BEING A RESOLUTION OF THE PLANNING COMMISSION OF
THE CITY OF CAMPBELL APPROVING A SITE AND
ARCHITECTURAL APPLICATION TO ALLOW A SINGLE-
FAMILY HOME ON PROPERTY LOCATED AT 1513 VAN DUSEN
LANE IN AN R-l-9 (SINGLE FAMILY RESIDENTIAL) ZONING
DISTRICT. APPLICATION OF MR. BRUCE JOHNSON, ON
BEHALF OF MR VERNON SUART. FILE NO. S 94-06.
After notification and Public Hearing as specified by law on the application of
Mr. Bruce Johnson, on behalf of Vernon Suart, for approval of plans allowing
a residential structure on property located at 1513 Van Dusen Lane; as per the
application filed in the Planning Department on November 2, 1994, and, after
presentation by the Community Development Director, proponents and
opponents, the hearing was closed.
After due consideration of ail evidence presented, the Planning Commission
did find as follows with respect to File No. S 94-06:
The proposed dwelling is well' designed and is architecturally compatible
with the surrounding area 'With the modifications indicated on the plans
such as a new dormer windoWs and mullioned windows.
The proposed project meets or exceeds the development standards of the
R-l-9 Zoning District and the San Tomas Area Neighborhood Plan.

The development of the property will result in a density of 2.6 units per
gross acre which is consistent with the General Plan density of less than
4.5 units per gross acre shown for this area.
The proposed landscaping of the site will greatly contribute to the quality
of the develOpment and enhance the neighborhood.
Based upon the foregoing findings o~ fact, the Planning Commission further
finds and concludes that:
The proposed project is consistent with the General Plan and zoning,
and
The proposed project will aid in the harmonious development of the
immediate area.

Approval is effective ten days after decision of approval of the Planning
Commission, unless an appeal is filed, subject to the following Conditions of
Approval:
Approved Proiect: Approval is granted for a Site and Architectural
Review Permit allowing a move on single family residence on property
located at 1513 Van Dusen Lane. Project approval shall substantially
comply with project plans prepared by Bruce Johnson dated December 20,
1994, except as modified by the Conditions of Approval herein.

Fences: Submit a fencing plan indicating location and details of fencing
to be approved by the Planning Director, prior to issuance of building
permits.

Landscaving: Four copies of a landscaping plan indicating type and size
of plant material, planting details and irrigation system for the front yard
to be submitted to the Community Development Department prior to
issuance of building permits. (Planning)

Performance Bond: Applicant to either: 1) post a faithful performance
bond in the amount of $5,000 for each property to ensure landscaping,
and fencing within three months of completing construction and prior
to final occupancy; or 2) file a written agreement to complete
landscaping, fencing and driveway areas prior to final occupancy.

Parcel Map: Applicant shall file and/or complete the processing of the
parcel map application. (Public Works)
Park Impact Fee: The applicant shall pay a park impact fee of $10,990 for
each new single family residence prior to certificate of building
occupancy. (Public Works)
Storm Drain Area Fee: Pay a storm drain fee in the amount of $510.00
(0.2615 acres @ 1,950.00/acre)

Grading and Drainage: Applicant shall submit three (3) copies of grading
and drainage plans that show grading and drainage of the property
toward the proposed public street right of way.

Encroachment Permit: Submit application for encroachment permit(s),
submit plans, post surety, and pay fees for work within the public right of
way.

Property Maintenance: The property is to be maintained free of any
combustible trash, debris and weeds, until the time that actual
construction commences. All existing structures shall be secured by
having windows boarded up and doors sealed shut, or be demolished or
removed from the property (Section 11.201 & 11.414, 1985 Ed. Uniform
Fire Code.) (Fire)
11. Underground Utilities: Underground utilities to be provided as required
by Section 20.36.150 of the Campbell Municipal Code. (Public Works)

Parking and Driveways: All parking and driveway areas shall be
developed in compliance with the standards in Chapter 21.50 of the
Campbell Municipal Code.
13.
Development Approval Expiration: The Site and Architectural approval
for this project is valid for a period of one year from the Planning
Commission approval.
