C Los Gatos, CA 95032 Re: File No: PLN2011-50 Address: 1520 Dell Avenue Subject: Zoning Clearance ~ Green Earth Greens Dear Mr. Fok, The Community Development Director has reviewed your request to establish Green Earth Greens in an existing warehouse building located at the above referenced property. Based on the documentation submitted to the City, the Director has determined that this business most closely can be classified as a research and development use in that the principal function of this facility will be the refinement of crop growing techniques. A research and development use is permitted in the C-M (Controlled Manufacturing) Zoning District by issuance of a zoning clearance, subject to conformance with applicable development standards. The tenant space where Green Earth Greens would be located is currently occupied by a combination of warehousing and office space. Although a conventional research and development use has a higher parking demand than a warehousing use, the Director has determined that due to the unique characteristics of Green Earth Greens, pursuant to Campbell Municipal Code Sec. 21.28.040(D), the use has a parking demand more commensurate to warehousing than research and development. Therefore, the Director has issued a zoning clearance for establishment of Green Earth Greens, subject to the business operating within the scope of the approved operational description (enclosed), specifically the number of employees, which shall not exceed twelve at any one time. You may now submit a building permit for any necessary tenant improvements and apply for a business license.
