PC Res 2913RESOLUTION NO. 2913 BEING A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CAMPBELL APPROVING A SITE AND ARCHITECTURAL APPLICATION TO ALLOW THE CONSTRUCTION OF A SINGLE-FAMILY RESIDENCE ON PROPERTY LOCATED AT 1689 WALTERS AVENUE IN AN R-l-9 (SINGLE FAMILY RESIDENTIAL) ZONING DISTRICT. APPLICATION OF MR. D. PATRICK FINNIGAN, ON BEHALF OF MR. TONY CHANG. FILE NO. S 92-10. After notification and Public Hearing as specified by law on the application of Mr. D. Patrick Finnigan, on behalf of Mr. Tony Chang, for approval or a Site and Architectural Review permit to allow the construction of a single-family residence on property located at 1689 Walters Avenue in an R-l-9 (Single Family Residential) Zoning District; as per the application filed in the Planning Department on November 11, 1992, and, after presentation by the Community Development Director, proponents and opponents, the hearing was dosed. After due consideration of all evidence presented, the Planning Commission did find as follows with respect to File No. S 92-10: 1. The proposed dwelling in reference to scale, massing and design is consistent with the intent and policies of the San Tomas Area Policies. 2. The building is architecturally compatible with the existing development in the area. Based upon the foregoing findings of fact, the Planning Commission further finds and concludes that: The proposed project is consistent with the policies of the General Plan and zoning for the area. o The proposed project will aid in the harmonious development of the immediate area. The applicant is hereby notified, as part of this application, that he/she is required to meet the following conditions in accordance with the Ordinances of the City of Campbell and the State of California. The lead department with which at the applicant will work is identified on each condition. Additionally, the applicant is hereby notified that he/she is required to comply with all applicable Codes or Ordinances of the City of Campbell and the State of California that pertain to this development and are not herein specified. Resolution No. 2913 S 92-10 - 1689 Walters Avenue Adopted on April 12, 1994 Page 2 o o o ° Approved Project: Approval is granted for a Site and Architectural Review Permit (S 92-10) to allow a single-family dwelling on property located at 1689 Walters Avenue. Approved Plans: Approval is granted for one single-family home of approximately 1,970 square feet. The property is identified as Assessor's Parcel Number 403-18-023. A. Project drawings for the single-family homes consist of four sheets prepared by Patrick Firmigan, dated December 31, 1993. Revised site plan indicating property dimensions verified by deed or other recorded information. Fences: Fences shall 'be constructed in compliance with the fencing provisions as specified in Section 21.59.090 of the Zoning Ordinance. Trees: Applicant shall provide four trees on site as indicated in the approved plans. Property Maintenance: The applicant is hereby notified that the property is to be maintained free of any combustible trash, debris and weeds, until the time that actual construction commences. All existing structures shall be secured by having windows boarded up and doors sealed shut, or be demolished or removed from the property. Section 11.201 & 11.414, 1985 Ed. Uniform Fire Code. (Fire Department) Underground Utilities: Underground utilities to be provided as required by Section 20.36.150 of the Campbell Municipal Code. (Public Works) Utility Connections: Plans submitted to the Building Division for plan check indicate clearly the location of all connections for underground utilities including water, sewer, electric, telephone and television cables, etc. (Building) Building Code: Provide modified one hour (1-Hr.) construction between the garage and the living areas (walls and ceiling of garage) UBC 503. Windows: All bedrooms must have a minimum of one (1) window openable to 20" wide by 24" high and 5.7 square feet. Maximum of 44" above the floor. UBC 1205. (Building) Storm Drainage: Applicant shall pay Storm Drain Area Fee of $188.77. (Public Works) Grading & Drainage: Applicant shall submit three copies of a grading and drainage plan for approval by the City Engineer. (Public Works) Encroachment Permit: Applicant shall apply for an encroachment permit, submit plans, pay fees, post surety, for any work within the public right of way. (Public Works) Utility Easement: The applicant shall dedicate a five (5.00) foot wide publi~ utility easement (P.U.E) and/or public service easement (P.S.E) for any and all public utility facilities.
