In lieu of undergrounding the utilities along the project's public street frontage Public Works
recommends that the applicant enter into an agreement with the City to pay an in lieu utility
undergrounding fee. In order to accommodate this request at the already scheduled City
Council meeting (January 16, 2007 meeting), Public Works recommends that the following
language be added to the Council report:
Underground Utility Exception:
Section 21.18.140 requires undergrounding of all overhead utility lines along the project's
public street frontage, unless otherwise approved by the decision making body. Due to the
impracticality and costs of undergrounding 75' of frontage along S. First Street, where it is
unlikely other properties would significantly develop (and provide for additional undergrounding
opportunities), staff is not recommending that undergrounding be required of the applicant. In
lieu of undergrounding of utilities along the street frontage, staff is recommending that the
owner enter into an agreement with the City that would require payment of an in-lieu utility
undergrounding fee, should the City establish such a fee within the next 7 years. Staff is
currently evaluating the possibility of establishing an underground utility in-lieu fee to address
utility undergrounding requirements where street frontage undergrounding is unlikely or
impractical. Staff anticipates bringing a recommendation on an in-lieu fee program to the
Council within the next three months in conjunction with a review of candidate locations for
establishment of future Underground Utility Districts.
