This office has received an application for a license to operate a residential care facility referenced by Health and Safety
Code, Section 1520.5.
This code section sets forth the State's policy and requirements regarding the overconcentration of residential care
facilities. It defines overconcentration as "facilities which are separated by a distance of 300 feet or less, as measured
from any point upon the outside walls of the structures housing such facilities." The law requires the Director of the
Department of Social Services to deny an application for license if the proposed facility is 300 feet or less from another
residential facility unless approval is obtained from the city or county in which the facility will be located. The law also
requires the Department of Social Services to notify the local agency 45 days in advance of approving an application for
license. The local agency may request denial based upon overconcentration.
X We have determined that the proposed facility is more than 300 feet from any other licensed residential home as
defined by the Health and Safety Code. Therefore, should the referenced applicant meet other requirements for
licensure, we will approve the application. Should your agency's review determine that the proposed facility is 300
feet or less from another residential facility, please notify us within 45 days.

option to approve an exemption from the existing requirement based upon local needs and conditions. If you do not
approve this exemption within 45 days, we will deny the application without further review.
