PC Res 4112RESOLUTION NO. 4112 BEING A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CAMPBELL APPROVING A SIGN EXCEPTION AND MODIFICATION (PLN2013-145) OF AN EXISTING MASTER SIGN PLAN OF THE PRUNEYARD SHOPPING CENTER TO ALLOW FIVE WALL SIGNS/GRAPHICS FOR THE SPORTS BASEMENT (WITHIN A TENANT SPACE PREVIOUSLY OCCUPIED BY HOLLYWOOD VIDEO AND BARNES AND NOBLE) ON PROPERTY LOCATED AT 1875 S. BASCOM AVENUE, SUITE 240. After notification and public hearing, as specified by law and after presentation by the Community Development Director, proponents and opponents, the hearing was closed. After due consideration of all evidence presented, the Planning Commission did find as follows with respect to file number PLN2013-145: Environmental Finding 1. The project qualifies as an Exempt project under Section 15311, Class 11 of the California Environmental Quality Act (CEQA), pertaining to the construction or placement of on-premise signs. Evidentiary Findings 1. The Modification of the Master Sign Plan is consistent with the requirements of the Sign Ordinance in that the Planning Commission, in conjunction with approval language of the Master Sign Plan, has the authority to modify the Master Sign Plan to allow individual tenant signage an exception from strict compliance with the adopted Master Sign Plan upon re-evaluation at change of tenancy. 2. The proposed signage design complies with the intent of the Master Sign Plan in that the Master Sign Plan provides clear requirements for all new signage to be architecturally compatible with the design of not only the individual shopping center but also the specific tenant space. 3. The location of the proposed signs and the design of their visual elements (lettering, words, figures, colors, decorative motifs, spacing, and proportions) are legible under normal viewing conditions in that the size and placement of the proposed wall and tower signage is commensurate with the scale of the shopping center, providing adequate off-site visibility. Based on the foregoing findings of fact, the Planning Commission further finds and concludes that: 1. That the signs are consistent with the requirements of the original tenant space Sign Permits, as approved through the Master Sign Plan. Planning Commission Resolution No. 4112 PLN2013-145 - 1875 S. That the design complies with the design elements criteria listed in subsection 21.30.030(H)(2) of the Sign Ordinance as approved through the original Master Sign Plan. 3. That both the location of the proposed signs and the design of their visual elements (lettering, words, figures, colors, decorative motifs, spacing, and proportions) are legible under normal viewing conditions. 4. The signs otherwise allowed by the Sign Ordinance would not be visible to the public due to issues of distance or obstructions that are beyond the control of the owner of the site on which the signs are or would be located. 5. The signs could not be made visible and intelligible to a person of normal sight by allowing an increase in the area or height of the sign pursuant to the increased sign area or increased sign height exception process stated above. 6. The additional signs comply with all the requirements of the Sign Ordinance, except for the limitations on the number of signs and the increased in sign area. 7. The number of signs allowed pursuant to the this provision shall not exceed the minimum number of signs necessary to make the signs visible to the public due to issues of distance or obstructions that are beyond the control of the owner of the site on which the signs are or would be located, which could not be accomplished by the number of signs otherwise allowed. 8. That the location and design of the proposed signs do not obscure existing or adjacent signs from view. 9. The location and design of the proposed signs (e.g., size, shape, illumination, and color) are compatible with the visual characteristics of the surrounding area so as not to detract from or cause to decrease the value or quality of adjacent properties. 10. The location and design of signs in close proximity to any residential district does not adversely affect the quality or character of the residential area. 11. No substantial evidence has been presented from which a reasonable argument could be made that shows that the project, as currently presented and subject to the required Conditions of Approval, will have a significant adverse impact on the environment. 12. There is a reasonable relationship and a rough proportionality between the Conditions of Approval and the impacts of the project. THEREFORE, BE IT RESOLVED that the Planning Commission approves a Sign Exception and Modification (PLN2013-145) of an existing Master Sign Plan of the Pruneyard Shopping Center to allow five wall signs/graphics for The Sports Basement Planning Commission Resolution No. 4112 PLN2013-145 - 1875 S. Bascom Ave -Sign Exception & Modification -Sports Basement Page 3 (within a tenant space previously occupied by Hollywood Video and Barnes and Noble) on property located at 1875 S. Bascom Avenue, Suite 240. Where approval by the Director of Community Development, City Engineer, Public Works Director, City Attorney or Fire Department is required, that review shall be for compliance with all applicable conditions of approval, adopted policies and guidelines, ordinances, laws and regulations and accepted engineering practices for the item under review. Additionally, the applicant is hereby notified that he/she is required to comply with all applicable Codes or Ordinances of the City of Campbell and the State of California that pertain to this development and are not herein specified. COMMUNITY DEVELOPMENT DEPARTMENT Planning Division Approved Project: Approval is granted for a Sign Exception and Modification to a Previously Approved Master Sign Plan (PLN2013-145) exempting three walls signs and two tower signs associated with Suite 240 from the current sign regulations for the Pruneyard Shopping Center, located at 1875 S. Bascom Avenue. The project shall substantially conform to the Project Plans stamped as received by the Community Development Department on May 28, 2013, except as may be modified by the Conditions of Approval specified herein. 2. Sign Area: Sign 1 shall be limited to 191 square feet of sign area, inclusive of background. Signs 3 and 5 shall each be limited to 90 square feet in sign area, inclusive of background. Signs 2 and 4 shall each be limited to 66 square feet, inclusive of background. 3. Sign Maintenance: The signs shall be maintained in good condition at all times and shall be repaired or replaced as necessary. 4. Building Permits Required: The applicant shall obtain all necessary building and/or electrical permits from the Building Division prior to the installation of any new signs.
