PC Res 4163RESOLUTION N0.4163 BEING A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CAMPBELL RECOMMENDING THAT THE CITY COUNCIL APPROVE A NEGATIVE DECLARATION AND ADOPT AN ORDINANCE APPROVING A ZONING TEXT AMENDMENT (PLN2014-165) INVOLVING REVISIONS TO THE CITY'S REQUIREMENTS FOR EMERGENCY SHELTERS, TRANSITIONAL HOUSING AND SUPPORTIVE HOUSING IN CONFORMANCE WITH SENATE BILL 2 (LOCAL PLANNING APPROVAL FOR EMERGENCY SHELTERS AND TRANSITIONAL AND SUPPORTIVE HOUSING); MANUFACTURED HOUSING; SINGLE ROOM OCCUPANCY FACILITIES; AND UPDATES TO DEFINITIONS IN ACCORDANCE WITH THE CITY'S 2009-2014 HOUSING ELEMENT OF THE GENERAL PLAN. THE REVISIONS AFFECT CHAPTER 21.08 (RESIDENTIAL DISTRICTS); SECTION 21.10.080 (M-1) LIGHT INDUSTRIAL ZONING DISTRICT; SECTIONS 21.36.085 AND21.36.230; AND SECTION 21.72.020 (DEFINITIONS) OF THE ZONING ORDINANCE. After notification and public hearing, as specified by law and after presentation by the Community Development Director, proponents and opponents, the hearing was closed. After due consideration of all evidence presented, the Planning Commission did find as follows with respect to application PLN2014-165. Environmental Findings 1. An Initial Study was prepared for this project that provides the factual basis for concluding that a Negative Declaration should be adopted since no substantial evidence exists, in light of the whole record, that the project may have a significant effect on the environment. 2. The project consists of a Zoning Text Amendment involving revisions to the City's requirements pertaining to emergency shelters and transitional and supportive housing in conformance with Senate Bill 2 (Local Planning Approval for Emergency Shelters and Transitional and Supportive Housing); manufactured housing; single- room occupancy facilities; and updates to definitions in accordance with the City's 2009 - 2014 Housing Element of the General Plan. The Revisions affect Chapter 21.08 (Residential Districts); Section 21.10.080 (M-1) Light Industrial Zoning District; Sections 21.36.085 and 21.36.230; and Section 21.72.020 (Definitions) of the Zoning Ordinance.. 3. The Negative Declaration describes the reasons that the proposed Text Amendment project will not have a significant effect on the environment, and therefore, does not require the preparation of an Environmental Impact Report, pursuant to the California Environmental Quality Act Guidelines. The proposed amendment would not be detrimental to the public interest, health, safety, convenience, or general welfare of the city; and 7. The proposed amendment is internally consistent with other applicable provisions of this Zoning Code. 8. The purpose of the amendment is to provide consistency between SB 2 and the City's Housing Element of the General Plan with the City's Zoning Ordinance. 9. The proposed text amendment will be adopted in compliance with the following General Plan Goals, Policies, and Strategies: Policy LUT-2.4: Jobs and Housing Balance: Maintain Campbell's balance of jobs and housing units to encourage residents to work in Campbell, and to limit the impact on the regional transportation system. Policy LUT-3.1 Variety of Residential Densities: Provide land use categories for and maintenance of a variety of residential densities to offer existing and future residents of all income levels, age groups and special needs sufficient opportunities and choices for locating in Campbell. Strategy LUT-3.1 a: Consistency with Housing Element: Ensure consistency with the City's Housing Element including ensuring that there is adequate land designated to meet Housing goals. Goal LUT-5: Preservation and enhancement of the quality character and land use patterns that support the neighborhood concept. Policy LUT-5.2: Residential Neighborhoods: Maintain safe, attractive, pedestrian friendly residential neighborhoods with identifiable centers and consistent development patterns and a range of public and private services. Policy LUT-13.1: Variety of Uses: Attract and maintain a variety of uses that create an economic balance within the City while maintaining a balance with other community land use needs, such as housing and open space, and while providing high quality services to the community. Goal H-1: Maintain and enhance the quality of existing housing and residential neighborhoods in Campbell. Goal H-2: Improve housing affordability for both renters and homeowners in Campbell. Goal H-3: Encourage the provision of housing affordable to a variety of household income levels. Planning Commission Resolution No. 4163 PLN2014-165 -Text Amendment -Shelters and Transitional Housing Page 4 Goal H-4: Provide adequate housing sites through appropriate land use and zoning designations to accommodate the City's share of regional housing needs. Goal H-5: Minimize the impact of potential governmental constraints on the maintenance, improvement, and development of housing. Policy H-5.3: Revise the City's Zoning Code to clarify provisions for transitional and supportive housing, emergency shelters and Single Room Occupancy (SRO) facilities. Based upon the foregoing findings of fact, the Planning Commission further finds and concludes that: 1. The proposed amendment is consistent with the goals, policies, and actions of the General Plan; 2. The proposed amendment would not be detrimental to the public interest, health, safety, convenience, or general welfare of the City; and 3. The proposed amendment is internally consistent with other applicable provisions of the Zoning Code. THEREFORE, BE IT RESOLVED that the Planning Commission recommends that the City Council approve a Negative Declaration and adopt an Ordinance approving a Zoning Text Amendment (PLN2014-165) involving revisions to the City's requirements for emergency shelters, transitional housing and supportive housing in conformance with Senate Bill 2 (Local Planning Approval for Emergency Shelters and Transitional and Supportive Housing); manufactured housing; single-room occupancy facilities and updates to definitions in accordance with the City's 2009-2014 Housing Element of the General Plan. The revisions affect Chapter 21.08 (Residential Districts); Section 21.10.080 (M-1) Light Industrial Zoning District; Sections 21.36.085 and 21.36.230; and Section 21.72.020 (Definitions) of the Zoning Ordinance, as set forth in Exhibit A.
