PC Res 3542 RESOLUTION NO. 3542 BEING A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CAMPBELL RECOMMENDING THAT THE CITY COUNCIL APPROVE A COMPREHENSIVE AMENDMENT TO THE CAMPBELL ZONING CODE (TITLE 21 OF THE MUNICIPAL CODE) INCLUDING THE TEXT AND DIAGRAM AMENDMENTS. After notification and public hearing as specified by law on the proposed amendments to the Zoning Code of the City of Campbell, and after presentation by the Community Development Director, proponents and opponents, the Planning Commission did determine that the adoption of a Comprehensive Amendment to the Zoning Code are warranted based upon the following findings: 1. The City of Campbell adopted a comprehensive General Plan Update in November 2001. 2. The General Plan Update contained numerous goals, policies and strategies that required new zoning ordinances to be enacted. 3. The Zoning Code is required by State law to be consistent with the General Plan. 4. The City Council authorized the Community Development Department to initiate the Zoning Code Update. 5. The Community Development Department has held City Council Study Sessions on September 16, 2003 and October 7, 2003 on the Zoning Code Update. 6. The Community Development Department has held 13 Planning Commission Study Sessions. 7. The proposed Zoning Code has been amended to include General Plan required changes. 8. The proposed Zoning Code has been amended to include Planning Commission requested changes. 9. The proposed Zoning Code has been amended to be easier to read and understand and has been made more user friendly through the inclusion of tables, diagrams and illustrations. 10. An Initial Study and Negative Declaration have been prepared pursuant to CEQA, and no significant environmental impacts have been identified. 11. The public hearing before the Planning Commission has been advertised at least 10 days in advance of the meeting in a local newspaper of general circulation. 12. This Zoning Code is enacted based on the authority vested in the City of Campbell by the State of California, including but not limited to: the State Constitution; the Planning and Zoning Law - . >.. , T' Planning Commission Resolution No. 3542 Approving a Comprehensive Amendment to the Zoning Code Page 2 (Government Code Sections 65000 et seq.); the Subdivision Map Act (Government Code Sections 66410 et seq.); and the California Health and Safety Code. Based upon the foregoing findings of fact, the Planning Commission further finds and concludes that: 1. The Zoning Code Update will provide a comprehensive, Zoning Code for the physical development of the City, consistent with the adopted General Plan of the City of Campbell. 2. The Zoning Code Update is internally consistent and compatible statement of regulations for the development of the City. 3. The Planning Commission of the City of Campbell recommends that the City Council approve a comprehensive amendment to the Zoning Code, including the text and diagram amendments as illustrated in the Zoning Code Update. 4. The Custodian of the Record for this Zoning Code Update and Mitigated Negative Declaration is the Community Development Department of the City of Campbell, located at 70 North First Street, Campbell, California. IT IS HEREBY RESOLVED that the Planning Commission of the City of Campbell recommends approval of a comprehensive amendment to the Zoning Code, including the text and diagram amendments as illustrated in the Zoning Code Update.
