PC Res 2925RESOLUTION NO. 2925 BEING A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CAMPBELL APPROVING A CONDITIONAL USE PERMIT TO ALLOW THE ESTABLISHMENT OF AN ATHLETIC FACILITY (28,000 SQUARE FEET) IN A PORTION OF AN EXISTING COMMERCIAL BUILDING LOCATED ON PROPERTY KNOWN AS 700 W. HAMILTON AVENUE IN A C-2-S (GENERAL COMMERCIAL) ZONING DISTRICT. APPLICATION OF MR. MICHAEL GREENWOOD. FILE NO. UP 94-01. After notification and Public Hearing as specified by law on the application of the Mr. Michael Greenwood, on behalf of Greenwood Construction, to approve a Conditional Use Permit allowing the establishment of an athletic facility (28,000 square feet) in a portion of an existing commercial building located on property known as 700 W. Hamilton Avenue, and after presentation by the Planning Director, proponents and opponents, the hearing was dosed. After due consideration of all evidence presented, the Planning Commission did find as follows with respect to File No. UP 94-01: No substantial evidence has been presented which shows that the project, subject to the Conditions of Approval, would have a significant adverse impact on the environment. o An initial study has been conducted by the City of Campbell in order to evaluate the potential for adverse impacts, either individually or cumulatively. There is no evidence before the City of Campbell indicating that the proposed project will have any potential for an adverse effect on wildlife resources. The proposed athletic facility is consistent with the commercial land use designation shown on the Land Use Element of the General Plan. Se The proposed athletic facility, subject to the conditions imposed, addresses the development standards of the General Commercial Zoning District. o Adequate parking and circulation improvements have been provided to integrate the proposed use into the neighborhood. Hamilton Avenue Adopted on August 9, 1994 Page 2 o The proposed parking adequately addresses the parking needs of the existing office use and proposed athletic facility based upon varied hours and parking demands as well as the concept of shared parking. The proposed use will compliment the existing office use and is compatible with surrounding and adjacent uses. Based upon the foregoing findings of fact, the Planning Commission concludes that: The establishment, maintenance, or operation of the use applied for will not be detrimental to the public health, safety, peace, morals, comfort or general welfare of persons residing or working in the neighborhood of such proposed use. The proposed use will not be detrimental or injurious to property and improvements in the neighborhood or to the general welfare of the City. The proposed site is adequate in size and shape to accommodate the said use. The proposed site is adequately served by streets of sufficient capacity to carry the kind and quantity of traffic such use would generate. 4. The proposed use is compatible with the uses in the area. Further, the applicant is notified as part of this application that he/she is required to meet the following conditions in accordance with the Ordinances of the City of Campbell and the State of California. The lead department with which the applicant will work is identified on each condition. Additionally, the applicant is hereby notified that he/she is required to comply with all applicable Codes or Ordinances of the City of Campbell and the State of California that pertain to this development and are not herein specified. APPROVED USE 1. Approval is granted for a health and fitness dub of approximately 28,000 square feet located at 700 W. Hamilton Avenue. The proposed business shall substantially comply with the applicant's description per attachment #3 of the Planning Commission report and the following conditions. Hamilton Avenue Adopted on August 9, 1994 Page 3 Operational Hours: Monday through Friday Saturdays & Sundays 5 a.m. to 11 p.m. 7 a.m. to 9 p.m. Trash Containers: Trash container(s) of a size and quality necessary to serve the development shall be located in area(s) approved by the Fire Department and the Community Development Director. Unless otherwise noted, endosure(s) shall consist of a concrete floor surrounded by a solid wall or fence and have self-dosing doors of a size spedfied by the Fire Department. All enclosures to be constructed at grade level and have a level area adjacent to the trash enclosure area to service these containers. (Fire Department/Planning) Revised Site Plan & Elevations: Prior to issuance of building permits, applicant to submit three copies of revised site plans and elevations to the Planning Department addressing modifications #1-8 as recommended by the Site and Architectural Review Committee, including the landscape to sidewalk transition area at the corner of Hamilton Avenue and San Tomas Expressway. Landscape Plan: Applicant to submit four copies of landscape and irrigation plans to the Planning Department for approval of the Community Development Director prior to issuance of building permits. Revised landscaping plans to address the following items: A. Provision of boulevard treatment consistent with the Streetscape Standards. Landscape plan to indicate the provision of canopy type trees (minimum 15-gallon size) throughout the parking area and along the expressway and W. Hamilton Avenue frontages of the project and upgrading of existing planting along Gayle Drive. C. The parking spaces shown adjacent to the W. Hamilton Avenue frontage shall be eliminated and this area shall be landscaped. D. Applicant to provide a pedestrian connection to the Hamilton Avenue frontage adjacent to the driveway. Hamilton Avenue Adopted on August 9, 1994 Page 4 Existing trees to be retained shall be protected consistent with the Water Efficient Landscape Standards (WELS) adopted by the City of Campbell. Property Maintenance: Applicant is responsible to maintain fencing and landscaping in accordance with the approved plans. 6. Performance Bond: Applicant is to either: Post a faithful performance bond in the amount of $15,000 to ensure landscaping, fencing and striping of parking areas within three months of completion of construction; or File a written agreement to complete landscaping, fencing and striping of parking area. Bond or agreement to be filed with the Planning Department prior to application for a building permit. (Planning) PROPERTY MAINTENANCE/UTILITIES 7. Property Maintenance: The applicant is hereby notified that the property is to be maintained free of any combustible trash, debris and weeds, until the time that actual construction commences. All existing structures shall be secured by having windows boarded up and doors sealed shut or be demolished or removed from the property. Section 11.201 & 11.414, 1985 Ed. Uniform Fire Code. (Fire Department) Garbage Collection: Ordinance No. 782 of the Campbell Munidpal Code stipulates that any contract for the collection and disposal of refuse, garbage, wet garbage and rubbish produced within the limits of the City of Campbell shall be made with Green Valley Disposal Company. (Fire Department) PUBLIC WORKS 9. Dedicate Land for Boulevard Treatment: The applicant shall dedicate an eight-foot wide strip of land along the W. Hamilton Avenue frontage to allow the construction of boulevard treatment. Resolution No. 2925 UP 94-01 - 700 W. Hamilton Avenue Adopted on August 9, 1994 Page 5 10. Encroachment Permits: The applicant shall apply for an encroachment permit, submit plans, pay fees, post surety for removals and construction of public street improvements upon Hamilton Avenue. Plans shall show all existing and proposed public improvements. 11. Grading and Drainage Plan: The applicant shall submit a grading and drainage plan that shows all existing and proposed grading and drainage facilities. All on-site storm water runoff shall be collected on-site and conveyed underground from on-site to a public underground storm drain system. The grading and drainage plan shall show the existing and/or proposed contours of landscape buffer areas. 12. Parcel Map: Applicant to file and process a parcel map to combine lots. 13. Interconnect System: Applicant to pay to the City the sum of $9,000 to fund all costs associated with interconnecting Darryl/Hamilton and STEX/Hamilton signals, which may include, but is not limited to, all labor, materials, tools, equipment and inddentals and for doing all of the work involved in the interconnecting the traffic signal systems. PUBLIC SAFETY/WELFARE 14. Utility Boxes: Applicant to submit a plan to the Planning Department, prior to installation of PG&E utility (transformer) boxes, indicating the location of the boxes and screening (if boxes are above ground) for approval of the Planning Director. (Planning) 15. Underground Utilities: Underground utilities to be provided as required by Section 20.36.150 of the Campbell Municipal Code. (Public Works) 16. Utility Connections: Plans submitted to the Building Division for plan check indicate clearly the location of all connections for underground utilities including water, sewer, electric, telephone and television cables, etc. (Building) 17. Handicapped Requirements: Applicant shall comply with all appropriate State and City requirements for the handicapped. (Building) 18. Equipment Screening: All mechanical equipment on roofs and all uti_'!ity meters to be screened as approved by the Planning Director. (Planning) Resolution No. 2925 UP 94-01 - 700 W. Lighting Plan: Lighting plan shall be submitted to the Planning Department and approved by the Planning Director prior to issuance of a building permit if modifications to existing exterior lighting is proposed. (Planning) 20. Signs: Sign application to be submitted in accordance with provisions of the Sign Ordinance for all signs. No sign shall be installed until application is approved and a permit issued by the Planning and Building Departments (Section 21.53 of the Campbell Municipal Code). Project signing as presented on plans is not approved. All temporary signs shall conform to the Temporary Sign Ordinance. (Planning) STREET/SITE IMPROVEMENTS 21. Parking and Driveways: All parking and driveway areas to be developed in compliance with Chapter 21.50 of the Campbell Munidpal Code. All parking spaces to be provided with appropriate concrete curbs or bumper guards. Parking area to be restriped with designation of spaces as well as traffic flow markings. FIRE DEPARTMENT 22. Construction Drawings: Submit scaled and dimensioned construction drawings to the Building Department for review and permit. All construction shall comply with the 1991 California Building Code for Type II-One Hour. Fire Sprinkler System: Provide an automatic fire sprinkler system throughout all portions of the building. System shall be designed per NFPA Standard #13, 1989 edition with plans submitted to the Central Fire District for review. 24. Exits: Exits shall comply with the California Building Code, Chapters 8 and 33. 5. One-Hour Separation/Day Care Use: Provide a one-hour rated occupancy separation which is both vertical and horizontal between the Day Care use and the balance of the tenant space. Also, provide an approved early warning device therein. 26. Fire Alarm System: Provide/maintain a fire alarm system for monitoring fire sprinkler system by an approved Central Station. Access Keys in Lock Box: Tenant to provide access keys for storage in the building access key lock box (Knox).
