AUTHORIZATION TO RESCIND CONTRACT FOR NON-PERFORMANCE AND AUTHORIZE
THE PUBLIC WORKS SUPERINTENDENT TO PURCHASE
FIVE NEW 2013 CHEVROLET CAPRICE MARKED PATROL VEHICLES
FROM WONDRIES FLEET GROUP
WHEREAS, the Police Department has selected the Chevrolet Caprice as their preferred
vehicle for marked vehicle operations; and
WHEREAS, the current Fiscal Year 2012/13, Vehicle and Equipment Maintenance Operating
Budget has appropriated funds for replacement of five patrol vehicles; and
WHEREAS, on July 17, 2012, City Council adopted Resolution Number 11440, which
approved the specifications and call for bids for the purchase of three new 2013 Chevrolet
Caprice marked police vehicles to replace the existing retired vehicles; and
WHEREAS, following the formal bid process, Stevens Creek C LLC, Courtesy Chevrolet was
deemed the lowest responsible bidder and the Interim Public Works Superintendent was
authorized to award the contract for the procurement of these units; and
WHEREAS, on October 16, 2012, City Council adopted Resolution Number 11468, which
authorized the purchase of two additional police patrol units by the lowest bid received by
Stevens Creek C LLC, Courtesy Chevrolet; and
WHEREAS, on March 8, 2013, staff inspected three Chevrolet Caprice Patrol Vehicles and
determined that the units were V-6 3.8 liter engines and did not meet the specifications
approved by City Council; and
WHEREAS, Courtesy Chevrolet did notify city staff that the additional two Chevrolet Caprice
Patrol Vehicles not yet delivered were also equipped with the non-compliant V-6 3.8 liter
engines; and
WHEREAS, staff is requesting that City Council authorize the Public Works Superintendent to
cancel the contract for non-performance; and
WHEREAS, staff is further requesting that City Council authorize the Public Works
Superintendent to award the contract for these five new patrol units to the Wondries Fleet Group
who has been determined to be the lowest responsible bidder as a result of a competitive bid
process conducted by the Los Angeles Airport (Contract #DA 4672) and is in compliance with
the Campbell Municipal Code 3.20.070; and
WHEREAS, Wondries Fleet has pre-ordered 60 non-committed 2013 Chevrolet Caprice V8 6
liter engine, patrol vehicles and expects delivery of these units by mid June, which will allow for
a much quicker acquisition over conducting a new bid; and
WHEREAS, staff is recommending that the City obtain the County of Santa Clara's services for
the installation of safety equipment.
NOW, THEREFORE, BE IT RESOLVED that the City Council authorize the Public Works
Superintendent to award the contract to purchase five new 2013 Chevrolet Caprice Police Patrol
Vehicles from Wondries Fleet Group and authorize the installation of the safety equipment to
the County of Santa Clara.
