STAFF RECOMMENDATION That the Planning Commission take the following actions: 1. Find that the proposed Capital Improvement Plan is consistent with the City's General Plan; and, 2. Recommend that the City Council find that the adoption of the Capital Improvement Plan (CIP), being a list of future ensuing projects, is exempt from the provisions of the California Environmental Quality Act (CEQA) in that the CIP is not a "project" as defined by Public Resources Code § 21065 and CEQA specifically excludes organizational or administrative activities of government that will not result in direct or indirect physical change in the environment pursuant to CEQA Guidelines § 15378. DISCUSSION Each year, the City prepares a Capital Improvement Plan (CIP) to plan for the acquisition and maintenance of publicly owned property. This includes public facilities such as the Community Center, City Hall and public parks. Public property also includes the acquisition and maintenance of equipment. Expenditures of more than $25,000 must be included in the CIP, while expenditures under that amount are included in annual departmental operating budgets. The City uses the Capital Improvement Plan to project future capital needs, to determine financial resources and to schedule construction activity. Section 65403.c of the State of California Government Code requires that the Planning Commission review the CIP for consistency with the City's General Plan before the City can carry out its capital improvement program. Attached is a copy of the proposed Capital Improvement Plan for 2012-2016 (Attachment 1). II As illustrated above, the proposed FY 2012-16 CIP contains 15 projects of which 4 are new and 11 were previously included in the City's currently adopted CIP. Two of the new projects, both funded from the City's Capital Improvement Plan Reserve (CIPR) in Year 1, involve tenant improvements to the Campbell Community Center Buildings `A' and `M. ' The other two involve the development of a Park Improvement Master Plan in Year 3 and the Park System Improvements in Years 4 and 5, both of which will be funded from Park Dedication fees. Other changes compared to last year's CIP include additional scheduled funding for biennial Accessibility Ramps of $50,000 in Construction Tax (CT), $25,000 in grant funds for Bike/Pedestrian Traffic Safety Improvements, and $330,000 in Vehicle Impact Fees for Annual Street Maintenance. Proposed projects supported by grant funds will only proceed if the grant is secured and any requisite local matching funds are identified. Approximately 63% of the proposed CIP dollars (or $9.1 million) is for Street and Signal projects and approximately 31% (or $4.4 million) is proposed for Parks and Open Space projects. Consistency with the General Plan Staff has reviewed. the proposed projects and finds them consistent with the various elements of the Campbell General Plan and with the Campbell Strategic Plan. The following goals and related policies listed below are applicable to the improvements proposed under the Capital Improvement Plan: Goal LUT-1: Coordinated land use and transportation planning in the region. Policy LUT-1.4: Regional Traffic Mana eg ment: Lead and participate in initiatives and functions to manage regional traffic and to reduce congestion on area roadways. Goal LUT-2: Balanced and functional transportation system. Policy LUT-2.1: Alternative Transportation: Encourage the use of alternative transportation such as ridesharing, public transit, walking, and bicycling to reduce reliance on automobile use. Goal LUT-4: A community that has a strong identity, community image and "sense of place." Goal LUT-6: Strong and identifiable City boundaries that provide a sense of arrival into the City and its districts to reinforce Campbell's quality small town image. Policy OSP-6.2: Community Facilities: Ensure functional, attractive and well-maintained community facilities that serve Campbell's residents. Goal LUT-7: Attractive, well-maintained and safe streets, public improvements and utilities. Staff Report -Planning Commission Meeting of May 10, 2011 CIP2012-2016 Page 4 Goal OSP-1: Regional open space, parks and recreation facilities that are useful, attractive, well maintained and accessible to Campbell residents. Staff also finds consistency with adopted area plans including the San Tomas Area Neighborhood Plan, the South of Campbell Avenue Area Plan, the North of Campbell Avenue Area Plan, the Winchester Boulevard Master Plan, and the Downtown Development Plan. Environmental Assessment In the past, the City has performed a preliminary review of each conceptual project within the CIP and issued an environmental determination. The majority of these have resulted in categorical exemptions from the provisions of CEQA. However, staff has determined that this process is unnecessary at this time. All projects listed in the CIP will be reviewed separately under CEQA at the time they are scheduled to move forward, and the City's review for General Plan consistency does not commit the City to any one of the listed projects. Also, the review of the CIP list is not itself a "project" as defined under CEQA (Public Resources Code § 21065). In addition, the CEQA Guidelines §15378 specifically exclude organizational or administrative activities of government. that will not result in direct or indirect physical changes in the environment. Lastly, the statutory exemption of "feasibility" and "planning studies" would apply because the City decision is to adopt. a CIP that is consistent with the General Plan, not the approval of the individual projects contained within the CIP themselves. City Council Consideration The Planning Commission's recommendation will be considered by the City Council at its meeting of June 21, 2011 as part of the adoption of the Fiscal Year 2011/12 Operating and Capital budget.
