PC Res 2921RESOLUTION NO. 2921 BEING A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CAMPBELL RECOMMENDING APPROVAL OF A MINOR MODIFICATION TO A SIDE YARD SETBACK TO ALLOW THE CONSTRUCTION OF A SECOND STORY ADDITION ON PROPERTY LOCATED AT 1067 ALMARIDA DRIVE IN AN R-1-6 (SINGLE FAMILY RESIDENTIAL) ZONING DISTRICT. FILE NO. M 94-05. After notification and Hearing on the application of Mr. Jack McGillis, on behalf of Ray and Karen Moskaluk, for a minor modification to a side yard setback to allow the construction of a second story addition on property located at 1067 Almarida Drive in an R-l-6 (Single Family Residential) Zoning District, as per the application filed in the Planning Department on May 4, 1994; and, after presentation by City Staff, proponents and opponents, the hearing was closed. After due consideration of all evidence presented, the Planning Commission did find as follows with respect to File No. M 94-05: The absence of second story windows on the north side of the proposed addition addresses issues of privacy relating to the adjoining neighbor. The proposed design and expansion of the existing dwelling is compatible with the existing dwelling and homes in the neighborhood. o The proposal reflects recommendations made by the Site and Architectural Review Committee to enhance the entryway and extend the wood siding along the first floor. Based upon the foregoing findings of fact, the Planning Commission concludes that: The proposed development and uses clearly result in a more desirable environment and use of land than would be possible under any other zoning classification. o The development and uses will be compatible with the General Plan of the City and will aid in the harmonious development of the immediate area. o The proposed development would not be detrimental to the health, safety or welfare of the neighborhood or the City as a whole. Resolution No. 2921 M 94-05 -- 1067 Almarida Drive Adopted on June 14, 1994 Page 2 Further, the applicant is notified as part of this application that he is required to comply with all applicable Codes and Ordinances of the City of Campbell and the State of California that pertain to this development and are not herein specified. Approved Project: This approval is for a minor modification allow a one foot reduction in a required side yard setback allowing the construction of a second story addition on an existing single family dwelling located at 1067 Almarida Drive in a R-l-6 (Single Family Residential) Zoning District. A. Project Plans: Project shall substantially adhere to project plans prepared by Jack McGillis and dated June 13, 1994. Bo Details: Applicant shall submit details concerning the entryway treatment and support posts for approval by the Community Development Director prior to issuance of the building permits. Co Horizontal Siding: The horizontal siding shall be centered along the first floor elevation to a logical termination that shall be defined in the building plans. ° Second Story Addition Design: The second floor addition is to be designed by a licensed architect or engineer with plans stamped and signed by same. (Building) ° Emergency Egress: All new bedrooms to meet emergency egress requirements per UBC 1204.
