Dear Mr. & Mrs. Uehara,
The Planning Division has reviewed your written request for an extension of approval
for a Conditional Use Permit approval (PLN2008-96) to allow a beer & wine license in
association with a new restaurant and related Sign Permit (PLN2008-112). The
Community Development Director may administratively approve an extension for a
maximum of one year beyond the original approval period. Any further request for an
extension of approval may only be granted by the Planning Commission, subject to the
applicable filing fee.
The Community Development Director has approved your request for an extension of
approval, for a period of one year from the original permit expiration date of August 22,
2009, subject to modified conditions of approval (enclosed). The new expiration date
shall be August 22, 2010. By this date, the business must be established on the site and
all conditions of approval satisfied.
Please also let this letter serve as a reminder that the building permit for tenant
improvements, submitted pursuant to this Conditional Use Permit, has not been cleared
by the Planning Division, subject to several required revisions (referenced the enclosed
plan-check letter). Additionally, as stated in the plan-check letter, please submit a
signed copy of enclosed conditions of approval (page 1).

Dear Ms. Kato,
The Planning Division has reviewed your building permit submittal for a tenant improvement of
an existing commercial space to establish a new restaurant. Your building permit was reviewed
based upon the Planning Commission's approval of a Conditional Use Permit (PLN2008-96) per
Resolution No. 3904 (enclosed). The following issues need to be addressed prior to Planning
Division clearance for issuance of a building permit:
Permit Expiration: The Conditional Use Permit approving the establishment of the
proposed restaurant expires on August 22, 2009 (Condition of Approval No. 4). By this
date, the restaurant must have been established. As it is apparent that this deadline cannot
be met, an application for an Extension of Approval must be submitted. Please submit
the enclosed application no later than August 22, 2009. Please note that the fee for this
application is 50% of the original application fee, or $1,662.50 (50% of $3,325).
2. Minimum Tree Size: Condition of Approval No. 5 requires that all new trees be a
minimum 24-inch box size. Please revise Sheet A-2 to satisfy this requirement.
3. Landscaping Li hg ting: Condition of Approval No. 8 requires that all landscaping lighting
be "low-level/accent lighting" to limit glare to adjacent residences. The indicated solar
garden lighting fixtures on Sheet A-2 are described as "bright white LED technology,"
which would not appear to satisfy this requirement. Please indicate a new lighting fixture
or specify how the proposed lighting is "low-level/accent lighting."
4. Building Colors: The approved projects plans submitted with the Conditional tlse Permit
application indicate that the existing building would be painted Kelly Moore brand 230
"Graystone" with KM3992-5 "Cozy Cabin" trim. Please indicate the use of these colors
on Sheet A-1 under "Notes."

5. Signed Conditions of Approval: Condition of Approval No. 1 requires that the approved
Conditions of Approval shall be signed by the applicant. Please have your client, Mr.
Masatsugu Uehara, sign the enclosed Conditions of Approval and return them to the
Planning Division.
This letter includes only the Planning Division's comments on your Building Permit submittal
and does not include Building Division, Public Works Department, or County Fire Department
