PC Res 4171RESOLUTION NO. 4171 BEING A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CAMPBELL RECOMMENDING THE ADOPTION OF A MITIGATED NEGATIVE DECLARATION (PLN2014-144) FORA PLANNED DEVELOPMENT PERMIT (PLN2014-140), VESTING TENTATIVE SUBDIVISION MAP (PLN2014-141), ZONING MAP AMENDMENT (PLN2014-142), AND TREE REMOVAL PERMIT (PLN2014-143) TO ALLOW AMIXED-USE PROJECT CONSISTING OF 16 RESIDENTIAL CONDOMINIUM UNITS AND 3,200 SQUARE FEET OF GROUND FLOOR RETAIL SPACE ON PROPERTIES LOCATED AT 2295 AND 2305 S. WINCHESTER BOULEVARD. After notification and public hearing, as specified by law, and after presentation by the Community Development Director, proponents and opponents, the Planning Commission did determine that the adoption of a Mitigated Negative Declaration provides full and adequate environmental review for approval of a Planned Development Permit (PLN2014- 140), Vesting Tentative Subdivision Map (PLN2014-141), Zoning Map Amendment (PLN2014-142), and Tree Removal Permit (PLN2014-143) to allow the construction of a mixed-use project consisting of 16 residential condominium units and 3,200 square-feet of ground floor retail space. The Planning Commission finds as follows with regard to the Mitigated Negative Declaration: An Initial Study has been prepared for the project which provides documentation for the factual basis for concluding that a Mitigated Negative Declaration may be adopted since no substantial evidence exists, in light of the whole record, that the project may have a significant effect on the environment. The project proposes to allow construction of a mixed-use project with density bonus parking standards (16 residential condominium units and 3,200 square-feet of ground floor retail space) on properties located at 2295 & 2305 S. Winchester Boulevard. 2. The proposed project ("project") is a mixed-use project with density bonus parking standards (16 residential condominium units and 3,200 square-feet of ground floor retail space), as well as removal of existing on-site trees. The project includes applications fora Planned Development Permit (PLN2014-140), Vesting Tentative Subdivision Map (PLN2014-141), Zoning Map Amendment (PLN2014-142) and a Tree Removal Permit (PLN2014-143). 3. The project site is a .56 net acre assemblage of two properties. 4. The project site is generally located at the southwest corner of South Winchester Boulevard and EI Caminito Avenue, abutting asingle-family residence to the west and a small retail center to the south. The project site is zoned P-D (Planned Development) as shown on the Campbell Zoning Map and will be rezoned to C-PD (Condominium Planned Development). 6. The project site is designated Central Commercial as shown on the Campbell General Plan Map. The project site is within the boundaries of the Winchester Boulevard Master Plan. 7. The City of Campbell provided a Notice of Intent to adopt a Mitigated Negative Declaration were filed with the County Clerk-Recorder's Office for public review, noticed in the Campbell Express newspaper, and posted on the City's website. 8. The City of Campbell provided a 20-day public review period of the draft Mitigated Negative Declaration pursuant to the California Environmental Quality Act Guidelines. The 20-day public review period was between October 8 to October 28, 2014. 9. The mitigation measures identified in the Mitigated Negative Declaration are included as Conditions of Approval of the Planned Development Permit. 10. The Mitigated Negative Declaration reflects the independent judgment and analysis of the Planning Commission. Based upon the foregoing findings of fact, the Planning Commission further finds and concludes that: 1. No substantial evidence has been presented from which a reasonable argument could be made that shows that the project, as currently presented and subject to the required Conditions of Approval, will have a significant adverse impact on the environment. 2. The Custodian of the Record for the Mitigated Negative Declaration and Initial Study is the City Clerk of the City of Campbell, located at 70 North First Street, Campbell, California. THEREFORE, BE IT RESOLVED that the Planning Commission recommends the adoption of a Mitigated Negative Declaration (PLN2014-144) (attached Exhibit A) for Planned Development Permit (PLN2014-140), Vesting Tentative Subdivision Map (PLN2014-141), Zoning Map Amendment (PLN2014-142), and Tree Removal Permit (PLN2014-143) to allow the construction of a mixed-use project consisting of 16 residential condominium units and 3,200 square-feet of ground floor retail space. Mitigation Measures Included in the Project to Reduce Potentially Significant Environmental Effects to a Less Than Significant Level: Mitigation Measure AIR-1: The contractor shall implement the following Best Management Practices during construction and demolition activity: • All exposed surfaces (e.g., parking areas, staging areas, soil piles, graded areas, and unpaved access roads) shall be watered two times per day. • All haul trucks transporting soil, sand, or other loose material off-site shall be covered. • All visible mud or dirt track-out onto adjacent public roads shall be removed using wet power vacuum street sweepers at least once per day. The use of dry power sweeping is prohibited. • All vehicle speeds on unpaved roads shall be limited to 15 mph. • All roadways, driveways, and sidewalks to be paved shall be completed as soon as possible. Building pads shall be laid as soon as possible after grading unless seeding or soil binders are used. • Idling times shall be minimized either by shutting equipment off when not in use or reducing the maximum idling time to 5 minutes (as required by the California airborne toxics control measure Title 13, Section 2485 of California Code of Regulations [CCR]). Clear signage shall be provided for construction workers at all access points. • All construction equipment shall be maintained and properly tuned in accordance with manufacturer's specifications. All equipment shall be checked by a certified mechanic and determined to be running in proper condition prior to operation. • Post a publicly visible sign with the telephone number and person to contact at the Lead Agency regarding dust complaints. This person shall respond and take corrective action within 48 hours. The Air District's phone number shall also be visible to ensure compliance with applicable regulations. Dratt Mitigated Negative Declaration Page 3 Any person may file a written protest of the draft Mitigated Negative Declaration before 5:00 p.m. on October 28, 2014. Such protest must be filed at the Community Development Department, City Hall, 70 North First Street, Campbell, California. The written protest should make a "fair argument" that the project will have one or more significant effects on the environment based on substantial evidence.
