PC Res 3559 RESOLUTION NO. 3559 BEING A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CAMPBELL FINDING THE PROPOSED CAPITAL IMPROVEMENT PLAN 2004-2011 TO BE CONSISTENT WITH THE CITY'S GENERAL PLAN PURSUANT TO SECTION 65401 OF THE STATE OF CALIFORNIA GOVERNMENT CODE AND REOMMENDING THAT THE CITY COUNCIL FIND THE CIP PROJECTS TO BE CATEGORICALLY EXEMPT UNDER CEQA. After notification and public hearing, as specified by law, and after presentation by the Community Development Director, proponents and opponents, the hearing was closed. After due consideration of all evidence presented, the Planning Commission did find as follows with respect to the 2004/2011 CIP: 1. The proposed Capital Improvement Plan 2004-2011 is consistent with the City's General Plan and Redevelopment Plan, pursuant to Section 65401 of the State of California Government Code. 2. Recommend that the City Council find the CIP Projects to be Categorically Exempt under CEQA and that these projects will not have a significant effect on the environment due to their location, cumulative impact or unusual circumstances. Based upon the foregoing findings of fact, the Planning Commission further finds and concludes that: 1. The Capital Improvement Plan 2004-2011 is consistent with the General Plan. 2. No substantial evidence has been presented from which a reasonable argument could be made that the CIP projects would have a significant adverse impact on the environment. NOW, THEREFORE, BE IT RESOLVED that the Planning Commission finds the proposed Capital Improvement Plan to be consistent with the City's General Plan pursuant to Section 65401 ofthe State of California Government Code and recommending that the City Council find the CIP projects to be Categorically Exempt.
