PC Res 2840RESOLUTION NO. 2840 BEING A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CAMPBELL APPROVING A MODIFICATION TO A SIDEYARD SETBACK TO ALLOW THE CONSTRUCTION OF A SECOND STORY ADDITION ON PROPERTY LOCATED AT 1719 PALO SANTO DRIVE, IN AN R-l-6 (SINGLE- FAMILY RESIDENTIAL) ZONING DISTRICT. FILE NO. M 93-01 After notification and public hearing as specified by law on the application of Mr. Guy Denues, on behalf of Mr. Steve Watson, for approval of a modification to a sideyard setback to allow the construction of a second story addition on property located at 1719 Palo Santo Drive, in an R-l-6 (Single- Family Residential) Zoning District, as per the application filed in the Planning Department on January 7, 1993; and, after presentation by the City Staff, proponents and opponents, the hearing was closed. After due consideration of all evidence presented, the Planning Commission finds as follows with regard to Application No. M 93-01: The proposed addition is well integrated and incorporates building materials that are consistent with the existing dwelling. The proposed addition meets the intent of the Zoning Ordinance allowing a five foot side yard setback for second story additions. 3. The adjacent neighbors are supportive of the proposal. Based upon the foregoing findings of fact, the Planning Commission finds and concludes that: That the said side yard will not be detrimental to the health, safety, peace, comfort, or general welfare of persons in the neighborhood or the City as a whole, and That said side yard will not unreasonably interfere with the ability of adjoining property owners who enjoy access to sunlight, air, privacy, and quiet enjoyment of such owner's property. Approval is effective ten days after decision of approval of the Planning Commission, unless an appeal is filed. The applicant is notified as part of this application that he is required to comply with the following Conditions of Approval: Resolution No. 2840 M 93-01 -- 1719 Palo Santo Drive -- G. Denues Adopted on February 9, 1993 Page 2 MODIFICATION APPROVAL 1. Approved Project: The approval is granted for a minor modification to the side yard setback requirement allowing a second story addition with a 6 foot side yard setback to the southern property line. SITE AND BUILDING DESIGN 2. Approved Plans: Approval of the minor modification allows a 687 square foot second story addition. The property is identified as Assessor's Parcel Number 307-08-037. A. Project drawings for the addition consist of 2 sheets prepared by Guy Denues, Architect dated December 22, 1992. BUILDING CODE 3. Building Permits: Obtain all necessary building permits prior to construction. All interior portions of the garage (walls and ceiling) to be covered with 5/8" x gypsum per UBC 503(d). Further, the applicant is notified as part of this application that he is required to comply with all applicable Codes and Ordinances of the City of Campbell and the State of California which pertain to this development and are not herein specified.
