A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CAMPBELL
APPROVING PLANS AND SPECIFICATIONS, AUTHORIZING SOLICITATION
OF BIDS, AUTHORIZING THE PUBLIC WORKS DIRECTOR TO AWARD A
CONSTRUCTION CONTRACT, AUTHORIZING THE CITY ENGINEER TO EXECUTE
CONTRACT CHANGE ORDERS, AUTHORIZING THE PUBLIC WORKS DIRECTOR
TO EXECUTE AN AMENDMENT TO THE CONSULTANT SERVICES AGREEMENT,
AND AUTHORIZING THE PUBLIC WORKS DIRECTOR TO EXECUTE A
MAINTENANCE AGREEMENT FOR THE EAST CAMPBELL AVENUE PORTALS
PROJECT 11-EE AND APPROVING A BUDGET ADJUSTMENT
WHEREAS, the City Council adopted a resolution on July 16, 2013, assuring the Santa
Clara Valley Transportation Authority (VTA) and Metropolitan Transportation
Commission (MTC) that the City of Campbell will complete the East Campbell Avenue
Portals Project 11-EE under the MTC's One Bay Area Grant (OBAG) Program; and
WHEREAS, the project is included in the City's adopted Capital Improvement Plan; and
WHEREAS, final plans and specifications have been prepared for the project; and
WHEREAS, Caltrans must provide clearance prior to the City advertising the project for
bids; and
WHEREAS, additional consultant services are necessary during the project's bid,
award, and construction phase; and
WHEREAS, Caltrans requires a maintenance agreement be executed to obligate the
City to maintain and operate the improvements installed for the East Campbell Avenue
Portals Project; and
WHEREAS, Transportation Development Act FY 11/12 funds of $19,552 were
previously allocated to the project.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Campbell
hereby:
1. Approve the plans, specifications, and estimates for the East Campbell Avenue
Portals Project 11-EE;
2. Authorize the Public Works Director to execute an amendment to the Consultant
Services Agreement with Biggs Cardosa Associates for bid, award, and
construction engineering services in an amount not to exceed $311,500;
3. Authorize the solicitation of bids upon clearance from Caltrans;
4. Authorize the Public Works Director to determine the lowest reasonable and
responsible bidder and to award and execute a construction contract in an
amount not to exceed $3,250,000 and encumber a construction contingency in

an amount not to exceed $487,500 for a total encumbrance not to exceed
$3,737,500;
5. Authorize the City Engineer to negotiate and execute contract change orders up
to and within the allocated contingency;
6. Authorize the Public Works Director to enter into a maintenance agreement with
Caltrans for the maintenance and operation of the East Campbell Avenue Portals
and associated facilities within the Caltrans right of way; and
7. Approve a budget adjustment of $19,552 of TDA funding.
