CC Resolution 11464RESOLUTION NO. 11464 BEING A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CAMPBELL APPROVING THE REORGANIZATION OF THE AREA DESIGNATED AS "CAMBRIAN NO. 36" INVOLVING THE ANNEXATION OF THE NEIGHBORHOOD INTO THE CITY OF CAMPBELL; DETACHMENT FROM THE SANTA CLARA COUNTY CENTRAL FIRE PROTECTION DISTRICT AND FROM THE SANTA CLARA COUNTY LIGHTING DISTRICT; INCLUSION INTO THE CAMPBELL LIGHTING AND LANDSCAPE ASSESSMENT DISTRICT AND THE CAMPBELL MUNICIPAL LIGHTING DISTRICT FOR BOTH THE CAMBRIAN NO. 36 AND CENTRAL PARK NEIGHBORHOODS; AND SET THE EFFECTIVE DATE OF THE REORGANIZATION (PLN2011-226 AND PLN2011-267) WHEREAS, the City Council of the City of Campbell at its study session of June 16, 2009 directed staff to pursue discussions with the City of San Jose in order to detach the Cambrian No. 36 county pocket from their Sphere of Influence (SOI) and Urban Service Area (USA) to allow a Campbell annexation of the territory; and WHEREAS, on August 24, 2009, LAFCO informed both the Cities of San Jose and Campbell that in order to maintain logical jurisdictional boundaries with a Campbell annexation, the Central Park neighborhood would need to be detached from the City of San Jose and annexed into the City of Campbell; and WHEREAS, the City of San Jose approved the annexation of the territory on December 7, 2010 but agreed to postpone the Local Agency Formation Commission Organization (LAFCO) filing for six months to allow the Cities of San Jose and Campbell to negotiate an agreement that would allow the pocket to be annexed into Campbell; and WHEREAS, a condition of the agreement was that it would have to be revenue neutral to the City of San Jose resulting in an annual payment of $199,000 to the City of San Jose every year for the first five years to which an adjustment would occur every consecutive five years to main such neutrality over a forty year period; and WHEREAS, on July 20, 2011, the City of San Jose City Council approved the terms of a future agreement with the City of Campbell and adopted a related resolution to allow consideration of an alternative reorganization proposal; and WHEREAS, on August 2, 2011, the City of Campbell City Council approved the major terms of the agreement and authorized the City Manager to execute the agreement; and WHEREAS, on September 21, 2011, the City of Campbell Planning Division conducted a neighborhood meeting with the residents of the Cambrian No. 36 and Central Park neighborhoods to explain the annexation and detachment processes; and City Council Resolution -October 2, 2012 File No. PLN2011-226 and PLN2011-267 -Cambrian No. 36 and Central Park Page 2 WHEREAS, on October 25, 2011, the City of Campbell Planning. Commission considered a General Plan and Pre-Zoning Map amendment to establish land use designations for the Cambrian No. 36 and Central Park neighborhoods; and WHEREAS, the City of Campbell City Council considered the Planning Commission's recommendation on November 15, 2011 and approved the General Plan and Pre- Zoning Map amendments, and considered the expansion of the SOI and USA to encompass both territories, and authorized staff to file application with LAFCO requesting that LAFCO initiate proceedings for the amendment of the SOI and USA for the reorganization of the subject territories; and WHEREAS, on January 30, 2012, the City of Campbell filed application with LAFCO following preparation of the required mapping and application materials; and WHEREAS, LAFCO informed the City that an additional City Council action was required as part of the application resulting in the need to return back to the City Council on April 3, 2012 to authorize the submittal of an application to annex the Central Park Neighborhood into the Santa Clara County Library service area and into the West Valley Sanitation District and inclusion of the Central Park and Cambrian No. 36 neighborhoods into the West Valley Sanitation District's SOI; and WHEREAS, on April 4, 2012, an application was filed with LAFCO to annex the Central Park Neighborhood into the Santa Clara County Library service area and into the West Valley Sanitation District and inclusion of the Central Park and Cambrian No. 36 neighborhoods into the West Valley Sanitation District's SOI; and WHEREAS, on April 4, 2012 the LAFCO Commission conditionally approved the City of Campbell's request for a SOI and USA amendment, the detachment of the Central Park neighborhood from the City of San Jose, and the annexation to the City of Campbell; and WHEREAS, the LAFCO conditions of approval required the Executive Officer of LAFCO to hold protest proceedings for the Central Park Reorganization; and WHEREAS, the protest proceedings occurred on June 4, 2012 with no filed protests; and WHEREAS, the LAFCO conditions of approval required the execution of an agreement between the Cities of San Jose and Campbell prior to December 31, 2012; and WHEREAS, the City understands that an agreement will be finalized and executed prior to filing with LAFCO and intends to submit said agreement no later than November 1, 2012; and WHEREAS, the LAFCO conditions of approval required LAFCO approval of an annexation of the Central Park Neighborhood into the Santa Clara County Library City Council Resolution -October 2, 2012 File No. PLN2011-226 and PLN2011-267 -Cambrian No. 36 and Central Park Page 3 service area and into the West Valley Sanitation District and inclusion of the Central Park and Cambrian No. 36 neighborhoods into the West Valley Sanitation District's SOI; and WHEREAS, on May 30, 2012 the LAFCO conditionally approved the request subject to the Executive Officer conducting protest proceedings; and WHEREAS, the protest proceedings occurred on September 6, 2012 with no filed protests; and WHEREAS, an "Island Annexation Mapping Request Form" was submitted to the LAFCO and County of Santa Clara on August 2, 2012 to prepare the necessary mapping materials for the Cambrian No. 36 territory; and WHEREAS, the County prepared and submitted back to the City of Campbell Surveyors/Assessors Reports and Maps for the Cambrian No. 36 territory on September 17, 2012; and WHEREAS, the "Cambrian No. 36" pocket is approximately 80 acres and consists of 333 parcels as described in Exhibit A; and WHEREAS, the "Central Park" neighborhood is approximately 16 acres and consists of 96 parcels as described in Exhibit B; and WHEREAS, both neighborhoods are contiguous to the City of Campbell; and WHEREAS, the two neighborhoods affected by the annexation/reorganization are hereby annexed into the Campbell Lighting and Landscaping Assessment District (LLA- 1)and the Campbell Municipal Lighting District (CMLD); and WHEREAS, fire protection service would be extended into the two neighborhoods and provided by Santa Clara County Central Fire Protection District under contract with the City of Campbell; and WHEREAS, the annexation would provide for use of the City of Campbell services; and WHEREAS, the "Cambrian No. 36" pocket has been pre-designated as General Plan land uses to General Commercial for properties located along Camden Avenue, to Neighborhood Commercial for non-residential properties located at the corner of Union and Bascom Avenues, and to Low-Density Residential (less than 4.5 dwelling units per gross acre) for residential properties; and WHEREAS, the "Cambrian No. 36" pocket has been pre-zoned as Zoning Districts to CC=2 (General Commercial) for properties located along Camden Avenue, to C-1 (Neighborhood Commercial) for properties located at the corner of Union and Bascom City Council Resolution -October 2, 2012 File No. PLN2011-226 and PLN2011-267 -Cambrian No. 36 and Central Park Pape 4 Avenues, and to R-1-8 (8,000 square foot minimum lot sizes) for residential properties; and WHEREAS, the City of Campbell, as Lead Agency for environmental review for the reorganization, finds that the project qualifies for a Categorical Exception under the California Environmental Quality Act (CEQA) Section 15319 [annexations that contain existing developments served with public facilities] and Section 15305 [minor alterations in land use limitations]; and WHEREAS, the County Surveyor of Santa Clara County surveyor has prepared the maps and descriptions (Exhibits "A") in accordance with Government Code Section 56757, the boundaries to be definite and certain, and the proposal to be in compliance with LAFCO's road annexation policies; and WHEREAS, as provided in Government Code Section 56757, the City Council of the City of Campbell shall be conducting authority for a reorganization including an annexation to the City; and WHEREAS, said territory is developed and inhabited, each Pocket is less than 150 acres, and the Pocket is located within the SOI of the City of Campbell as recently approved by LAFCO; and WHEREAS, California Government Code Section 56375.3 provides for an expedited process for cities to initiate changes of organization or reorganization for pockets of unincorporated territory within specified time frames that meet specified criteria; and WHEREAS, the State legislature has adopted the objective for LAFCO's to promote orderly boundaries and the efficient delivery of services; and WHEREAS, the continuation of unincorporated pocket areas is inconsistent with State, County and local policies that discourage the continuation of unincorporated pocket areas surrounded by cities. NOW, THEREFORE, BE IT RESOLVED, as follows: 1. Findings: The City Council finds as follows: a. The territory does not exceed 150 acres in area, and that area constitutes the entire island; b. The territory is substantially surrounded by the city to which annexation is proposed or by the city and a county boundary or adjacent cities; c. The territory is substantially developed, in that: (1) Public utility services are available; City Council Resolution -October 2, 2012 File No. PLN2011-226 and PLN2011-267 -Cambrian No. 36 and Central Park Paoe 5 (2) Public improvements have been installed; and (3) Physical improvements are located upon the parcels within the area. d. The territory is not prime agricultural land, as defined by Section 56064. e. The territory will benefit from the annexation or is receiving benefits from the annexing city. f. The territory is within the urban service area of the city as adopted by LAFCO; g. The county surveyor has determined the boundaries of the proposal to be definite and certain, and in compliance with the road annexation policies of LAFCO; h. The proposal does not split lines of assessment or ownership; i. The proposal does not create islands or areas in which it would be difficult to provide municipal services; j. The proposal is consistent with the adopted general plan of the City; k. The territory is contiguous to existing City limits; and I. The City has complied with all conditions imposed by the commission for inclusion of the territory in the urban service area of the city. 2. Annexation: The City Council of the City of Campbell hereby approves: a. The annexation of the territory designated as "Cambrian No. 36" into the City of Campbell, the Campbell Lighting and Landscaping Assessment District (LLA-1) and the Campbell Municipal Lighting District (CMLD); and detachment from the Santa Clara County Central Fire Protection District and from the Santa Clara County Lighting District, and that upon completion of these reorganization proceedings the territory reorganized will be taxed on the regular county assessment roll, and including taxes for existing bonded indebtedness. b. The annexation of the territory designated as "Central Park" into the City of Campbell Lighting and Landscaping Assessment District (LLA-1) and the Campbell Municipal Lighting District (CMLD), and that upon completion of these reorganization proceedings the territory reorganized will be taxed on the regular county assessment roll, and including taxes for existing bonded indebtedness.
