PC Res 2846RESOLUTION NO. 2846 BEING A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CAMPBELL APPROVING A MODIFICATION TO A PREVIOUSLY APPROVED USE PERMIT AND EXTENSION OF APPROVAL TO ALLOW THE REMODEL OF AN EXISTING GAS STATION ON PROPERTY LOCATED AT 370 E. HAMILTON AVENUE, IN AN C-1-S (NEIGHBORHOOD COMMERCIAL) ZONING DISTRICT. FILE NO. M 93-03 After notification and public hearing as specified by law on the application of Mr. Robert Lee, on behalf of Coast Oil Stations, Inc., for approval of a modification to a previously approved Use Permit and extension of approval to allow the remodel of an existing gas station on property located at 370 E. Hamilton Avenue, in an C-1-S (Neighborhood Commercial) Zoning District, as per the application filed in the Planning Department on February 12, 1993; and, after presentation by the City Staff, proponents and opponents, the hearing was closed. After due consideration of all evidence presented, the Planning Commission finds as follows with regard to Application No. M 93-03: There have been no changes in the General Plan or Zoning since the previous approval. 2. Substantial landscaping will enhance the appearance of the site, and ge The modifications to the previous approval requested by the applicant will improve the design of the proposed mini-mart and will increase the amount of on-site landscaping. Based upon the foregoing findings of fact, the Planning Commission further finds and concludes that: The proposed project, subject to the conditions imposed, will be consistent with the General Plan and Zoning Ordinances of the City. 2. The proposed use is compatible with the uses in the area. The proposed project, subject to the required conditions, will aid in the harmonious development of the immediate area. The establishment, maintenance, or operation of the use applied for will not be detrimental to the public health, safety, peace, morals, comfort or Resolution No. 2846 M 93-03 - 370 E. Lee Adopted on April 13, 1993 Page 2 general welfare of persons residing or working in the neighborhood of such proposed use, or be detrimental or injurious to property and improvements in the neighborhood or the general welfare of the City. The proposed site is adequate in size and shape to accommodate the yards, walls, fences, parking and loading facilities, landscaping and other development features required in order to integrate said use with uses in the surrounding area. The proposed use is adequately served by the streets of sufficient capacity to carry the kind and quantity of traffic such use would generate. Approval is effective ten days after decision of approval of the Planning Commission, unless an appeal is filed. The applicant is notified as part of this application that he is required to comply with the following Conditions of Approval: 1. Approved Plans: This approval is a remodel of an existing service station and installation of a new mini-mart on a 17,900 square foot parcel identified as Assessor's Parcel Number 279-34-029. Development shall be substantially as shown on the project materials listed below, except as may be modified by conditions contained herein: a. Project drawings for Coast Oil Company prepared by Jim Mitchell & Associates, consisting of five sheets, dated February 10, 1992. Revised Plans/Elevations; The applicant shall revise plans/elevations indicating the following: a. Provide a second exit door from the retail building, if required by the Building Department. b. Provide a sight obscuring material for the trash and mechanical equipment enclosure. c. Provide a raised brick planter near the entry of the mini-mart building. o Landscaping Plan: Landscaping plan indicating type and size of plant material, and located irrigation system to be submitted to the Planning Department and approved by the Site and Architectural Review Committee prior to issuance of a building permit. (Planning) o Fencing: Fencing plan shall be submitted to the Planning Department and approved by the Planning Director prior to the issuance of a building permit. Fencing material shall be black vinyl chain link with painted post. o Equipment Screening: All mechanical and trash enclosures shall be screened with a sight obscuring material, as indicated on the red lined plans. o Garbage Disposal: Ordinance No. 782 of the Campbell Municipal Code stipulates that any contract for the collection and disposal of refuse, garbage, wet garbage and rubbish produced within the limits of the City of Campbell shall be made with Green Valley Disposal Company. This requirement applies to all single family dwellings, multiple apartment units, to all commercial, business, industrial, manufacturing, and construction establishments. Property Maintenance: The applicant is hereby notified that the property is to be maintained free of any combustible trash, debris and weeds, until the time that actual improvements take place. o Parking and Driveway Areas: All parking and driveway areas to be developed in compliance with Chapter 21.50 of the Campbell Municipal Code. All parking spaces to be provided with appropriate concrete curbs or bumper guards. Hours of Operation: following: Monday - Saturday Sunday Hours of operation shall 6:00 a.m. - 11:00 p.m. 7:00 a.m. - 11:00 p.m. be limited to the 10. Signage: The applicant shall be permitted the following signs: a. 8 ft. x 8 ft. monument sign (64 sq. ft. total height) b. One building sign 3'6" x 8'6". Sign shall be located on the building elevations as indicated on the approved plans, dated February 10, 1992. 11. Use Permit: Beer and wine sales shall be limited to off-site only. The sale of beer and wine for on-site consumption is prohibited. BUILDING DIVISION 12. Obtain all necessary building permits and clearances. FIRE DEPARTMENT 13. PUBLIC WORKS DEPARTMENT 14. Driveways: Show the existing driveway to be removed on the site plan. Submit plans, pay fees, post surety, and obtain an encroachment permit for this work in the public right-of-way. 15. Site Plan Details: Show the distance from the fronting property lines to the street centerlines on the site plan. Also show the existing electroliers, traffic signal poles, street signs, tree wells, and other public improvements on the frontage of this property. 16. Grading and Drainage Plans: Submit three copies of a grading and drainage plan to the Building Division for review. Further, the applicant is notified as part of this application that he is required to comply with all applicable Codes and Ordinances of the City of Campbell and the State of California which pertain to this development and are not herein specified.
