Dear Mr. Wyant,
This letter is in response to your request of October 6, 2010 for a zoning verification
letter for the above referenced property. Your letter indicates that there exists an 887
square-foot discrepancy between the square-footage of your residence as recorded by
the County Assessor (1,308 sq. ft.) and as determined by an appraisal report (2,195 sq.
ft.). A search of building permit records does not reveal the source of this discrepancy.
However, in the City's observation this discrepancy may stem from two factors. Based
on a review of the floor plan and the exterior of the building, it appears that the north
side of the residence is an unrecorded addition. This addition may be unpermitted or
precede County permit requirements before City incorporation. Additionally, County
Assessor records for dwelling square-footage do not include garage area. These two
factors taken together may account for the discrepancy.
In absence of definitive permit documentation, the City cannot verify the legal
conformity of the subject residence in its current configuration.
However, as to whether the existing residence may be rebuilt at the calculated square-
footage of 2,195 square feet in the existing site layout, the City provides the following
information. The subject property is zoned R-1-16 (Single-Family Residential - 16,000
sq. ft. minimum lot size). Properties within the R-1-16 Zoning District are subject to the

City of Campbell San Tomas Area Neighborhood Plan. The San Tomas Area
Neighborhood Plan specifies development criteria for single-family residences such as
minimum lot size, building setbacks, maximum structure height, lot coverage, and floor
area ratio (FAR).
Based upon a review of City documents and taking into account a 2,195 square-foot
structure size indicated by your appraisal report, the City has determined that your
residence conforms to all applicable development criteria for the R-1-16 Zoning District
as specified by the San Tomas Area Neighborhood Plan. Accordingly, the residence
may be rebuilt with the same square-footage and in the same site configuration as
currently exist in the event of its destruction.
