PC Res 2934RESOLUTION NO. 2934 BEING A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CAMPBELL APPROVING A CONDITIONAL USE PERMIT TO ALLOW A PUBLIC PARK USE ON PROPERTY LOCATED AT 90 S. FIRST STREET IN A PD (PLANNED DEVELOPMENT) ZONING DISTRICT. CITY- INITIATED APPLICATION. FILE NO. UP 94-15. After notification and Public Hearing as specified by law on the City-initiated application to approve a Conditional Use Permit allowing a public park use on property at 90 S. First Street, and after presentation by the Planning Director, proponents and opponents, the hearing was closed. After due consideration of all evidence presented, the Planning Commission did find as follows with respect to File No. UP 94-15: The public park use will provide a complimentary land use to the surrounding residential and office developments in the area. e Development of the property with a public park will add to park land available in the City of Campb,ell. The location of the park within proximity to the downtown neighborhoods reflect the policy of the Open Space Element of providing access to park fadlities within reasonable walking distance of a resident's home. Therefore, the Planning Commission; hereby, also finds in conclusion that: The establishment, maintenance or operation of the use applied for will not be detrimental to the public health, safety, peace, morals, comfort or general welfare of persons residing or working in the neighborhood of such proposed use, or be detrimental or injurious to property and improvements in the neighborhood or to the general welfare of the City. The proposed park site is adequate in size and shape to accommodate the said use with uses in the surrounding area. The proposed site is adequately served by streets of suffident capacity to carry the kind and quality of traffic such use would generate. 4. The proposed use is compatible with the uses in the area. Further, the applicant is notified as part of this application that he/she is required to meet the following conditions in accordance with the Ordinances of the City of Campbell and the State of California. The lead department with Resolution No. 2934 UP 94-15 - 90 S. First Street Adopted on September 13, 1994 Page2 which the applicant will work is identified on each condition. Additionally, the applicant is hereby notified that he/she is required to comply with ail applicable Codes or Ordinances of the City of Campbell and the State of California that pertain to this development and are not herein specified. APPROVED USE 1. Park Use: Approvai is granted for a .33 net acre public park use located at 90 S. First Street. The proposed park shall be established to provide additional park land within the City of Campbell and shall be dedicated in honor of the Hyde Family. ae Revised Site Plan: A revised park site plan shall be submitted reflecting recommendations of the Parks and Recreation Commission for a more simplified design. Details of the park design shall be reviewed and approved by the Director of Parks and Recreation Department prior to construction of improvements. Hours of Operation: The park shail maintain hours of operation and operationai characteristics consistent with other parks in the City of Campbell. Building Permits: Improvements are subject to the issuance of building permits as required under the Uniform Building Code. (Building) Historic Landmark: Property known as the Campbell Water Company Tower and Pump House is designated an Historic Landmark and is subject to the review procedures in accordance with Section 21.41 (Historic Preservation) of the Zoning Ordinance.
