PC Res 2847RESOLUTION NO. 2847 BEING A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CAMPBELL DETERMINING THAT A PHOTO COPYING AND DESK TOP PUBLISHING CENTER IS A USE SIMILAR TO OTHER USES PERMITTED IN THE C-1-S (NEIGHBORHOOD COMMERCIAL) ZONING DISTRICT, PURSUANT TO SECTION 21.59.070 OF THE CAMPBELL MUNICIPAL. After notification and hearing as specified by law on the City-initiated application for determination that a photo copying and desk top publishing center is a use similar to other uses permitted in the C-1-S (Neighborhood Commercial) Zoning District and, after presentation by the City Staff, proponents and opponents, the hearing was closed. After due consideration of all evidence presented, the Planning Commission finds as follows: A copy center use is similar to other service retail uses permitted in the C- 1-S Zoning District. o A copy center is similar in intensity to other uses permitted in the C-1-S Zoning District, and o Permitting a copy center in the C-1-S (Neighborhood Commercial) Zoning District is in keeping with the intent and purposes of that district. Based upon the foregoing findings of fact, the Planning Commission further finds and concludes that: The establishment, maintenance, or operation of a copy center use in the C-1-S Zoning District will not be detrimental to the public health, safety, peace, morals, comfort or general welfare of persons residing or working in the neighborhood of such proposed use, or be detrimental or injurious to property and improvements in the neighborhood or to the general welfare of the City. o A copy center use is compatible with the uses allowed in the Neighborhood Commercial Zoning District. o A copy center use would be compatible with the General Plan of the City and will aid in the harmonious development of the immediate area. Resolution No. 2847 C-1-S -- Planning Commission determination -- City-Initiated Adopted on April 13, 1993 Page 2 Approval is effective ten days after decision of approval of the Planning Commission, unless an appeal is filed. Further, the applicant is notified as part of this application that he is required to comply with all applicable Codes and Ordinances for the City of Campbell and the State of California which pertain to this determination and are not herein specified.
