A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CAMPBELL
DENYING AN APPEAL AND UPHOLDING A CONDITION OF APPROVAL
REQUIRING THE INSTALLATION OF A STREET LIGHT IN CONJUNCTION
WITH A BUILDING PERMIT (BLD 2012-00299) TO CONSTRUCT
A NEW 2-STORY SINGLE FAMILY DWELLING ON PROPERTY OWNED BY
BRYAN FITZWATER AT 1195 LONGFELLOW AVENUE
WHEREAS, on April 5, 2012 the applicant submitted a building permit application for
the construction of a new two-story 3,286 square foot residence at 1195 Longfellow
Avenue; and
WHEREAS, Longfellow Avenue is part of the South Pocket (White Oaks Road Area)
that was annexed into the City of Campbell on November 22, 2006, previously an
unincorporated County of Santa Clara pocket; and
WHEREAS, Longfellow, Kilmer, Emerson and Holmes Avenues do not have street
lights, except for one located at the cul-de-sac area of Kilmer/Longfellow; and
WHEREAS, the Municipal Code (CMC § 11.24.040) requires street improvements be
installed in connection with the construction of, or addition to, any building or structure
for which a building permit is required; and
WHEREAS, the Municipal Code (CMC § 11.24.030) also identifies the general purpose
and intent of the street improvements chapter of the Municipal Code is to define policies
and procedures for the construction of public improvements and, among other items, to
protect the public safety and common welfare of the general public; and
WHEREAS, the Public Works Department staff issued conditions of approval for the
building permit application on May 3, 2012 requesting that the applicant install a street
light along the project's public street frontage; and
WHEREAS, street lights are installed for pedestrian and vehicle safety; and
WHEREAS, the condition of approval is consistent with City policy and other
developments that have been conditioned to install street improvements where
necessary.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Campbell
denies an appeal and upholds a condition of approval requiring the installation of a
street light in conjunction with a building permit (BLD 2012-00299) to construct a new 2-
story single family dwelling on property owned by Bryan Fitzwater at 1195 Longfellow
Avenue.
