The Planning Commission of the City of Campbell convened this
day in regular session at the regular meeting place, the Council
Chambers of the City Hall, 75 Pdorth Central Avenue, Campbell,
California.

MINUTES Commissioner Samuelson moved that the
minutes of the January 8, 1976 meeting
be approved as received, seconded by
Commissioner Pack and unanimously
adopted.
COMMUNICATIONS Mr. Kee reported that the only communica-
tions received relate to specific items
on the agenda.
PUBLIC HEARINGS
Commissioner Pack reported for, the Architectural Review Committee:
UP 75-15 This is the time and place for continued
Church of public hearing on the application of
Christ Ronald D. Senna, on behalf of the Church
Senna, R.D, of Christ, for a use permit and approval
of plans to allow construction of a new
classroom building, a new office building
and an outdoor learning area, along with
partical remodeling of the existing
structure on property known as 1075 West
Campbell Avenue in a Public Facilities
Zone.
Commissioner Pack reported that the Architectural Review Committee
and the Architectural Advisor met with Mr. Senna, representing
the Church of Christ, and they recommend approval subject to the
conditions outlined by staff.
The applicant submitted a revised plan showing more detail as
requested by the committee and Mr. Senna indicated that they
were in agreement with the recommended conditions.
Mr, Kee advised that a letter had been received expressing con-
cern about the access to the subject property. He presented a
map showing the location of the development and the ingress and
egress to it. The Architectural Review Committee recommends
that the traffic problem be referred to the traffic engineer,
and Mr. Senna indicated that he would work with the traffic
engineer in an effort to resolve the problems that might result
from the traffic.
Commissioner Hebard questioned the reference to a business
operation on the property.
Mr, Kee advised that a nursery school is in operation on the
property. This is a permitted use in any zone with a use
permit, and the church did receive a use permit in 1966 for
the operation of a day school.
Commissioner Dickson arrived and was seated at 7:45 p.m.
Commissioner Campos stated that there is a statement in the
letter that the church is being used for other than church
related uses.
Mr. Kee stated that this was in reference to the nursery school
and the fact that the church property is next .to Coventry
School. Possibly the parking to the rear of the property is
being used by people not associated with the church. During
the week it is a convenient place to park for people going to
Coventry School activities.
Commissioner Hebard requested that the letter be referred to the
other departments that might be interested in the use of the
parking lot and also that Mr. Swiderski, 1020 Hedegard Avenue,
be notified of the action being taken by the Planning Commission.
Mr. Kee advised that the Architectural Review Committee did not
feel that the project should be held up until the traffic problems
are solved, and he was of the opinion that the matter. of ingress
and egress should be worked out between the applicant and the
traffic engineer.
Commissioner Dickson also pointed out that the portion of
Hedegard adjacent to the church property is in the county and
this matter should be referred to the Sheriff's Department.
Mr. Kee stated that the traffic problem on Hedegard would be
under the jurisdiction of the Sheriff's Department, however,
the on-site traffic circulation would be within the City of
Campbell's jurisdiction.
Chairman Lubeckis stated this is a continued public hearing and
asked if anyone in the audience wished to speak for or against
the application.

There being no one present wishing to be heard, Commissioner
Stewart moved that the public hearing be closed, seconded by
Commissioner Pack and unanimously adopted.
RESOLUTION N0, 1488 Commissioner Stewart moved that
Resolution No. 1488 be adopted
approving UP 75-15, application of
Ronald D. Senna, on behalf of the

PD 75-8 This is the time-and place for continued
Rev, Vernon Smith public hearing on the application of
Calvary Temple Rev, Vernon Smith, on behalf of the
Church Calvary Temple Church, for approval of
plans to construct an addition to the
front of the church auditorium and to
construct a multi-purpose nursery school
building on property known as 202 Railway
Avenue in a Planned Development Zoning
District.
Commissioner Pack reported that the Architectural Review Committee
discussed this application at the meeting. The applicant was not
in attendance and the committee recommends continuance in order
that the applicant can submit revised plans. The committee
recommends continuance to the second. regularly scheduled meeting
in February.
Commissioner Hebard moved that PD 75-8 be continued to the
February 19th meeting, seconded by Commissioner Stewart and
unanimously adopted.
PD 75-6 This is the time and place for continued
Roberts, C.T. public hearing on the application of
C.T. Roberts for approval of plans,
elevations and development schedule to
allow construction of an additional
living unit on property located at 206
West Rincon Avenue in a Planned Develop-
ment Zone.
Commissioner Pack reported that the

Architectural Review Committee
with Mr. Roberts. The

revised plans lack sufficient detail and the Architectural Advisor
and the committee could not review them for that reason. The
committee did communicate with Mr. Roberts and he is aware of the
problems. Mr. Roberts indicated that he would like to come
back with more detailed plans. The committee recommends contin-
uance to the last meeting in March.
Commissioner Campos asked if .the continuance were granted would
it be with the understanding that the applicant would submit
plans for. a new building.
Mr. Kee replied that it would be.
Chairman Lubeckis asked if the applicant concurred with the
continuance.
Mr. Kee advised that the staff has not received a letter to that
effect but Mr. Roberts did indicate at the Architectural Review
Committee meeting that he would come back with revised plans.
Commissioner Hebard moved that PD 75-6 be continued to the
second regularly scheduled meeting in March, seconded by
Commissioner Campos and unanimously adopted.
Commissioner Pack requested that staff notify Mr. Roberts by
letter that the application had been continued to March 18 in
order that he could submit revised plans.
GP 76-1 This is the time and place for public
Williams R. J. hearing to consider proposed amendments
to the Land Use Element of the General
Plan and/or Zoning Map from "Low Density
Residential" (R-1) to "Professional
Office" (P-0) or "Commercial" (C-2-S)
at 10 Alice Avenue, Campbell, as per the
application of Robert J. Williams.
Chairman Lubeckis asked Mr. Kee for his comments.
Mr, Kee advised that Mr. Stafford would make the presentation.
Mr. Stafford, Senior Planner, presented a map delineating the
subject property and pointed out the surrounding uses. The
subject property is the only remaining parcel on Winchester.
Boulevard, between Hamilton and Budd Avenues, which is planned
and zoned for residential use. Due to the location of the
property with respect to Winchester Boulevard, the staff is of
the opinion that the property could develop with commercial or
office use, and not be detrimental. to the residential area on
Alice Avenue.
Staff recommends: 1. T2iat the Planning Commission adopt a
resolution recommending; a) That the Land Use Element of the
General Plan be amended from "Low Density Residential" to
"Commercial," and b) That the zoning on the subject property
be changed from R-1 (Single Family District) to C-2-S (General
Commercial District).

Tt~e applicant's statement indicates that there is an e~:istir~g

and the app_l.icant has stated that it is now unsuitable for
residential use.
Staf~ is of. the opinion that either a commercial type development
or professional office development could be compatible with the
Alice Avenue development and. the commercial development fronting

the professional office zoning was not recommended,

the requested change. He stated that the subject property has

rezoning to either commercial or professianal office drould make

Commissioner Campos staffed that the-applicant i.s requesting a
rezoning, and he was of the opinion that the Commission should
know the kind of business that he proposes. In his opinion,
it does not do any good to rezone the property if he might nat ___
be able to use it for that purpose, ~,
Mr, Kee stated that the applicant's intention is, to use the
existing structure for office purposes. Tt may be that he
might have to remove part of the structure in order to get
sufficient parking,
Commissioner Pack stated than she could not understand the
people on Alice Avenue wanting.to continue to put up with the
property as it now exists rather than having it improved.
Anything that would go in would be an improvement over what
is now there.
After considerable discussion, City Attorney Dempster advised
that the only matter before the Commission was the requested
change in the General Plan and the rezoning. He advised that
the Commissian and audience shauld restrict their comments to
the application before them and. not get into discussion of
plans at this time,
t~1r, Harrison suggested that the zoning be left R-1 until the
applicant can submit plans that would be suitable for the
property and then the zone change would follow,
Mr. Bruce Johnson, 80 A1iee Avenue, stated that the property
is an eyesore and he was of the opinion that the ootners should
have approached the residents of Alice Avenue to find out their
feelings befo~~e the application was filed,
Mr. William Burns, 186 Alice Avenue, spoke in opposition to the
rezoning, He said that if-the zone is changed to commercial,
,people will park on Alice Avenue, He did not see how parking
could be located on the property.
Commissioner Pack moved that the public hearing be closed,
seconded by Commissioner Samuelson.
Chairman Lubeckis declared a recess at 9:05 p.m, in order that
the members of the audience could review a plan showing a
proposed parking layout for the subject property.
Meeting reconvened at 9:20 p,m.
Chairman Lubeckis announced that the public hearing was not
closed as there was no vote on~the motion.
Chairman Pack requested that her motion to close the hearing be
rescinded, Commissioner Samuelson withdrew his second to the motion.

Chairman. Lubeckis asked for comments from the Commissioners.
Commissioner Stewart stated that it is obvious that the use at
the present time is not desirable from the standpoint of the
residents of the area and also that a commercial use is not
desirable. The owner does have the right to utilize his property
and in his opinion the most logical use that would provide the
least amount of traffic-and disturbance to the neighborhood
would be professional office zoning.
Gommissioner Pack concurred- with Mr. Stewart's comments.
Commissioner Dickson stated that the people in the area have
indicated that they want the use of the property and the zoning
to remain the same. If the zoning is changed, all the ordinances
of the City are still in effect and the plans would have to be
reviewed by the staff, Architectural Review Committee, other
departments,' Planning Commission and the residents of .,the area
would also have an opportunity to review the plans, He agreed _
with Mr. Stewart's comments.
Commissioner Samuelson stated that he would like to see the
application continued for sixty days to see if the applicant can
work out something with the residents of Alice Avenue.
Chairman Lubeckis stated that the code requires that zoning
be established first and then applications for the development
of the property may be accepted._
Mr. Kee stated that the zoning will give the applicant direction
as to what he-can do.
Commissioner Campos stated that he would concur with Commissioner
Samuelson. He would agree with the residents of Alice Avenue,
All they are asking is for information as to what kind of a
building is going in on the property.
City Attorney advised the Commission-that they have to take into
consideration what is before them. Either it is a proper
application, or it is not. Everyone concerned has to rely on
the machinery within the City works to come up with a legitimate
plan that will handle that particular piece of property.

Chairman Lubeckis advised the audience that the application
would be forwarded to the City Council for adoption of the
ordinances. If the Council approves the application, plans
will then be submitted for review .by the Architectural Review
Committee and the Planning Commission and they will then have
an opportunity to review the proposal.

West Rincon Avenue and 41, 51, and

Chairman Lubeckis asked Mr. Stafford for his comments.
Mr. Stafford outlined the subject areas and reviewed previous
Planning Commission actions in the area. The staff recommends

that the Planning Commission adopt a resolution recommending to
the City Council that: l.a) That the Land Use Element of the
General Plan be amended from "Professional Office" to "Medium
Density Residential" for the subject properties having frontage
only on Mission Way, b) That the Zoning on the subject properties
having frontage on Mission Way be changed from P-0 (Professional
Office) and C-3-S (Central Business District) to P-D (Planned
Development. IT.a) That the Land Use Element of the General Plan
for the subject properties with frontage or1 West Rincon Avenue
remain Professional Office. b) That the zoning for 54 West
Rincon remain P-0 and that the zoning for 38 West Rincon be
changed from C-3-S to P-0.

GP 76--2B This is the time and place for public
City Initiated hearing to consider proposed City
Millich Drive initiated zone change from R-D (Two
Family District) to R-M (Multiple
Family District) for property located
on the easterly side of Millich Drive,
Campbell.
Mr, Stafford presented a map showing the present lot configura-
tion, An architectural approval was granted to convert existing
duplex development on the subject properties to condominium,
thereby allowing the sale of individual units. Subsequently,
a parcel map was filed and approved for the condominium con-
version. The parcel map shows more than two dwelling units
per lot, which is inconsistent with the R-D zoning. For this
reason, the staff is recommending that the zoning be changed
to R-M for the existing development.
Chairman Lubeckis declared the public hearing open and asked
if anyone wished to be heard.
There being no one wishing to speak, Commissioner Hebard moved
that the public hearing be closed, seconded by Commissioner
Dickson and unanimously adopted.
RESOLUTION N0, i493 Commissioner Stewart moved the Planning
Commission adopt Resolution No. 1493
recommending that the City Council
adopt an ordinance approving a zone
change from F.-D to R-M for the subject

GP 76-2^C This is the time and place for public
West Valley hearing to consider future use of the
College West Valley College Site.
Chairman Lubeckis asked Mr. Kee for his comments,
P4r, Kee advised that the staff recommends continuance to the

first meeting in February. Mr. Kee stated that there are other
groups in the City that will be concerned about the future use
of this site and he suggested that possibly a study session be
held and that the other interested groups be invited to attend.
H.e thought that the public hearing should be held after the
study session in order that everyone interested could be in-
volved in the discussions.
Commissioner Hebard suggested that two Planning Commissioners be
appointed to work with staff to develop a schedule.
Chairman Lubeckis appointed Commissioner Hebard and Commissioner
Samuelson to work with staff in setting up a time schedule.
Chairman Lubeckis declared the public hearing open.
Commissioner Hebard moved that GP 76-2-C be continued to the
February 19th meeting, seconded by Commissioner Pack and
unanimously adopted.
MISCELLANEOUS
T.S. 76-1 Tentative Subdivision P7ap-Jennings-
Kunkel, Eldred McDermott-Heiss, Inc., for the Lands
of Eldred Kunkel for approval of a 29
lot townhouse subdivision located on
property known as 112 Salice Way in a
Planned Development Zone.
Mr. Kee advised that the staff is recommending approval of the
subject tentative subdivision map subject to the conditions
recommended by staff The applicant is proposing a subdivision
of 1.84 acres of land into 28'townhouse lots and one lot for
common ownership. Planned Development approval has been
granted by the. Planning Commission and City Council for the
townhouse development with a condition that a subdivision map
be filed and approved by the City.. This tentative subdivision
map is in accord with the General Plan and the Planned Develop-
ment Zoning that exists on the property.
Clmmissioner Hebard asked what the density was on the property
and Mr. Kee advised that it was about 15 units p_er acre.
Commissioner Campos moved that the Planning Commission recommend
approval to the City Council of T.S. 76-1 subject to the condi-
tions outlined by staff, seconded by Commissioner Dickson and
unanimously adopted.
Referral from Social Services Study Report
City Council
Mr. Kee reviewed the study session which was held on the Social
Services Study Report.

Commissioner Pack stated that she would like clarification as
to what is going to be presented at the public hearing. Is
the so-called element and what is going to be contained in
the element?
Chairman Lubeckis stated that it was his understanding that
each part of the study report was going to be discussed,
Commissioner Hebard stated that it would depend largely on
the City Council's action at their next meeting.
RESOLUTION N0. 1494 Commissioner Hebard moved that the
Planning Commission adopt Resolution No.
1494 setting public hearing on the Social
Services Element of the General Plan for
the second regularly .scheduled meeting
- in February of the Planning commission,
seconded by Commissioner Campos and
adopted by the following roll call vote:
AYES: Commissioners: Hebard, Campos, Stewart, Dickson,
Samuelson, Pack, Lubeckis
NOES: Commissioners; None

Referral from Renaming of the Sphere of Influence
the Mayor Boundary.
Mr. Kee advised that the Planning Policy Committee is considering
a proposed change of name of the "Sphere of Influence" to
"Boundary Agreement". The term "Sphere of Influence" would then
be used to delineate those areas that are covered by the cities'
general plans for the next 20-30 years in the future. The pro-
posed change would have little effect on the City of Campbell.
Commissioner Hebard moved that the Planning Commission go on
record as supporting the change of name from "Sphere of Influence"
to "Boundary Agreement", seconded by Commissioner Stewart and
unanimously adopted.
Prezoning Lovell Set a public hearing to consider the
1975-2 prezoning for annexation known as Lovell
1975-2
Mr. Kee advised that this annexation was approved at the last
regular meeting of the Local Agency Formation Commission, The
General Plan reflects low-density residential for this area and
the staff is recommending that it be noticed for R-1 zoning.
RESOLUTION N0. 1495 Commissioner Dickson moved that the
Planning Commission adopt Resolution
No. 1495 setting public hearing to
consider the prezoning for annexation
known as Lovell 1975-2 as R-1 zoning

Social Services Mr. 3Cee suggested that two Planning
Element Commissioners be appointed to work with

Study Report prior to the public hearing.
Commissioner Pack volunteered to work with staff and Chairman
Lubeckis appointed Commissioner Hebard to also work with staff
in the review of the document.
ADJOURNMENT Chairman Lubeckis announced that due
to the Planning Commissioners Institute
in San Francisco February 4-6, there
would not .be a regular Planning Commission
meeting on February 5 and that the next
regularly scheduled meeting would be
held February 19, 1976.

be adjourned, seconded by Commissioner Campos and unanimously
adopted, The meeting was adjourned at 10:25 p.m.

Commissioner Hebard requested that the letter be referred to the
other departments that might be interested in the use of the
parking lot and also that Mr. Swiderski, 1020 Hedegard Avenue,
be notified of the action being taken by the Planning Commission.
Mr. Kee advised that the Architectural Review Committee did not
feel that the project should be held up until the traffic problems
are solved, and he was of the opinion that the matter. of ingress
and egress should be worked out between the applicant and the
traffic engineer.
Commissioner Dickson also pointed out that the portion of
Hedegard adjacent to the church property is in the county and
this matter should be referred to the Sheriff's Department.
Mr. Kee stated that the traffic problem on Hedegard would be
under the jurisdiction of the Sheriff's Department, however,
the on-site traffic circulation would be within the City of
Campbell's jurisdiction.
Chairman Lubeckis stated this is a continued public hearing and
asked if anyone in the audience wished to speak for or against
the application,

There being no one present wishing to be heard, Commissioner
Stewart moved that the public hearing be closed, seconded by
Commissioner Pack and unanimously adopted.

PD 75-8 This is the time-and place for continued
Revs Vernon Smith public hearing on the application of
Calvary Temple Rev. Vernon Smith, on behalf of the
Church Calvary Temple Church, for approval of
plans to construct an addition to the
front of the church auditorium and to
construct a multi-purpose nursery school
building on property known as 202 Railway
Avenue in a Planned Development Zoning
District.
Commissioner Pack reported that the Architectural Review Committee
discussed this application at the meeting. The applicant was not
in attendance and the committee recommends continuance in order
that the applicant can submit revised plans. The committee
recommends continuance to the second. regularly scheduled meeting
in February.
Commissioner Hebard moved that PD 758 be continued to the
February 19th meeting, seconded by Commissioner Stewart and
unanimously adopted.
PD 75-6 This is the time and place for continued
Roberts, C.T. public hearing on the application of
C.T. Roberts for approval of plans,
elevations and development schedule to
allow construction of an additional
living unit on property located at 206
West Rincon Avenue in a Planned Develop-
ment Zone.
Commissioner Pack reported that the
discussed this application at length

new building rather than convert the
Architectural Review Committee
with Mr. Roberts. The
he wishes to construct a
existing structure. The

revised plans lack sufficient detail and the Architectural Advisor
and the committee could not review them for that reason. The
committee did communicate with Mr. Roberts and he is aware of the
problems. Mr. Roberts indicated that he would like to come
back with more detailed plans. The committee recommends contin-
uance to the last meeting in March.
Commissioner Campos asked if .the continuance were granted would
it be with the understanding that the applicant would submit
plans for. a new building.
Mr. Kee replied that it would be.
Chairman Lubeckis asked if the applicant concurred with the
continuance.
Mr. Kee advised that the staff has not received a letter to that
effect but Mr. Roberts did indicate at the Architectural Review
Committee meeting that he would come back with revised plans.
Commissioner Hebard moved that PD 75-6 be continued to the
second regularly scheduled meeting in March, seconded by
Commissioner Campos and unanimously adopted.
Commissioner Pack requested that staff notify Mr. Roberts by
letter that the application had been continued to March 18 in
order that he could submit revised plans.
GP 76-1 This is the time and place for public
Williams R, J. hearing to consider proposed amendments
to the Land Use Element of the General
Plan and/or Zoning Map from "Low Density
Residential" (R-1) to "Professional
Office" (P-0) or "Commercial" (C-2-S)
at 10 Alice Avenue, Campbell, as per the
application of Robert J. Williams.
Chairman Lubeckis asked Mr. Kee for his comments.
Mr, Kee advised that Mr. Stafford would make the presentation.
Mr. Stafford, Senior Planner, presented a map delineating the
subject property and pointed out the surrounding uses. The
subject property is the only remaining parcel on Winchester
Boulevard, between Hamilton and Budd Avenues, which is planned
and zoned for residential use. Due to the location of the
property with respect to Winchester Boulevard, the staff is of
the opinion that the property could develop with commercial or
office use, and not be detrimental to the residential area on
Alice Avenue,
Staff recommends: 1. That the Planning Commission adopt a
resolution recommending; a) That the Land Use Element of the
General Plan be amended from "Low Density Residential" to
"Commercial," and b) That the zoning on the subject property
be changed from R-1 (Single Family District) to C-2-S (General
Commercial District).
