Ail proposed facilities shall be of consistent materials, finish and color (except where otherwise agreed; existing cabinets will be painted to match paired Lightspeed cabinet). Pedestal numbering shall be consistent and as inconspicuous as possible. New Lightspeed cabinets shall have an anti-graffiti finish. 3. Plans shall be accurately dimensioned, clearly showing the proposed location, size, and shape of all existing and proposed facilities, including all existing and proposed right-of--way sines and anv existing or proposed easements. 4. Applicant shall submit photos of the proposed location both pre-construction and post construction (with proposed structure(s) and all related service pedestals, bollards, landscaping, screening, etc. shown). 5. Plans shall reflect that the following guidelines whenever possible. The proposed facilities should be: a. located outside of any future sidewalk area b. located outside and beyond the back of walk (existing or future) wherever possible, with a minimum clearance of 18" from the SFdeVValk c. in park strip locations (only considered if beyond the back of walk location is not feasible), located with a minimum clearance of 18" from the face of curb to any part of the facility (if bollards are proposed, bollards must be located a minimum of 18" from face of curb), and a minimum of 18" from existing sidewalk d. in sidewalk locations (only considered if beyond the back of walk locations are not feasible), located to accommodate the required ADA specifications, with no less than a 4' clear path around the proposed facilities and with a minimum clearance of 18" from the face of curb to any part of the proposed facility (including bollards) e. located 5' from any existing public improvements such as, trees (tree wells if applicable), light poles, sign poles, etc. f. located with adequate clearance from existing fire hydrants g. located with adequate line of sight clearances G. All contractors working under the permit shall have a valid City business license. 7. Applicant shall obtain approval from other agencies (Caltrans, Santa Clara Valley Water District, VTA, etc.) as needed. 8. After the City has reviewed and conditionally approved each permit location, the applicant shall proceed with the public%property owner notification process as follows: a. Following the City's preliminary approval of a site, AT&T shall mail a preliminary notice to all propetty owners that are adjacent to, or abut, the proposed location„ as well as to those across the street from the location. in somc cases, the City may request notifications be sent to additional properties or parties. The preliminary notice, which shall be approved by the City prior to mailing, shall be mailed to the property owners, with a copy to the City, not less than four (4) weeks prior to anticipated construction date, and shall give the property owner a two (2) week period in which to respond with questions or concerns. Should the notified property owner have concerns regarding the location of the facilities, AT&T shall work with the property owner(s) toward a mutually acceptable location. b. AT&T shall provide a final notice to the property owners at least 48 hours before the commencement of the proposed construction. I. Applicant shall ensure that all property owner notifications have been completed prior to construction. 10. AT&T agrees to maintain the facilities in an attractive and clean manner. AT&:T will make commercially reasonable efforts to remove graffiti within 48 hours of notification that the facilities have been tagged. AT&T shall provide the City with contact information for graffiti removal. 11. The City of Campbell will bill AT&T if its contractor leaves any site in such a manner requiring City forces to mobilize and mediate an unsafe situation. 1'?. If and only to the extent required by State or federal law, should a public project arise that requires the relocation of existing facilities, the facilities shall be removedireiocated to accommodate the scope, alignment and schedule of the public project. in accordance with state or federal legal or regulatory requirements. 1 ~. As required by State statues, and unless otherwise preempted by State or Federal Law, abandoned facilities shall be completely removed from the site and the sne restored to its origmai condition. ] 4. The parties agree to fully reserve their rights as to the applicability and interpretations of California Public Utilities Code Section 7901 and other related local, state or federal laws, and the City reserves the right to contend that future permits will not be issued without AT&T obtaining a franchise or other agreement price to providing video services, and ATR.T reserves it's right to contend that City is required to issue the encroachment permits without first obtaining such franchise or agreement. A Construction Cash Deposit is required. Chazges will be made against this deposit if there is an emergency call-out, overtime inspection or when Ciry ordered barricading is required. Any such costs in excess of the deposit will be billed to the Permittee. 2. A one-year maintenance period and surety are required. Such period will begin on date of written acceptance by the City. 3. All proposed facilities shall be of consistent materials, finish and color (except where otherwise agreed, existing cabinets will be painted to match paired Lightspeed cabinet). Pedestal numbering shall be consistent and as inconspicuous as possible. New Lightspeed cabinets shall have an anti-graffiti finish. 3. Plans shall be accurately dimensioned, clearly showing the proposed location, size, and shape of all existing and proposed facilities, including all existing and proposed right-of--way lines and anv existing or proposed easements. 4. Applicant shall submit photos of the proposed location both pre-construction and post construction (with proposed structure(s) and all related service pedestals, bollards, landscaping, screening, etc. shown). 5. Plans shall reflect that the following guidelines whenever possible. The proposed facilities should be: a. located outside of any future sidewalk area b. located outside and beyond the back of walk (existing or future) wherever possible, with a minimum clearance of ] 8" from the sidewalk c. in park strip locations (only considered if beyond the back of walk location is not feasible), located with a minimum clearance of 18" from the face of curb to any part of the facility (if bollards are proposed, bollards must be located a minimum of 18" from face of curb), and a minimum of 1 S" from existing sidewalk d. in sidewalk locations (only considered if beyond the back of walk locations are not feasible), located to accommodate the required ADA specifications, with no less than a 4' clear path around the proposed facilities and with a minimum clearance of 18" from the face of curb to any part of the proposed facility (including bollards) e. located 5' from any existing public improvements such as, trees (tree wells if applicable), light poles, sign poles, etc. f. located with adequate clearance from existing fire hydrants g. located with adequate line of sight clearances 6. All contractors working under the permit shall have a valid City business license. 7. Applicant shall obtain approval from other agencies (Caltrans, Santa Clara Valley Water District, VTA, etc.) as needed. 8. After the City has reviewed and conditionally approved each permit location, the applicant shall proceed with the publiciproperty owner notification process as follows: a. Following the City's preliminary approval of a site, AT&T shalt mail a preliminary notice to all property owners that are adjacent to, or abut, the proposed location, as well as to those across the street from the location. in some cases, the City may request notifications be sent to additional properties or parties. The preliminary notice, which shall be approved by the City prior to mailing, shall be mailed to the property owners, with a copy to the City, not less than four (4) weeks prior to anticipated construction date, and shall give the property owner a two (2) week period in which to respond with questions or concerns. Should the notified property owner have concerns regarding the location of the facilities, AT&T shall work with the property owner(s) toward a mutually acceptable location. b. AT&T shall provide a final notice to the property owners at least 48 hours before the commencement of the proposed construction. 9. Applicant shall ensure that all property owner notifications have been completed prior to construction. 10. AT&T agrees to maintain the facilities in an attractive and clean manner. AT&T will make commercially reasonable efforts to remove graffiti within 48 hours of notification that the facilities have been tagged. AT&T shall provide the City with contact information for graffiti removal. 1 1. The City of Campbell will bill AT&T if its contractor leaves any site in such a manner requiring City forces to mobilize and mediate an unsafe situation. L. If and only to the extent required by State or federal law, should a public project arise that requires the relocation of existing facilities, the facilities shall be removedireiocated to accommodate the scope, alignment and schedule of the public project, in accordance with state or federal legal or regulatory requirements. I?. As required by State statues, and unless otherwise preempted by State or Federal Law, abandoned facilities shall be completely removed from the site and the siie restored to its ongmai condition. ] 4. The parties agree to fully reserve their rights as to the applicability and interpretations of California Public Utilities Code Section 7901 and other related local, state or federal laws, and the City reserves the right to contend that future permits will not be issued without AT&T obtaining a franchise or other agreement prior tc providing video services, and AT&T reserves ii's right to contend that City is required to issue the encroachment permits without first obtaining such franchise or agreement.
