PC Res 3571 RESOLUTION NO. 3571 BEING A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CAMPBELL RECOMMMENDING APPROV AL OF A ZONE CHANGE (PLN2004-53) FROM C-PD (CONDOMINIUM/PLANNED DEVELOPMENT) TO R-1-6 (SINGLE FAMILY RESIDENTIAL, 6,000 SQUARE FOOT MINIMUM LOT SIZE) ZONING DISTRICT ON PROPERTY OWNED BY DOUGLAS AND GINA SCHEIDT LOCATED AT 236 N. CENTRAL AVENUE IN A C-PD (CONDOMINIUM/PLANNED DEVELOPMENT) ZONING DISTRICT. APPLICATION OF MS MEREDITH LINDEM, ON BEHALF OF DOUGLAS AND GINA SCHEIDT. FILE NO.: PLN2004-53. After notification and public hearing, as specified by law, and after presentation by the Community Development Director, proponents and opponents, the hearing was closed. After due consideration of all evidence presented, the Planning Commission did find as follows with respect to application PLN2004-53: 1. The project site is an 11,252 square foot residential lot and is located on the east side of North Central Avenue near its intersection with West Latimer Avenue. 2. The proposed R-1-6 (Single-family Residential, 6,000 square foot minimum lot size) zoning classification is consistent with the proposed General Plan Land Use Designation of Low Density Residential, less than 6 units per gross acre for the project site. 3. The proposed zoning classification change is consistent with classification of surrounding properties to the north, west and east ofthe project site. 4. The proposed zoning is consistent with the Land Use Element of the General Plan. Based upon the foregoing findings of fact, the Planning Commission further finds and concludes that: 1. The proposed zoning classification will clearly result in a more desirable environment and use of the land than would be possible under any other zoning classification. 2. The development and uses will be compatible with the General Plan of the City and will aid in the harmonious development of the immediate area. 3. The proposed development will not result in allowing more residential units than would be allowed by other residential zoning districts which are consistent with the recommended General Plan land use designation of the property. 4. The proposed zoning classification change will not be detrimental to the health, safety or welfare ofthe neighborhood or the City as a whole. 5. No substantial evidence has been presented from which a reasonable argument could be made that shows that the project, as currently presented and subject to the required Conditions of Approval, will have a significant adverse impact on the environment. Central Avenue - Zone Change from C-PD to R-I-6 Page 2 NOW, THEREFORE, BE IT RESOLVED that the Planning Commission recommends approval of a Zone Change (PLN2004-53) from C-PD (Condominium/Planned Development) to R-1-6 (Single Family Residential, 6,000 square foot minimum lot size) Zoning District on property owned by Douglas and Gina Scheidt located at 236 N. Central Avenue in a C-PD (Condominium/Planned Development) Zoning District.
