A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF CAMPBELL APPROVING A PROPOSED
SPECIAL TAX TO BE IMPOSED BY THE SANTA
CLARA COUNTY OPEN SPACE AUTHORITY
WHEREAS, pursuant to the provisions of the Santa Clara
County Open Space Authority Act (Government Code Sections
35100 et seq.) (hereinafter referred to as "The Act"), the
Santa Clara County Open Space Authority was created on
February 1, 1990; and
WHEREAS, in addition to the County of Saata Clara, the
jurisciations participating in the Authority are the Cities
of Campbell, Milpitas, Morgan Hill, Santa Clara, and San
Jose; and
WHEREAS, the Interim Governing Board of the Authority
desires to submit to the voters a proposal to impose a
special tax, not to exceed Twenty-Five Dollars ($25.00), on
owners of developed parcels of land within the Authority's
boundaries; and
WHEREAS, the Act requires that before the Interim
Governing Board adopts an ordinance proposing such special
tax, it shall first obtain resolution of approval of the
proposed tax from a majority of cities which also include a
majority of the population within the boundaries of the
Authority;a do
WHEREAS, the Interim Governing Board of the Authority
has requested this Council to adopt a resolution of approval
of the proposed tax to be submitted to the voters;
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF CAMPBELL AS FOLLOWS:
The Santa Clara County Open Space Authority special
tax, to consist of no more than Twenty-five Dollars ($25.00)
annually imposed upon each owner of a developed parcel
within the boundaries of the Authority, is hereby approved
to be submitted to the voters of the Authority.
PASSED AND ADOPTED this 1st day of May, 1990, by the
following vote:
AYES: Councilmembers KOTOWSKI, WATSON, CONANT, BURR, ASHWORTH
NOES: Councilmembers NONE
ABSENT: Councilmembers NONE
