We have determined the a batting cage that you have described would constitute a "fence" pursuant to the Municipal Code definition (CMC 21.72.020.F): Fence" means an artificially constructed barrier of wood, masonry, stone, wire, metal, or other manufactured material or combination of materials erected to enclose, screen, or separate areas that does not contain any horizontal feature. As such, to allow installation of 12-foot support poles and nylon enclosure will require approval of a Fence Exception. I have enclosed the application for your review. This application will require additional drawings as specified in the application form, manufacture's specifications on the cage, a letter of request (basically what you provided me), and $612 in filing fees. Dear Daniel, Per our conversation last week, we are planning on placing a batting cage for our grandson in our back yard, and need to know if we need a permit to do so. The use will be solely personal for our grandson, and no commercial use is intended. The property is located a 1174 Denver Dr., Campbell, it is a single family residence, on a corner lot, and occupied and owned by my wife and me since 1971. The cage will be of 2 inch squares of nylon cord, 40 feet long by 12 feet high by 14 feet wide. The cage will be supported by steel cable attached to four, 12 foot high (above ground) cyclone fence type posts, one at each corner.
