PC Res 2912RESOLUTION NO. 2912 BEING A RESOLUTION OF THE PLANNING COMMISSION OF THE C1TY OF CAMPBELL RECOMMENDING APPROVAL OF A TENTATIVE PARCEL MAP TO ALL THE SPLIT OF A LOT ON PROPERTY LOCATED AT 41 & 51 MISSION WAY IN A PD (PLANNED DEVELOPMENT-MEDIUM DENSITY RESIDEN- TIAL/COMMERCIAL) ZONING DISTRICT. APPLICATION OF MR. TERRY Mc ELROY. FILE NO. PM 94-01. After public notification, as specified by law, for the application of Mr. Terry Mc Elroy for approval of a Tentative Parcel Map to allow the two-lot split of property located at 41 & 51 Mission Way, as per the application filed in the Planning Department on February 4, 1994, and after presentation by the Planning Director, the Planning Commission did find, with regard to File No. PM 94-01: The proposed density of 7.1 units per acre is consistent with the allowable density permitted under the General Plan. The existing development is consistent with the Residential Development Standards typically required for single-family development with the exception of lot size. Based on the foregoing findings of fact, the Planning Commission further finds and concludes that, subject to the imposed conditions: 1. The proposed subdivision is consistent with the General Plan. The proposed subdivision does not impair the balance between the housing needs of the region and the public service needs of its residents and available fiscal and environmental resources. The design of the subdivision provides, to the extent feasible, for future passive or natural heating or cooling opportunities. Further, the applicant is notified as part of this application that he is required to comply with all applicable Codes and Ordinances of the City of Campbell and the State of California that pertain to this development and are not herein specified. Map Approval: This approval allows the division of Assessor's Parcel Number 305-033-022 into two residential lots. Approval of this Tentative Map is valid for four years from the date of City Council approval. Map dated 12/15/93, prepared by Melvin Hill, Inc. Resolution No. 2912 PM 94-01 -- 41 & 51 Mission Way Adopted on April 12, 1994 Page 2 o o o o Driveway Maintenance: Prior to final map approval, applicant to provide evidence through the provision of a maintenance agreement or other mechanism found acceptable by the Community Development Director, to ensure maintenance of the private driveway as required in Section 21.50.030 (8) of the Campbell Municipal Code. Parking: Applicant to demonstrate the provision of paved parking facilities and/or garages providing three parking spaces on Parcel A and four parking spaces on Parcel B. Sewers: The subdivider shall install a sanitary sewerage system to serve all lots within the subdivision in conformance with the proposed plans of the West Valley Sanitation District. Sanitary sewerage service to be provided by said District. (Planning) Subdivision Map: Applicant shall process and file a subdivision map. (Public Works) Grading and Drainage Plan: Applicant shall submit three copies of a grading and drainage plan for review by the City Engineer. (Public Works) Storm Drain Area Fee: Applicant shall pay storm drain area fee of $515. (Public Works) o Proof of Legal Access: Applicant shall demonstrate proof of legal access to property.
