PC Res 4054RESOLUTION NO. 4054 BEING A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CAMPBELL RECOMMENDING APPROVAL OF A ZONE CHANGE (PLN2011-166) FROM M-1 (LIGHT INDUSTRIAL) TO P-D (PLANNED DEVELOPMENT) ON PROPERTY LOCATED AT 1075 FLORENCE WAY. After notification and public hearing, as specified by law and after presentation by the Community Development Director, proponents and opponents, the hearing was closed. After due consideration of all evidence presented, the Planning Commission did find as follows with respect to application PLN2011-166: Environmental Finding 1. The project qualifies as Categorically Exempt under Section 15332, Class 32, of the California Environmental Quality Act (CEQA), pertaining to infill development and under Section 15315, Class 15, pertaining to the division of property in urbanized areas into four or fewer parcels. Evidentiary Findings 2. The proposed P-D zoning designation would be consistent with the existing Light Industrial General Plan land use designation for the property with the approval of a Zone Change. 3. The proposed development will not result in allowing more residential units than would be allowed by other residential zoning districts which are consistent with the existing General Plan land use designation of the property. 4. The zoning designation change from M-1 to P-D allows for desirable development of a partially vacant property consistent with surrounding industrial developments and due to the existing site constraints that would significantly limit development under standard zoning. 5. The zoning designation change from M-1 to P-D allows for the development on two newly created parcels that provide with access to and from a public street through an existing private ingress/egress easement. Based upon the foregoing findings of fact, the Planning Commission further finds and concludes that: 1. The proposed amendment is consistent with the goals, policies, and actions of the General Plan. 2. The proposed amendment would not be detrimental to the public interest, health, safety, convenience, or general welfare of the City. Planning Commission Resolution No. 4054 PLN2011-166 - 1075 Florence Way Recommending Approval of a Zone Change from M-1 to P-D Page 2 3. The parcel is physically suitable (including absence of physical constraints, access, compatibility with adjoining land uses, and provision of utilities) for the requested zoning designation and anticipated land uses/project. 4. The development and uses will be compatible with the General Plan of the City and will aid in the harmonious development of the immediate area. 5. No substantial evidence has been presented from which a reasonable argument could be made that shows that the project, as currently presented and subject to the required conditions of approval, will have a significant adverse impact on the environment. THEREFORE, BE IT RESOLVED that the Planning Commission recommends approval of a Zone Change (PLN2011-166) from M-1 (Professional Office) to P-D (Planned Development) on property located at 1075 Florence Way.
