PC Res 2942RESOLUTION NO. 2942 BEING A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CAMPBELL APPROVING A SITE AND ARCHITECTURAL APPLICATION TO ALLOW :A SINGLE- FAMILY HOME ON PROPERTY LOCATED AT 1475 YORK AVENUE IN AN R-l-9 (SINGLE FAMILY RESIDENTIAL) ZONING DISTRICT. APPLICATION OF MR. BRUCE JOHNSON, ON BEHALF OF MR VERNON SUART. FILE NO. S 94-07. After notification and Public Hearing as specified by law on the application of Mr. Bruce Johnson, on behalf of Vernon Suart, for approval of plans allowing a residential structure on property located at 1475 York Avenue; as per the application filed in the Planning Department on November 2, 1994, and, after presentation by the Community Development Director, proponents and opponents, the hearing was closed. After due consideration of all evidence presented, the Planning Commission did find as follows with respect to File No. S 94-07: o The proposed dwelling is well designed and is architecturally compatible with the surrounding area with the modifications indicated on the plans such as a new porch, mullioned windows and accent siding. The proposed project meets or exceeds the development standards of the R-l-9 Zoning District and the San Tomas Area Neighborhood Plan. The development of the property will result in a density of 3.3 units per gross acre consistent with permitted General Plan density of less than 4.5 units per gross acre shown for this area. The proposed landscaping of the site will greatly contribute to the quality of the development and enhance the neighborhood. Based upon the foregoing findings of fact, the Planning Commission further finds and concludes that: The proposed project is consistent with the General Plan and zoning, and o The proposed project will aid in the harmonious development of the immediate area. Resolution No. 2942 $ 94-07 - 1475 York Avenue Adopted on December 27, 1994 Page 2 Approval is effective ten days after decision of approval of the Planning Commission, unless an appeal is filed, subject to the following Conditions of Approval: o ge o o o o Approved Project: Approval is granted for a Site and Architectural Review Permit allowing a move on single family residence on property located at 1475 York Avenue. Project approval shall substantially comply with project plans prepared by Bruce Johnson dated December 20, 1994, except as modified by the Conditions of Approval herein. Fences: Submit a fencing plan indicating location and details of fencing to be approved by the Planning Director, prior to issuance of bUilding permits. Landscaping: Four copies of a landscaping plan indicating type and size of plant material, planting details and irrigation system for the front yard to be submitted to the Community Development Department prior to issuance of building permits. (Planning) Performance Bond: Applicant to either: 1) post a faithful performance bond in the amount of $5,000 for each property to ensure installation of landscaping, and fencing within three months of completing construction and prior to final occupancy; or 2) file a written agreement to complete landscaping, fencing and driveway areas prior to final occupancy. Parcel Map: Applicant shall file and/or complete the process for a parcel map application. (Public Works) Park Impact Fee: The applicant shall pay a park impact fee of $10,990 for each new single family residence prior to certificate of building occupancy. (Public Works) Storm Drain Area Fee: Pay a storm drain fee in the amount of 429.00 (0.2199 acres @ 1,950.00/acre) Grading and Drainage: Applicant shall submit three (3) copies of grading and drainage plans that show grading and drainage of the property toward the proposed public street right of way. Resolution No. 2942 S 94-07 - 1475 York Avenue Adopted on December 27, 1994 Page 3 Encroachment Permit: Submit application for encroachment permit(s), submit plans, post surety, and pay fees for work within the public right of way. 10. Property Maintenance: The property is to be maintained free of any combustible trash, debris and weeds, until the time that actual construction commences. All existing structures shall be secured by having windows boarded up and doors sealed shut, or be demolished or removed from the property (Section 11.201 & 11.414, 1985 Ed. Uniform Fire Code.) (Fire) 11. Underground Utilities: Underground utilities to be provided as required by Section 20.36.150 of the Campbell Municipal Code. (Public Works) 12. Parking and Driveways: All parking and driveway areas shall be developed in compliance with the standards in Chapter 21.50 of the Campbell Municipal Code. 13. Development Approval Expiration: The Site and Architectural approval for this project is valid for a period of one year a from the Planning Commission approval.
