Robert Dempster; Recorder Phyllis Acker Absent Commissioner Stewart MINUTES Commissioner Hebard moved that the minutes of the August 21, 1975 meeting be approved as received, seconded by Commissioner Dickson and unanimously adopted. V COMMUNICATIONS Mr. Kee reported that the communications received relate to specific items on the agenda. ARCHITECTURAL APPROVALS' Commissioner Pack reported as follows for the Architectural Review Committee: "S" 75-18 The Architectural Review Committee Woolworth Construction recommends approval of the application Company of the Woolworth Construction Company far an approval of plans to construct an office addition to an existing build- ing located on property known as 740 Camden Avenue in an M-2-S zone subject to the following conditions: 1. Property to be fenced and landscaped as indicated acid as added in "red" on plans. 2~ Landscape plan indicating type of plant material, location of hose bibs or sprinkler system and type of fencing to be sub- , mitted for approval of the Planning Director at time of app.li- cation for building permit. Commissioner Samuelson moved that "S" 75-18 be approved as recommended, seconded by Commissioner Campos and unanimously adopted. "S" 75-20 The Architectural Revieti Committee Keifer, Robert recommends that the application of Robert H. Keifer, and ServiCar of Santa Clara County for approval of plans to construct an office and shop building to be used as a bus/van repair facility on property known as 1506 White Oaks Road in an M-1-S zone be continued to the September 18th meeting of the Planning Commission. There are some problems to be worked out and the applicant has agreed to the continuance. Mr. Kee stated that the staff recommends the continuance so the applicant can submit revisions to the plans. Commissioner Hebard moved that "S" 75-20 be continued to tr.e September 18th meeting, seconded by Commissioner Samuelson and unanimously adopted. "S" 75-21 The Architectural Review Committee Terrible Herbst recommends approval of the application Oil Company of Philip A. Muscara, on behalf of the Terrible Herbst Oil Company, for approval of plans to remodel a service station on property known as 1311 -- Camden Avenue in a C-2-S zone subject to the following conditions: 1. Property to be fenced and added in "red" on plans. 2. Landscape plan indicating of hose bibs or sprinkler submitted for approval of application for building landscap~:d as indicated and as type of plant material, location system and type of fencing to be the Planning Director at time of permit . 3. Landscaping shall be maintained in accordance with the approved landscape plan. 4. Commissioner Samuelson moved that "S" 75-21 be approved as recommended, seconded by Commissioner Hebard and unanimously adopted. "S" 75-22 The Architectural Review Committee Garrett, Charles B. recommends approval of the application of Charles B. Garrett for approval of plans to construct a Montessori Pre- School on property known as 40 Jeffers Way in a R-2-S Zone subject to the conditions recommended by staff. Commissioner Pack reported that there was discussion at the committee meeting with regard to changing the entrance of the pre-school from Jeffers Way to Rose Court. The applicant agreed to the change. The Architectural Review Committee sees no problem with the development and recommends approval. Mr. Kee advised that the staff also recommends approval subject to the conditions outlined in the staff report. Cammissioner Hebard moved that "S" 75-22 be approved subject to the following conditions and the change in the entrance to 'the project from Jeffers Way to Rose Gourt: 5 - 1'_. Motion seconded by Commissioner Dickson and unanimously adopted. Commissioner Dickson stated that the staff has also recommended that the Commission recommend to the City Engineer that the curb adjacent to the project be painted for loading purposes only and he would recommend that this be done. Commissioner Dickson moved that the Commission recommend to the City Engineer that the curb adjacent to the project be painted for a loading zone, seconded by Commissioner Pack and unanimously adopted. "S" ?5-23 The Architectural Review Committee Charter Plumbing recommends approval of the applica- Company,-Inc. tion of Robert R. Walker and the Charter Plumbing Company, Inc. for approval of plans for an outdoor storage yard to be - 7 - a located on property known as 356 McGlincey Lane in an i•I-1-S Zone subject to the conditions recommended by staff. Mr. Kee stated that there was some discussion regarding the area marked in red on the plans, which shows a 6 foot masonry wall adjacent to the residential area in San Jose. After dis- cussing this with the applicant, he was in agreement with the requirement. The staff has also recommended ten feet of land- scaping indicated in red on the plans along the front property line and the applicant agreed to this additional landscaping. Commissioner Pack advised that the applicant is required to obtain a building permit to put up the masonry tirall. After some discussion as to the requirement of the masonry wall, Commissioner Dickson moved that "S" 75-23 be approved subject to the conditions recommended by staff, seconded by Commissioner Samuelson and unanimously adopted. 1. PUBLIC HEARINGS UP 74-19 Campbell Building and Investment Company This is the time and place for continued public hearing on the application of Campbell Building and Investment Company for a use permit and approval of plans to construct and office building on property known as 54 North Central Avenue in an Interim Zoning District. Chairman Lubeckis asked Mr. Kee for his comments. Mr. Kee advised that the staff recommends denial without prejudice. There is no longer an Interim Zone in this area and the next item on the agenda is a PD application for the same project. A denial without prejudice would remove this item from the agenda. Commissioner Hebard moved that the public hearing be closed, - 9 - seconded by Commissioner Samuelson and unanimously adopted. RESOLUTION N0. 1466 AYES: NOES: ABSENT: Commissioners: Commissioner Campos moved that Resolution No. 1466 be adopted denying without prejudice, UP 74-19, application of Campbell Building and Investment Company, seconded by Commissioner Hebard and adopted by the following roll call vote: Hebard, Campos, Dickson, Samuelson, Pack, Lubeckis Commissioners: None Commissioners: Stewart PD 75-4 This is the time and place for Campbell Building public heari ng on the application and Investment of Campbell Building and Tnvestment Company Company for approval of plans, elevations, and development schedule to allow con struction of an office building to be located on property -~ known as 54 North Central Avenue in a Planned Development Zoning District . Chairman Lubeckis asked P4r. Kee for his comments. Mr. Kee advised that this application covers the same property as in the previous application, UP 74-19. The proposal is f.or an office building to be located at 54 North Central Avenue. The applicant is requesting a continuance for six months in order that plans for the parking district will be more settled. The staff is recommending that PD 75-4 be continued to the first meeting in February, 1976. Chairman Lubeckis declared the public hearing open and asked if anyone wished to be heard. There being no one present wishing to speak, Commissioner Pack moved that PD 75-4 be continued to the first meeting in February, 1976, seconded by Commissioner Dickson and unanimously adopted. PD.?5-3 This is the time and place for Herr, Joseph continued public hearing on the application of Joseph Herr for approval of plans, elevations, and development schedule to allow construction of ar. industrial/warehouse building on property known as ?89 Dillon Avenue in a Planned Development Zoning; District. - 10 - Chairman Lubeckis asked Mr. Kee for his comments. Mr. Kee advised that this item was continued from the meeting of August 12, 1975 in order that staff could have additional time to -- review revised plans and the development schedule. The applicant is proposing to construct a 3,900 square foot industrial/warehouse building on a parcel containing approximately 8,800 square feet after dedication. The staff recommends approval subject to conditions outlined in the staff report and the Architectural Review Committee also reviewed the plans and recommends approval. Chairman Lubeckis asked if there were any questions regarding the development. Commissioner Samuelson asked to see the plans and Mr. Stafford presented the site plan for the Commission's review.. There being no one wishing to be heard, Commissioner Samuelson moved that the public hearing be closed, seconded by Commissioner Pack and unanimously adopted. RESOLUTION N0. 1467 AYES: Commissioners: Commissioner Samuelson moved that the Commission recommend approval of PD 75-3 to the City Council sub- ject to the conditions recommended by staff and the Architectural Review Committee, seconded by Commissioner Pack and adopted by the following roll call vote: Hebard, Campos, Dickson, Samuelson, Pack, Lubeckis NOES: Commissioners: None ABSENT: Commissioners: Steuart G.P. 75-2 This is the time and place for Seismic Element public hearing to consider the adoption of a Seismic Element of the General Plan. Chairman Lubeckis asked Mr. Kee for his comments. Mr. Kee advised that Mr. Stafford would make the presentation of the Seismic and Safety Elements as he was directly involved in the preparation of both elements. Mr. Stafford advised that the California Government Code requires that all general law cities and counties in the state include a Seismic Element in their General Plan. The primary objective of the Seismic Element is that of informing the decision maker of the seismic hazard and to suggest ways in which injuries, damage, and social and economic dislocations can be kept to a minimum in future earthquakes. Basically, the city must be aware of the seismic problems for its jurisdiction, take the necessary - 11 - I ~' steps to minimize the effects of an earthquake and to take the steps necessary to react to the community's needs following an earthquake. The Earthquake Response Operations Guide prepared by the estate outlining procedures which would take place following an earth- quake is attached to the draft copy of the Seismic Element as a guide,and he informed the Commission that the City of Campbell does have an Emergency Operations Plan which establishes the city as an emergency operations center and designates key personnel in the city to act in the time of an emergency. Mr. Stafford briefly reviewed the draft Seismic Element and stated that most of Campbell is in an area which is quite likely to suffer significant damage due to an earthquake because of the nature of the soil and the water table level. Mr. Stafford stated that it is important to note that like all residents of the ~3ay Area, Campbell residents must live with the risk that at some future date heavy shaking will occur to their homes. He referred to Table I in the draft, which illustrates the level of acceptable risks as submitted to the California Legislature by the Jaint Committee on Seismic Safety. Most of the structures in Campbell can be seen as having an ordinary level of risk to the occupants of the structure. The extra cost to a project in order to reduce this risk to an acceptable level is approximately 1 to 2 percent in most cases. Mr. Stafford referred to Page 21, Section VI, Policies and Imple- mentation, and briefly reviewed the policy guidelines in order to effectuate the goals. Chairman Lubeckis asked Fir. Stafford if there is any record of damage 'n the Campbell Area during the earthquake of 1906. Mr. Stafford replied that he was not aware of any record pertain- ing to this specific area, however, he stated that the San Jose area as a whole suffered from that quake. F1r. Kee informed the Commission that the water district has done a study on possible dam failure. Stevens Creek Dam has a fault that runs almost dowll the middle of it, however, Lexington Dam was found to be in good condition to withstand a quake. Commissioner Campos asked Mr. Stafford about the mutual aid agreen;ent between cities and how much does the City of Campbell rel}~ on that agreement. Fir. Stafford stated that the City of Campbell does put considerable emphasis on mutual aid. Mr. Kee informed the Commission that the City does have a :fiutual aid agreement with the San Nose Fire Department in the event there is a fire in the Towers building. However, the Fire Chief had requested a ladder truck, but it was :IOt approved in this year's budget. Mr. Kee stated that the City has an Emergency Operations Frocedure which has been adopted and tested and this would be very closely related to the Seismic Element. - 12 - i ^:. Commissioner Campos asked if the city has a mutual aid agreement - with the adjoining cities. Mr. Kee advised that there is a written mutual aid agreement with the San Jose Fire and Police Departments. At one time there was an agreement with the County Fire Marshal. Commissioner Campos was of the opinion that during a major disaster, the City should not rely heavily on mutual aid, but should emphasize local emergency plans. Mr. Kee advised that the City does have an emergency operations plan which has been tested on at least two occasions. Commissioner Dickson referred to page 3, the last sentence on that page. He recommended that the words "it is .theorized that" be added so the sentence reads: "In Campbell, it is theorized that most of the debris was deposited in the form of alluvial fans since Pleistocene times (approximately 1 million years). Commissioner Dickson referred to Page 111-1--Checklist Guide for Planning Emergency Operations and suggested that the words "is presented as an example" be inserted in the first sentence to read: "The following Checklist Guide is presented as an example of action"s that most localities must be prepared to undertake in response to a major earthquake." Mr. Kee advised that the Checklist is an information part of the Seismic Element. The Checklist is a guide and a guide only and he would not interpret a guide as requiring any specific proce- dures. Commissioner Pack moved that the public hearing be closed, seconded by Commissioner Samuelson and unanimously adopted. RESOLUTION N0. 1468 AYES: NOES: ABSE2IT: Commissioners: Commissioner Hebard moved to adopt Resolution No. 1468 recommending adoption of the Seismic Element of the General Plan to the City Council, with recommended changes, seconded by Commissioner Samuelson and adopted by the following roll call vote• Hebard, Campos, Dickson, Samuelson, Pack, Lubeckis Commissioners: None Commissioners: Stewart Chairman Lubeckis declared a recess at 8:45 p.m. ~' vened at 9 p.m. Meeting recon- r 13 G.P. 75-3 This .is the time and place for Safety Element public hearing to consider the adoption of the Safety Element ~, of the Campbell General Plan. Chairman Lubeckis asked Mr. Kee for his comments. Mr. Kee advised that Mr. Stafford would make the presentation on the Safety Element. Mr. Stafford advised that the Safety Element is also a state requirement for all general law cities. The basic purpose of the Safety Element is to identify the types of hazards such as fires acid floods. The Safety Element includes goals and objectives which will reduce the effects of these hazards. As with the Seismic Element, the concept of acceptable risk is defined. The point at which a risk becomes unacceptable is left to the discretion of the individual community. The Safety Element is closely related to the Campbell Emergency Operations Plan and is based on the following premises: First, if the catastrophe is limited to the local area, then the City must be prepared to take immediate and effective action to provide safety services pending arrival of mutual aid. Secondly, if the catastrophe- covers a wide area, the City will be required ~! to provide sustained local emergency services and coordinate its operations with regional disaster control efforts. i , Section IT: Public Safety Hazards. This section of the element attempts to identify the public safety hazards to which the city could reasonably be expected to respond with emergency services. Earthquakes and related hazards are discussed in the Seismic Element, however, one of the related hazards is flooding due to a dam failure. Another hazard would be a major fire which would require the efforts of the entire Campbell Fire Department. Mr. Stafford reviewed the draft Safety Element in some detail and stated that the goal of the City of Campbell is to protect life and property and to minimize damage caused by natural and man- caused emergencies. Section TV of the Element deals with imple- mentation of the Safety Element. Commissioner Campos referred to the second paragraph of the first page and asked what would constitute a public safety organization. Are there any provisions to bring in the National Guard in the event of a major catastraphe. Mr, Stafford stated that primarily the responsibilities of public safety would rest with the police department. There are provisions set up in the Emergency Operations Plan tc request outside assistance however, it is sat up to function on a local. basis. I 14 - Commissioner Dickson referred to Page ~~, C. Flooding, third paragraph, and suggested that the words, "while improvements were under construction" be included. The first sentence of that paragraph would read, "Some damage was recently caused to proper- ties abutting San Tomas Creek due to erasion of the stream channel while improvements ware under construction." Commissioner Dickson was of the opinion that it was a good report. Commissioner Pack moved that the public hearing be closed, seconded by Commissioner Hebard and unanimously adopted. Chairman Lubeckis asked rir. Y.ee if there were a plan for the Police Department to draw volunteers to help in an emergency. Mr. Stafford stated that he was not aware of any. Mr. Campos stated that the San Jose Police has an auxiliary force, however, there is no plan, that he was aware of, to recruit citizens. Mr, Kee advised that the Emergency Operations Plan speaks to mobilizing manpower. Manpower may be augmented by an auxiliary or volunteer people pressed into service. He stated that in all the discussions he has participated in, the emergency services would involve city staff. However, volunteers could be used but it would have to be within the framework of the whole program. Chairman Lubeckis asked Mr. Kee for his comments. Mr,, Kee stated that the City Council adopted the Downtown Develop- ment Guidelines which had been recommended by the Planning Commission '- and other advisory committees. ,' At that time, Mayor Hammer proposed two amendments, which consist - 15 - of a change in the wording of Section 4 (Landscaping) and the addition of Seoticn 1Q (New Development). The amendments to the __ guidelines have been referred to the other committees and to date there have been no ob~iections to the proposed amendments. The staff recommends that the Planning Commission review the proposed amendments to the Guidelines and forward its comments, if any, to the City Council. There was some discussion as to the proposed amendments pertain- ing to landscaping and Commissioner Hebard Mated that there are cases where quality landscaping substitutes for quantity landscap- ing and he did not think specific developments should be singled out. He recommended that the last sentence of paragraph 1 and paragraph 2, page 1 of the Proposed Amendments be deleted. Commissioner Dickson concurred with Commissioner Hebard and moved that the amendments as proposed to the Policy Guidelines for the Downtown Area be recommended for adoption to the City Council, with the deletion of the last sentence in the first and second paragraphs, Page 1. Motion seconded by Commissioner Samuelson and unanimously adopted. Commissioner Hebard stated that he had no arguments with the guidelines for what they say, however, he did not believe an overall statement of what they expect the downtc~•~n •~o be is included, and there is nothing clearly stated about the develop- -~ meet of the downtown as a living area--as a populated downtown. A downtown area is not a downtown area unless there are people living there. He stated there is no reference in the guidelines to transit. Guidelines for new development in an area like this should at least recognize transit other than automobiles. The guidelines should be flexible enough to respond to those services as they come about during the years. They are going to come about--it is merely ~ matter of time. They are speaking about future and it is not even mentioned in the guidelines. Chairman Lubeckis stated that the point was well taken. Commissioner Hebard stated that the guidelines have been opened up for amendments and perhaps the Planning Commission might like to ask the Council to consider adding a statement into the guide- lines covering those subjects. Commissioner Hebard suggested that in sending the recommendation to the City Council that the Planning Commission advise them that they have referred to the Campbell Transit Committee the question of developing a statement to be incorporated with regard to transit.
