Utility Waiver - Denied - 2011CITY of CAMPBELL Community Development Department June 4, 2010 Gary Carnes Carnes & Associates 9505 Sugar Babe Drive Gilroy, CA 95020 Re: Underground Utility Waiver -File No: PLN2010-124 1623 Adrien Drive Dear Mr. Carnes: Please be advised that the Community Development Director has reviewed your request to permit overhead utility services in conjunction with the construction of a substantial residential remodel to an existing one-story single-family residence at the above-referenced property in lieu of the requirement to underground utilities. Pursuant to Campbell Municipal Code (CMC) Section 21.18.140 (Undergrounding of Utilities), this request has been denied for the following reasons: The CMC requires all electric, telecommunications, and cable television lines that serve a substantial remodel or new development to be installed underground. An application to construct a second story addition and new first level floor area was submitted on March 31, 2010 (PLN2010-61). The resulting floor area will increase from 1,440 sq. ft. (includes garage) to 2,674 sq. ft. (includes garage). Adding over 900 square feet to the existing residence constitutes a substantial investment to the property to warrant the need to underground utilities if practical to do so. 2. CMC § 21.18.140 (D) allows the Community Development Director the ability to waive the requirements of undergrounding utilities when topographical, soil, or other conditions make underground installation unreasonable or impractical. There are no unique topographical conditions associated with the property or its surroundings that would restrict the ability to underground utilities. The site is located on relatively level topography with the utility service drop located to the rear of the existing home and one foot into an adjacent neighboring property. Because the utility pole is within an easement and approximately one foot from your property, the ability to trench utilities to the new remodeled residence is reasonable and practical.
