PC Res 4158RESOLUTION NO. 4158 BEING A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CAMPBELL APPROVING A MODIFICATION (PLN2014-126) TO A PREVIOUSLY APPROVED MASTER SIGN PLAN WITH A SIGN EXCEPTION FOR THE SAFEWAY FUELING STATION ON PROPERTY LOCATED AT 950 W. HAMILTON AVENUE. After notification and public hearing, as specified by law and after presentation by the Community Development Director, proponents and opponents, the hearing was closed. After due consideration of all evidence presented, the Planning Commission did find as follows with respect to file numbers PLN2014-126: 1. The project site is the Safeway Shopping Center located at the southwest corner of Hamilton Avenue and Marathon Drive. 2. On November 9, 2010, the Planning Commission adopted Resolution No. 4001 approving a Master Sign Plan for the Safeway Shopping Center that allowed for three free-standing monument signs, multiple wall and canopy-mounted signs, and refueling station canopy signage. The Conditions of Approval for the Master Sign Plan indicate that any sign inconsistent with the approval shall require approval of both a Sign Exception and a Modification to the Master Sign Plan. 3. The proposed project is a request to allow modification of the existing fueling sign to accommodate two sets of price modules, one for cash/debit purchases and another for credit card purchases in compliance with State law that requires such separate pricing. Although the overall square-footage of the sign (32 square-feet) is not changing, the area of the sign allotted to pricing would increase from 13.75 square- feet to 18 square-feet. 4. Consistent with Planning Commission Resolution No. 4001, the proposed modification to the existing fueling sign requires approval of both a Sign Exception and a Modification to the Master Sign Plan. 5. All other elements of the approved MSP and associated Conditions of Approval shall remain in effect. Based on the foregoing findings of fact, the Planning Commission further finds and concludes that: 1. That the signs are consistent with the requirements of this chapter. 2. That the design complies with the design elements criteria listed in subsection (H)(2) of this section. Planning Commission Resolution No. 4158 PLN2014-126 - 950 W. That both the location of the proposed signs and the design of their visual elements (lettering, words, figures, colors, decorative motifs, spacing, and proportions) are legible under normal viewing conditions. 4. That the location and design of the proposed signs do not obscure existing or adjacent signs from view. 5. The signs otherwise allowed by this chapter would not be visible to the public due to issues of distance or obstructions that are beyond the control of the owner of the site on which the signs are or would be located. 6. Allowable signage does not exceed forty-five feet in height or three hundred fifty square feet in area. 7. No sign shall be increased in size or height more than is necessary to allow the signs to be visible and intelligible to a person of normal sight; 8. The signs could not be made visible and intelligible to a person of normal sight by allowing an increase in the area or height of the sign pursuant to subsection (C) (4), (Increased sign area or increased sign height) of this section. 9. The additional signs comply with all the requirements of this chapter, except for the limitations on the number of signs. 10. The number of signs allowed pursuant to this provision shall not exceed the minimum number of signs necessary to make the signs visible to the public due to issues of distance or obstructions that are beyond the control of the owner of the site on which the signs are or would be located, which could not be accomplished by the number of signs otherwise allowed by this chapter. 11. The location and design of the proposed signs (e.g., size, shape, illumination, and color) are compatible with the visual characteristics of the surrounding area so as not to detract from or cause to decrease the value or quality of adjacent properties. 12. The location and design of signs in close proximity to any residential district does not adversely affect the quality or character of the residential area. THEREFORE, BE IT RESOLVED that the Planning Commission approves a Modification (PLN2014-126) to a previously approved Master Sign Plan with a Sign Exception for the Safeway fueling station on property located at 950 W. Hamilton Avenue. Where approval by the Director of Community Development, City Engineer, Public Works Director, City Attorney or Fire Department is required, that review shall be for compliance with all applicable conditions of approval, adopted policies and guidelines, ordinances, Planning Commission Resolution No. 4158 PLN2014-126 - 950 W. Hamilton Avenue Modification Permit to Master Sign Plan with a Sign Exception Page 3 laws and regulations and accepted engineering practices for the item under review. Additionally, the applicant is hereby notified that he/she is required to comply with all applicable Codes or Ordinances of the City of Campbell and the State of California that pertain to this development and are not herein specified. COMMUNITY DEVELOPMENT DEPARTMENT Planning Division Approved Project: Approval is granted for a Master Sign Plan and Sign Exception (PLN2014-126) to allow for a new Master Sign Plan, as modified herein, for the Safeway Shopping Center located at 950 W. Hamilton Avenue. Approval of the Master Sign Plan shall not be valid until a Final Master Sign Plan, incorporating the required changes reflected within the Conditions of Approval specified herein, has been submitted for review and approval by the Community Development Director. 2. Previous Conditions of Approval: Upon the effective date of this Resolution, the previously approved Conditions of Approval provided in Planning Commission Resolution No. 4001 shall be void and shall permanently be superseded in their entirety by the Conditions of Approval specified herein. 3. Monument Signage: The proposed monument signs shall be located on the project site, completely on private property, and located outside of a 10 foot site visibility triangle adjacent to all driveway approaches. The fueling price monument sign may be modified to incorporate separate pricing modules for cash/debit and credit card purchases as depicted on Sign Plans dated as received by the Planning Division on May 2, 2014 and incorporated herein into the approved Master Sign Plan. Neither the overall size nor the material composition of the monument sign shall be modified. 4. Pad Building Signage: The applicant shall submit a revised Master Sign Plan for review and approval of the Community Development Director showing the elimination of the west elevation signage of the proposed pad building and the installation of a new monument sign that is consistent in design, style, height and sign area with the approved fuel station price monument sign. The proposed monument sign shall be installed completely on private property and shall not impact both pedestrian and vehicle travel or visibility at any driveway approach. In addition, businesses located within the pad building may be allowed up to two signs two per business located along the north and south elevations with a maximum sign area of one square foot of sign area for every linear foot of business frontage (the frontage on which the sign shall be placed) up to a maximum of 50 square feet in total signage for the north and south elevations and no signage allowed on the east and west elevations. The applicant shall submit a revised Master Sign Plan showing the installation of the new monument sign for use by the pad building only for review and approval of the Community Development Director. Fuel Canopy Signage: The applicant shall revise the Master Sign Plan, reducing the allowable square footage for the north elevation fuel canopy sign to a maximum of 50 square feet in sign area. The proposed east elevation canopy sign shall remain at 63.4 square feet in area. 6. Sign Permit Required: All signs permitted under the Master Sign Plan shall require a Sign Permit prior to installation. 7. Sign Exception: Any sign inconsistent with the approved Master Sign Plan shall require approval of both a Sign Exception and a Modification to the Master Sign Plan. 8. Sign Maintenance: The signs shall be maintained in good condition at all times and shall be repaired or replaced as necessary. 9. Building Permits Required: The applicant shall obtain all necessary building and/or electrical permits from the Building Division prior to the installation of any new signs.
