PC Res 2851RESOLUTION NO. 2851 BEING A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CAMPBELL APPROVING A CONDITIONAL USE PERMIT TO ALLOW THE ESTABLISHMENT OF A BILLIARD PARLOR AND SEMI ARCADE WITHOUT ALCOHOL SALES IN AN EXISTING COMMERCIAL BUILDING ON PROPERTY LOCATED AT 1777 S. BASCOM AVENUE IN A C-2-S (GENERAL COMMERCIAL) ZONING DISTRICT. FILE NO. UP 93-04 After notification and public hearing as specified by law on the application of Mr. Paul Namkoong for approval of a Conditional Use Permit to allow the establishment of a billiard parlor and semi arcade without alcohol sales in an existing commercial building on property located at 1777 S. Bascom Avenue in a C-2-S (General Commercial) Zoning District, as per the application filed in the Planning Department on March 12, 1993; and, after presentation by the City Staff, proponents and opponents, the hearing was closed. After due consideration of all evidence presented, the Planning Commission finds as follows with regard to File No. UP 93-04: The proposed billiard parlor is a permitted use in the C-2-S Zoning District subject to approval of a Conditional Use Permit. Establishment of a billiard parlor at this location will not be detrimental to surrounding uses or uses within the general vicinity. o The proposed site adequately provides on-site improvements of parking, landscaping and building improvements to support the proposed use. The project is adequately served to by public streets to address the traffic and circulation needs of the proposed use. The proposed use does not represent a concentration of commercial entertainment uses in this area and is a use compatible to surrounding commercial uses. Based upon the foregoing findings of fact, the Planning Commission further finds and concludes that: The establishment, maintenance, or operation of the use applied for will not be detrimental to the public health, safety, peace, morals, comfort or general welfare of persons residing or working in the neighborhood of such proposed use, or be detrimental or injurious to property and improvements in the neighborhood or to the general welfare of the City. Namkoong Adopted on May 11, 1993 Page 2 The proposed site is adequate in size and shape to accommodate the yards, wall, fences, parking and loading facilities, landscaping and other development features required in order to integrate said use with uses in the surrounding area. o The proposed site is adequately served by streets of sufficient capacity to carry the kind and quantity of traffic such use would generate. 4. The proposed use is compatible with the uses in the area. Approval is effective ten days after decision of approval of the Planning Commission, unless an appeal is filed. The applicant is notified as part of this application that he is required to comply with the following Conditions of Approval: USE PERMIT Permitted Use: Conditional Use Permit approval is granted to allow a billiard parlor and semi-arcade of approximately 6,200 square feet in a portion of an existing commercial building located at 1777 South Bascom Avenue. The approved use shall substantially comply with the applicant's project description received April 26, 1993, and with the following characteristics: a. Hours of operation: 10:00 a.m. to 2:00 a.m., daily b. No alcoholic beverages. c. A maximum of 21 pool tables. (Planning) Applicant to obtain a Pool Parlor Permit from the Campbell Police Department. (Police) o Applicant to secure any necessary building or electrical, or mechanical permits. BUILDING DIVISION 4. Occupancy change to A-3 from B-2. 5. Need area ratio calculation for building. 6. A manual fire alarm system is required. 8. The automatic fire extinguishing system shall be modified to accommodate any changes. Exit hardware, signs, and corridor shall be provided to meet the minimum requirements of assembly occupancy. Further, the applicant is notified as part of this application that he is required to comply with all applicable Codes and Ordinances of the City of Campbell and the State of California which pertain to this development and are not herein specified.
