PC Res 2852RESOLUTION NO. 2852 BEING A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CAMPBELL APPROVING A MODIFICATION TO A PREVIOUSLY APPROVED USE PERMIT TO ALLOW A MODULAR CLASSROOM ON PROPERTY LOCATED AT 1980 E. HAMILTON AVENUE (FIRST CONGREGATIONAL CHURCH OF SAN JOSE), IN A PF (PUBLIC FACILITIES) ZONING DISTRICT. FILE NO. M 93- 05 After notification and public hearing as specified by law on the application of Ms. Ruth Kaplan, on behalf of Mulberry School, for approval of a modification to a previously approved Use Permit to allow a modular classroom on property located at 1980 E. Hamilton Avenue (First Congregational Church of San Jose), in a PF (Public Facilities) Zoning District, as per the application filed in the Planning Department on March 17, 1993; and, after presentation by the City Staff, proponents and opponents, the hearing was closed. After due consideration of all evidence presented, the Planning Commission finds as follows with regard to Application No. M 93-05: There is adequate parking on-site to accommodate the proposed use. The proposed use is consistent with the existing uses on the property. The structure is set back in excess of 100 feet to the eastern and southern property lines which provides a substantial distance to the nearest residential structures. Based upon the foregoing findings of fact, the Planning Commission further finds and concludes that: The establishment, maintenance, or operation of the use applied for will not be detrimental to the public health, safety, peace, morals, comfort or general welfare of persons residing or working in the neighborhood of such proposed use, or be detrimental or injurious to property and improvements in the neighborhood or to the general welfare of the City. The proposed use compatible with the adjacent land uses. Approval is effective ten days after decision of approval of the Planning Commission, unless an appeal is filed. The applicant is notified as part of this application that he is required to comply with the following Conditions of Approval: SITE AND BUILDING DESIGN 1. Approved Project: Approval of the modification allows a one story 1,330 square feet modular classroom on the easterly portion of the property Resolution No. 2852 M 93-05 -- 1980 E. Hamilton Avenue -- R. Kaplan Adopted on May 11, 1993 Page 2 located at 1980 E. Hamilton Avenue and identified as Assessor's Parcel Number 412-06-039. A. Project drawings for the classroom unit consist of 1 sheet prepared by Edward Janke, dated April 1, 1993. BUILDING CODE Building Permits: Applicant to obtain all necessary building permits prior to construction. Provide handicapped ramp with maximum slope of 1:12. Provide handrail if slope is greater than 1:15. Intermediate landings required for rises exceeding 30". Top landings minimum 60" square. Title 24.3307. Provide an adjacent power pole for (temporary) electrical service. Provide a cross-section of perimeter foundation and other structural support. FIRE DEPARTMENT 6. Buildings shall have automatic fire sprinkler system. 7. Fire alarm system shall be interconnect to existing site facility. Further, the applicant is notified as part of this application that he is required to comply with all applicable Codes and Ordinances of the City of Campbell and the State of California which pertain to this development and are not herein specified.
