250 Budd Ave. (PD76-13) ORDINANCE NO. 1068 The City Council of the City of Campbell does ordain as follows: SECTION ONE: That the Zoning Map of the City of Camobell is hereby changed and amended by adopting the attached "Exhibit A" entitled "Plans and Elevations.1I IIExhibit BII entitled IIDevelopment Schedule,1I and "Exhibit CII entitled tlMap of Said Property," as per application of Robert L. McKee on behalf of Corinthian House, lnc, for approval of plans, elevations, and development schedule to construct a lOS-unit senior citizens' apartment complex on property known as 250 Budd Avenue in a Planned Development Zoning District. Said approval granted subject to the following conditions: A. Approval of ZC 76-9. ( J B. Property to be fenced and landscaped as indicated and as added in tlredll on plans. C. landscape plan indicating type of piant material, location of hose bibs or sprinkler system a,ld type of fencing to be submitted for approval of the Planning Director at time of application for building permit. ~ D. landscaping shall be maintained with the approved landscape plan. ~ E. Faithful performance bond in the amount of $10,000 to be posted to insure landscaping, fencing, and striping of parking area within three (3) months of completion of construction, or applicant may file written agreem2nt to complete landscaping, fencing and striping of parking area prior to final building department clearance. F. All mechanical equipment located on roofs shall be screened as approved by the Planning Director. G. All parking and driveway areas to be developed in compliance with Section 21.50 of the Campbell Municipal Code. All parking spaces to be provided with appropriate concrete curbs or bumper guards. H. Underground utilities to be provided as required by Section 20.16.010 of the Campbell Municipal Code. . .,,..,, - I. Plans submitted to the Building Department for plan check shall indicate clearly the location of all connections for underground utilities including water, sewer, electric, telephone and television cables, etc. J. Sign application to be submitted in accordance with pro- visions of the sign ordinance for all signs. No sign to be installed until application is approved and permit issued by the Building Department. K. Ordinance No. 782 of the Campbell Municipal Code stipulates that any contract for the collection and disposal of refuse, garbage, wet garbage, and rubbish produced within the limits of the City of Campbell shall be made with Green Valley Disposal Company. This requirement applies to all single family dwellings, multiple apartment units, to all commercial, business, industrial, manufacturing, and construction establishments. l. Trash container(s) of a size and quantity necessary to serve the development shall be located in area(s) approved by the Fire Department. Unless otherwise noted, enclosure(s) shall consist of a concrete floor surrounded by a solid wall or fence and have self-closing doors of a size specified by the Fire Department. All enclosures to be constructed at grade level. M. Applicant shall meet all State requirements for the handicapped. FIRE DEPARTMENT. N. Provide an on-site fire hydrant system. o. Install a manual fire alarm system with an annunciator panel. -P. Provide an automatic fire extinguishing system. Q. Provide "2A-l OBC"C'i re extinguishers in metal cabinets.,:, BUILDING DEPARTMENT R. Three or more story, buildings, roofs and exterior walls shall be one-hour fire rated as per Table l7-A Type V, l-hour. PUBLIC WORKS DEPARTMENT S. Pay storm drainage area fee at'$765 per acre. Obtain excavation permit for construction of balance of street improvements. . -., /... 21.06.010 PURPOSE Corinthian House, Inc. is a not-for-profit organization designed to help senior citizens, including but not limited to the supplying of reasonable priced residential facilities, including meals. Under its Charter, Corinthian House must provide a measure of bene- volence which will include reduced rates for housing for a propor- tion of individuals with low income in our facilities and sponsoring of persons in other suitable quarters pending completion of Corinthian House's own structure. Benevolence may also include the supplying of clothing, help with moving and other assistance to those in need. 21.06.050 PUBLIC INTEREST AND NECESSITY To meet these objectives and to be of maximum service to those in need, it is essential that the property at 250 Budd Avenue be utilized for the greatest number of residential units feasible, consistent with concepts of open space, attractive appearance, comfort and security. ') All residents must be ambulatory and able to care for themselves; ,nursing service will not be provided. In keeping with our concept of greatest service to the community, ,Corinthian House may, subject to applicable regulations and with or without government subsidy, desire to make low cost meals available to low income residents in the area and to provide day care services for the children of working mothers needing this help. For the proposed maximum utilization of the property, we wish to reinstate and revise an earlier application and apply for permission to build one hundred four res.'dential units plus a managers apartment. (The earlier application was submitted and approved in its original form on November 2, 1970 2l.06.070(S)_OFF-STREET~PARKi~G A total of thirty six parking spaces have been provided which we believe will be more than adequate for the following reasons: 1. Public transportation is available within two blocks of the project; 2. Average age of residents is expected to be upwards of sevent)' years; \.. OUT budget includes provision for mini-bus facilities for transporting residents to shopping areas, church, cultural and entertainment programs; 4. A survey of other senior residence homes in the area, almost all of which have higher monthly rates and hence the degree of affluence which residents increasingly need to own and operate an automobile, indicates that this ratio of parking facilities will be more than adequate. It will be our policy to assign parking snaces to residents and new residents with cars will need to either dispense with their vehicles or rent off-property parking space in the unlikely event that on- property parking space is not immediately available. Additionally, our budgets provide for not more than five employees to be on the premises at anyone time. Not more than five spaces will be needed for employee parking, plus one space for parking of the facility mini-bus. 21.06.070 SITE LOCATION ) See attached aerial photo showing location of property and its relation to surrounding areas. Note the trees; also note in the plans the care that has been taken in location of buildings and 'other facilities to preserve the best trees, as well as the number of trees saved. These will make this a handsome, secluded haven for its elderly residents. 21.06.080 DEVELOPMENTSCHEDULJ , Construction will be started with-in not more than eighteen months after approval of our planned ievelopment application, and completion of the first 75 units within S months after start of construction.
