PC Res 3564 RESOLUTION NO. 3564 BEING A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CAMPBELL APPROVING A SIGN PROGRAM (PLN2004-18) FOR PROPERTY OWNED BY LYNN A. BUZOLICH ET AL LOCATED AT 525 E. HAMILTON AVENUE IN A C-2-S (GENERAL COMMERCIAL) ZONING DISTRICT. APPLICATION OF MR. STEPHAN SCHMIDT, ON BEHALF OF THE BERGMAN COMPANIES. FILE NO. PLN2004-18. After notification and public hearing, as specified by law, and after presentation by the Community Development Director, proponents and opponents, the hearing was closed. After due consideration of all evidence presented, the Planning Commission did find as follows with respect to application PLN2004-18: 1. The height and area of the proposed signs, as conditioned, are necessary to provide identification of the site from the public streets and on site. 2. The applicant has demonstrated that the business operation is dependent upon the signage and that denial of said identification would cause an undue hardship. 3. The freestanding signs will be visible from Hamilton Avenue and A1marida Drive frontages. 4. Reducing the freestanding monument pylon sign to 14' -0" (fourteen feet) high will provide consistency with the Sign Ordinance and the other businesses fronting Hamilton Avenue. 5. Eliminating the wall sign facing the Highway 17 off-ramp will provide consistency with the Sign Ordinance and eliminate redundant signage. 6. The applicant has demonstrated that the signage is similar to other similarly situated businesses in the area. 7. The signage program will be of a consistent design throughout the project site and will help the public identify businesses on the site. 8. None of the proposed signs have flashing, moving or rotating parts or lights. 9. Sign illumination will be provided internally within sign cabinets. 10. The proposed signs, as conditioned, are architecturally compatible in design and consistent with the proposed project. Based on the foregoing findings of fact, the Planning Commission further finds and concludes that: Planning Commission Resolution No. 3564 PLN2004-18 - 525 E. Hamilton Avenue - Sign Program Page 2 1. The proposed signs will promote the economic viability of the City by providing adequate identification and visibility of the new businesses,. 2. The uses is of such size and is so located in reference to surrounding uses and the traffic circulation system that additional signage is warranted. 3. The signs will not be detrimental to the public welfare or persons in the neighborhood or the City as a whole NOW, THEREFORE, BE IT RESOLVED that the Planning Commission approves a Sign Program (PLN2004-18) for property owned by Lynn A. Buzolich et a1 located at 525 E. Hamilton Avenue in an C-2-S (General Commercial) Zoning District, subject to the following conditions: Where approval by the Director of Community Development, City Engineer, Public Works Director, City Attorney or Fire Department is required, that review shall be for compliance with all applicable conditions of approval, adopted policies and guidelines, ordinances, laws and regulations and accepted engineering practices for the item under review. Additionally, the applicant is hereby notified that he/she is required to comply with all applicable Codes or Ordinances of the City of Campbell and the State of California that pertain to this development and are not herein specified. COMMUNITY DEVELOPMENT DEPARTMENT Planning Division: 1. Approved Project: Approval is granted for one new freestanding sign and four new wall signs at 525 E. Hamilton Avenue. The signs shall substantially conform to the Sign Plan prepared by The Bergman Companies, dated as received by the Planning Division on April 8, 2004 except as may be modified by the Conditions of Approval herein. This sign program approval shall be valid only in conjunction with an approved Site and Architectural Review Permit. 2. Approval Expiration: The sign approval is valid for a period of one year from the date of final approval unless an extension is granted prior to the expiration date 3. Revised Plan: Applicant shall submit a revised Sign Package for review and approval by the Community Development Director, prior to submittal to the Building Division for permits. Revisions to include eliminating the freeway oriented wall sign on Building A, reducing the height of the Hamilton Avenue monument pylon sign to 14' -0", and reducing the height of the freeway oriented pylon sign to 50' -0". 4. Landscaping: The applicant shall submit a landscape plan for review and approval of the Community Development Director prior to submittal to the Building Division providing for the installation of foundation p1antings at the base of the freestanding signs to introduce planting materials to screen the base and support structures of the sign. Sign Maintenance: The property owner / applicant shall maintain the sign in a state of good condition. Deterioration of illumination and/or sign materials shall be removed or replaced within 30 days of notification by the Community Development Director. 6. Sign Modifications: Any text or copy modifications to the approved signs shall require review and approval by the Community Development Director.
