Your Administrative Planned Development Permit application for the establishment of
a commercial school (martial arts studio) within an existing commercial tenant space
has been incomplete since May 21, 2010. As the City has not been contacted to discuss
the completeness issues and over 180 days have passed since the project was deemed
incomplete, your application has expired and is closed with no action taken.
If you are still interested in pursuing an Administrative Planned Development Permit
for your proposed project, you will be required to submit a new application for review.
This will include new submittal documents and the payment of all fees. If you should

Dear Mr. Halloway,
Thank you for submittal of an Administrative Planned Development Permit for the establishment
of a commercial school (martial arts studio) on property located at the above referenced address.
This application has been reviewed by the Planning Division, Building Division, Land
Development Division, Traffic Engineering Division, and the Santa Clara County Fire District.
Based upon this review, this application has been deemed incomplete. The following additional
information and details are needed in order continue processing of this application:
PLANNING DIVISION
Project Plans: Due to the age and incompleteness of the submitted plans, current
professionally drawn plans are required. Such plans must provide all applicable details
described in the Administrative Planned Development Permit application package and must
be to scale and fully dimensionalized. In addition, the plans shall document all existing uses,
including type of use, size of tenant space, number of seats (if restaurant use), and hours of
operation.
Parkin: Pursuant to the Parking and Loading Ordinance, a Commercial School use requires
15 parking spaces. Previous staff analysis of the project site has shown an existing parking
deficiency with the tenant space operating as a retail use. Your proposed change of use from
retail to commercial school will exacerbate an existing condition. Please provide evidence
that your proposed use would not impact the existing parking supply. Additionally, due to
the parking issue, this project will need to be considered by the Planning Commission as it is
the only decision making body that may allow an adjustment to parking. The Planning
Commission has not been supportive of an adjustment to parking standards based on parking
deficiencies caused by the establishment of commercial school uses in existing retail centers.
In light of the project review, it is unlikely that the City will be able to support this use in this
location. The issue regarding the intensification of a current parking deficiency will be very

difficult to resolve. You are entitled to pursue this application as you wish. However, it is staff s
recommendation that it be withdrawn at this time.
