelson and unar,i_mously adopted, 1. Hpplicant to sign an agreement, or provide an easement which is satisfactory to the City Attorney that the fence opening, along the westerly property line, will be maintained in an open and unobstructed manner, 2. "S" 76-7 Commissioner Pack reported that the Architectural Lyle, Jim Review Committee recommends approval of the application of Jim Lyle for approval of plans to construct a six-unit residential development on property known as 150 and 164 West Rincon Avenue in a R-2-S (I°iedium Density Residential) Zoning District subject to the conditions recommended by staff and an added condition 210. 7 to read: Carport structure aid window tre~itment shall be subject to approval of the Planning Diz~ector. The applicant is in agreement with the conditions. .Commissioner Hebard asked if the concerns of the Archi~ectural Advisor had been satisfied, and Commissioner Pack replied that they were. "S" 76-10 Commissioner Pack reported that the Architectural Kunkel, Eldred Review Commitee recommends approval of the appli- cation of Eldred Kunkel for approval of plans to construct a twenty-eight unit townhouse complex on property }mown as 112 Sal.ice Way in a P-D (Planned Development/Medium Density Residential.) Zoning District subject to the conditions recom- mended by staff. The Architectural Advisor had expressed concern over the design of. the chimneys and t;iis was resolved to his satisfaction at the committee meeting. Commissioner Pack moved that "S" 76-10 be approved subject to the conditions recommended by staff, seconded by Commissioner Samuelson and unanimously adopted. 1. FIRE DEPAKTMENT I. Provide one ~n-site fire hydrant at northwest corner of building ITI. This }iydrant is to be connected to the street water main. The applicant is notified that he shall comply with all applicable Codes or Ordinances of the City of Campbell which pertain to this development and are not herein specified. S.A. 76-9 Appeal by Warren G. Jacobsen, A.I.A. on behalf Marchick, }I. of Mr. Herbert H. Marchick, of a decision of the Planning Director which gave conditional approval to a sign application for Midas h4ufflers, to be located on property known as 1236 White Oaks Road in a C-2-S (General Commercial) Zoning District. i~1r, Kee reported that the applicant has requested a continuance on this appeal as he wishes to submit new plans to the Sign Review Committee. Commissioner Hebard moved that S.A. 76-9 be continued to the April 15 meeting, seconded by Commissioner Samuelson and unanimously adopted. n PUBLIC HEARIIJGS UP 70-4 This is the time and place for public Collishaca, Ray H, hearing on the application of Ray H. Collisl:aw for approval of plans to convert a residence into a professional office building on property known as ]_0 Alice Avenue in a P-0 (Professional Office) toning District. Mr. Kee reported that the staff recommends approval subject to the conditions outlined in the staff report. A communication from William L. }iarrison and h'illiam J. Burns, residents at 204 and 186 East Alice Avenue, has been received requesting, that the curbs "from the easterly boundary of the subject property around the corner radius and continuing southerly to approximately the north door shoVrn on the plans reception room" be painted red to indicate. "No Parking" and that the owner or applicant install a "No Parking i_n Alley" sign on the south fence. The recording secretary read the Letter. Said letter on fi)_e in the office of the Planning Department. Mr. Kee reported that the staff has not included these two requests in the recommendation of approval and the Commission may wish to refer them to the Traffic Engineer. Commissioner Pack reported that the Architectural Review Committee recommends approval subject to the conditions outlined in the staff report and the committee recommends that the plans be rererred to the City Council as an information item. The committee was of the opinion that the Traffic Engineer should be asked to submit a report to the City Council with regard to painting the curb red and the sign in the alley way. Mr. Kee advised that the Commission could take action on the use permit and then recommend to the City Council that the question of the signing on the property as well as the curb being painted red be referred to the Traffic Engineer for report back to the City Council. :fir. Helms reported that this is a fairly common request and staff could make an on-site investigation and report back to the Council. Commissioner Hebard requested that the a~lans be presented for review by t}ie Commission. Mr. Kee reported that the staff, Architectural Review Committee and Architectural Advisor. are of the opinion that the plans are acceptable. Commissioner Iiebard asked P9r. Kee if the staff was satisfied with the plans. Pir. Kee stated there was some concern with the rock roof. However, after discussion at the committee meeting, it was determined that shakes could not be added to the existing structure and that the roof would be an earthtone gravel roof that would blend in with the walls and trim. The staff is satisfied with the total proposal. - 8 - Commissioner Hebard was of the opinion that the structure is still going to look like a house rather than an office building. Mr. Kee stated that staff did not share that opinion and he referred to other conversions that had been accomplished and that were acceptable and he thought. that this would be a comparable conversion. Commissioner Campos asked if the letter submitted by Mr. Harrison reflected the opinion of the other people in the neighborhood. Several people were in attendance at the Planning Commission and City Council meetings when the zone change was considered and he asked if they had been informed of this application. Mr. Kee stated that he had talked to Mr. Harrison and Mr. Burns in the planning office and it was his understanding that the people are aware that the plans have been filed. h1r. Harrison and Mr. Burns looked at the plans in the office, however, no one else came into the office to see the plans. Commissioner Campos asked where Mr. Harrison lived in relation to this building. Vice Chairman Dickson declared the public hearing open and asked if anyone wished to be heard. Mr. Harrison stated that he lived at 204 East Alice Avenue. h1r. Ray Collishaw, applicant, stated. that he has no objections to the recommended conditions and he would be glad to answer any questions the Commission or audience members might have. Mr. William Harrison, 204 East Alice Avenue, stated that the plans are good and he was not at the meeting to protest. He asked about the grading of the parking lot, as the lot is lower than the street. Mr. Helms stated that he hags not inspected the plans as to that detail. The Public Works Department would require that the applicant grade the lot so the drainage would be disposed of in a manner satisfactory to the City Engineer--possibly an on-site catch basin with drainage to the curb. Mr. Harrison stated that they do not want the water sent down the alley. There is a water problem when it rains. Vice Chairman Dickson asked if anyone else wished to speak. There being no one wishing to speak further, Commissioner Hebard moved that the public hearing be closed, seconded by Commissioner Samuelson and unanimously adopted. Commissioner Hebard moved that the plans for UP 76-t+ be presented to the City Council as an information item, seconded by Commissioner Pack and unanimously adopted. 'LC 76-1 This is the time and place for public Prezoning hearing to consider prezoning of properties Lovell 1975-2 known as Lovell 1975-2 as R-1 (Single Family Residential). Said property known as 11.51 and 1171 Peggy Avenue. Vice Chairman Dickson asked I4r. Kee for comments. I~9r~. Kee advised that the staff recommends that the Planning Commission adopt « resolution reaffirming its recommendation that this area be prezoned R-1 (Single Family Residential). f;t the meeting of P~Iarch 4, 1976, the Commission adopted a resolution recommending that this area be prezoned R-1. The item was renoticed when staff became aware that the parcel known as 1171 Peggy Avenue }:ad beer, incorrectly identified as 1.156 Peggy Avenue. Staff recommends that the previous action again be taken to prezone the properties R-l. The previous resolution to prezone the properties as K-1 was passed with a 7-0 vote. Vice Chairman Dickson declared the public hearing open and asked if anyone wished to speak f.or or against the prezoning. 'There being no one present wishing to be heard, Commissioner Pack moved that the public hearing be closed, seconded by Commissioner Hebard and unanimously adopted. RESOLUTION N0. 1507 Commissioner Pack moved that the Planning Commission adopt Resolution No. 1507 . recommending to the City Council the pre- zoning of properties known as Lovell 1975-2 as R-1 (1151 and 1171 Peggy Avenue), seconded by Commissioner Samuelson and adopted by the following roll call vote: 0 AYES: Commissioners: Hebard, Campos, Samuelson, Pack, Vice Chairman Dickson NOES: Commissioners: 2vone ' ABSENT: Commissiar.ers: Stewart, Chairman Lubeckis T,A. 76--1 This is the time and place for public Parking-Loading hearing on a City initiated text amendment to Chapter 21.50, Section 21.50.020, Section 21.50.030, and Section 21.50.040 of the Campbell t9unicipal Code. Vice Chairman Dic}:son asked Mr. Kee for comments. Mr. Kee stated that the staff recommendation is that the Planning Commission adopt a resolution recommending the proposed text amend- ment. The Parking Subcommittee met with staff to review the existing parking ordinance, and it was the recommendation of the subcommittee that the Commission set a public hearing to consider the following text amendments: 1. Amend Section 21.50.020 to include: (13) Unless required otherwise by this code, the minimum parking stall size shall be 8'-0" width and 16'-0" length for compact car stalls and 9'-0" width by 20'-0" length for standard car stalls. 2. Amend Section 21.50.020 to include: (14) The total number of compact car stalls on any site shall not exceed 400 of the total parking provided. 3. Amend Section 21.50.020 to include: (15) All land in the parking area not required to be paved, in accordance with provisions of the Parking Design Table, shall be landscaped. 4. Amend Section 21.50.030 to include: Senior citizen housing 1 space/3 units 5. Amend Section 21.50.040 to include: Tt~e Drachman System of Parking. With the design full size cars park in a 60° angled stall and compact cars use a 90° stall with a common 18 foot back up. Mr. Kee was of the opinion that 20o may be a more desirable figure for percentage of compact cars as a first step and on a trial basis. ti review and report could be made in one year. of how the compact stalls work. He .cited parking in various shopping centers--if there were 1,000 parking stalls provided, 40% of• that amount would almost equal one-half of the total parking to be striped for compact cars. He was of the - 11 - opinion that if the 40% figure did not work out, it would be diffi- cult to change to a lower percentage. The Drar_hman system of par}:ing requires a 60o angled stall for large size cars and a 90o angled stall for compact cars. It would be er•- tremely difficult for full size cars to turn into a stall at 90°. Mr. helms advised that he had toured several new developments in Cupertino and Sunnyvale and a 30a figure is being used on the average and seems to be very workable. After some discussion as to the percentage requirement for compact cars, Commissioner Samuelson moved that the public hearing be closed, seconded by Commissioner Pack and unanimously adopted. RESOLUTION N0. 1508 Commissioner Hebard moved that the Planning Commission adopt Resolution 1508 recommending to the City Council that T.A. 76-1 be adopted,as recommended by staff, with a change in Section 21.50,020 to include the total number of compact car stalls on any site shall not exceed 30% of the total parking provided, motion seconded by Commissioner Samuelson and adopted by the following roll call vote: AYES: Commissioners: Hebard, Campos, Samuelson, Pack, `v'ice Chairman Dickson NOES: Commissioners: None ABSENT; Commissioners: .Stewart, Chairman Lubeckis Commissioner Hebard asked i.f .property owners would be notified that they would have some flexibility in rearranging their parking layout after the text amendment is approved. Mr. Kee stated that they would be notified and staff has already had communication with some property owners. t}ISCELLA}dEOUS Special Event Sign Request of John lianas on behalf of the The White (louse White House Restaurant to paint a bicentennial Restaurant ~ mural on the east side of their building located on 116 East Campbell Avenue in a P-D Zoning District. Mr. Kee advised that the applicant is proposing to paint a "Bicen- tennial Mural" on the east elevation of the White House Restaurant. Tlie si};n ordinance provides for special event signs when limited to a specific period of time. The Sign Review Committee reviewed the artist's rendition of the mural, and also slides of other works of the artist. The committee has recommended approval of the pro]ect. Commissioner Pack reported that the Architectural Review Committee recommends that the entire Commission review the proposed mural and make a recommendation to the City Council for final approval. Vice Chairman Dickson asked if the applicant wished to speak. Mr. John lianas, applicant, presented a sketch of the proposed mural and introduced the artist who presented slides of some of her other works. Vice Chairman Dickson asked if there were any comments. Commissioner Hebard asked if the request had been referred to the $icentennial Committee. Commissioner Pack stated that this jras discussed at the Architectural Review Committee meeting and they would recommend that this be done. Vice Chairman Dickson declared a recess at 8:45 p.m. Meeting reconvened at 8:55 p.m. Commissioner Samuelson moved that the request of John lianas on behalf of the 4ahite House Restaurant to paint a bicentennial mural on the east side of the building located at 116 East Campbell Avenue be approved subject to the condition that it be removed in one year, seconded by Commissioner Hebard and adopted by the following roll call vote: AYES: Commissioners: Hebard, Campos, Samuelson, Pack, Vice Chairman Dickson NOES: Commissioners: None ABSENT: Commissioners: Stewart, Chairman Lubeckis Commissioner Hebard moved that this request be referred to the Bicentennial Committee and the City Council as an information item, seconded by Commissioner Pack and unanimously adapted. Commissioner Hebard suggested to staff that if any more Bicentennial items are presented that they be referred to the Bicentennial Committee so the Commission can have a recommendation from that committee. Vice Chairman Dickson reported that this action was taken prior to referring it to the Bicentennial Committee due to the expediency of the. matter. West Valley College Discussion regarding a study session with Site the City Council, Planning Commission and Campbell Union Elementary School District. ISr. Kee advised that Chairman Lubeckis has advised him that Commissioner Pack has been appointed -to the subcommi-~tee to work with the School District. A letter has been prepared for I4r. - 13 - ;~ Lubeckis~ signature to be forwarded to the City Council requesting that they establish a date f.-o'r a study session and to invite members of the Planning Commission and School Board to meet with them for _- discussion purposes. Three suggested items far discussion are: 1. The procedure the School District is to fallow in offeri.rig the property for sale to the public., 2. The legal position of the City in acquiring property for Loop Street Acquisition if the property is owned by the School District. 3. Legal requirement of the City pertaining to the General Plan and Zoning. This list could be expanded if the Commission so desires. Commissioner Hebard stated that the letter very clearly states the discussions leading up to the study session and he suggested that a copy of the letter be directed to the School Administration and the School Board so they will have a clearer. picture of what the Planning Commission is attempting to do in the public hearing process. Commissioner Pack referred to the second paragraph, page two of the letter and suggested that it read ".....which would include the Board of Trustees of the Campbell Union Elementary School District." Commissioner Pack suggested Item 4 for discussion purposes: 4. Discussion related to possible land use alternatives. Mr. Kee advised that the letter world be revised to include the above recommendations. Campbell Press ~ Commissioner Campos stated that he mould News Release like to have staff respond to a CamPt;el]. Press Release to the effect that the City Administration is considering the consolidation of the Public Works, Building and Planning Departments and he asked the chair to request that staff submit a letter to the City Manager to determine if this is a fact. He was of the opinion that any move in that direction should have Commission input. Vice Chairman Dickson directed staff to direct a letter to the City rianager asking that he comment back to the Commission regarding this matter.
