San Tomas Aquino Road Dear Mr. Huntsberry: After re-considering staff's previous position and now supporting a potential parking exception request for the proposed drive-through "Taco Bell" restaurant, site circulation issues now must be considered. Staff is concerned that the drive-through lane egress crosses over the ingress lane of the driveway approach for the parcel to the north of the subject site. After the easement rights have been clarified for the 3-foot easement discussed in the Public Works Department preliminary comments, staff recommends the applicant enter into an agreement with the property to the north, 62 S. San Tomas Aquino Road, to reconfigure the southern driveway approach on the property located at 62 S. San Tomas Aquino Road as egress only. This should not impact the current circulation pattern of this property as the northern driveway approach is currently ingress only. Once the driveway approach in question is configured to egress only, any concerns regarding cross over egress from the proposed drive-through lane may be mitigated. San Tomas Aquino Road Dear Mr. Huntsberry: Thank you for your submittal of a preliminary application proposal to demolish an existing "Taco Bell" restaurant and construct a new "Taco Bell" restaurant with adrive- through component located at 70 S. San Tomas Aquino Road. The Planning Division completed the review of your pre-application and has the following comments regarding you r proposal: Zoning: The subject property is zoned C-1 (Neighborhood Commercial) The prescribed building form in this designation is set back 15 feet from the street and includes at grade parking. The proposed site intensification with the addition of a drive-through component is subject to approval of a Conditional Use Permit. Pursuant to CMC Section 21.46.030, a Conditional Use Permit is reviewed for approval by the Planning Commission at a public hearing. The processing time for such an application is 45-60 days. General Plan: The General Pian land use designation for the subject property is Neighborhood Commercial. The General Plan states: The Neighborhood Commercial (land use) category is designed to encourage the location of commercial uses at major intersections in residential areas. Neighborhood Commercial uses accommodate small- scale, power intensity commercial and office uses that provide services to the adjacent residential neighborhood and is accessible by automobile and foot. Neighborhood Commercial areas should be designed to accommodate the auto in a manner that is friendly to pedestrians and. bicvclc traffic. Grocery stores, pharmacies, restaurants, laundries and personal services are examples of neighborhood commercial uses. Site Plan: The following information should be indicated on the site plan: a. Please show the distance from the centerline of the adjacent street to the property lines. b. Describe the height, setbacks and type of structures on adjacent properties. c All existing trees on the site should be indicated on the plans and should specify the location, type, size and whether such tree is proposed to be removed or preser~~ed. d. Any proposed or existi~~g fencing needs to be shown. The height, materials and location should be listed. e. Sho~~~ location of any proposed utilities (e.g., sprinkler riser, transformer, etc.). Elevations: a. Please see the architectural comments below. Parkin :The Zoning Ordinance requires the provision of 1 parking space for each 40 square feet of building area for fast food restaurants with a drive through component plus one space for each employee. There may be an opportunity for staff to revisit this requirement curing the formal application process to determine if a parking exception should be recommended. Utility Connection: All new commercial developments shall be required to underground all overhead utility lines both in the interior of the lot and along the project's public street frontages, unless otherwise approved by the City Council (reference Scciion 21.18.140.A). Landscaping : Please provide a Landscaping Plan. The plan should include a minimum of a 10-foot wide landscape strip along the street frontage and 5-foot wide planter strips along abutting side and rear property lines. Tree Removal Permit: Approval of a Tree Removal Permit shall be required in order to remove the trees as shown on the preliminary site plan to provide for adrive-through lane. A completed Tree Removal Application, fee, and all of the required submittal documents must be submitted concurrent to the Conditional Use Permit application. Si na e: The signage shown on the colored elevations exceeds the maximum allowable signage per Section 21.30 of the Zoning Code. The proposed use would be allowed only one 27 square foot wall sign and one 27 square foot freestanding sign. Additional 70 S. Staff strongly discourages the application of a sign exception for this project as staff could not make the fnldings necessary to recommend approval. Additionally, previous sign exception applications for snnilar projects have been consistently denied by the Planning Commission. Program Stale~ment: Please provide an operational description including hours. Architectural Changes: • The General Plan encourages high quality building designs that are architecturally attractive and are compatible with or enhance the surrounding development. • The General Plan strongly discourages corporate architecture. The design of the proposed building should complement the existing buildings in the area. Staff recommends that the applicant incorporate the building style of the newly ren,odcled commercial huildillg at 1400 W. Campbell Avenue into the proposed project design. Your pre-application was distributed to the Building Division, the Public Works Department and the County Fire Department. Public Works and Fire District comments are enclosed. Planning has not yet received comments from the Building Departrnent. Please note that all comments are meant to be preliminary.
