PC Res 2856RESOLUTION NO. 2856 BEING A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CAMPBELL APPROVING A CONDITIONAL USE PERMIT TO ALLOW A 24-HOUR BUSINESS OPERATION ON PROPERTY LOCATED AT 10 E. HAMILTON AVENUE IN A C-1-S (NEIGHBORHOOD COMMERCIAL) ZONING DISTRICT. APPLICATION OF MR. D. DOUDS, ON BEHALF OF KINKO'S COPIES; FILE NO. UP 93-06(A) After notification and Public Hearing as specified by law on the application of Mr. David Douds, on behalf of Kinko's Copies, allowing a 24-hour business operation on property located at 10 E. Hamilton Avenue in a C-1-S (Neighborhood Commercial) Zoning District; as per the application filed in the Planning Department on April 15, 1993; and, after presentation by the Planning Director, proponents and opponents, the hearing was closed. After due consideration of all evidence presented, the Planning Commission did find as follows with respect to File No. UP 93-06(a): 1. The proposed copy center is an allowed use in the C-1-S Zoning District. o The location of the proposed business is so situated on the site that the activities of a twenty-four hour operation should not adversely impact adjacent residential uses. o The project site is currently developed with on site improvements such as pre-casted concrete walls, landscaping buffers, and adequate on-site parking to alleviate impact associated with commercial activities. Based upon the foregoing findings of fact, the Planning Commission further finds and concludes that the facts demonstrate that: 1. The establishment, maintenance, or operation of the use applied for will not be detrimental to the public health, safety, peace, morals, comfort or general welfare of persons residing or working in the neighborhood of such proposed use, or be detrimental or injurious to property and improvements in the neighborhood or to the general welfare of the City. The proposed site is adequate in size and shape to accommodate the yards, walls, fences, parking and loading facilities, landscaping and other development features required in order to integrate said use with uses in the surrounding area. o The proposed site is adequately served by streets of sufficient capacity to carry the kind and quantity of traffic such use would generate. Approval is effective ten days after decision of approval of the Planning Commission, subject to the following Conditions of Approval, unless an appeal is filed: 1. Project Approval: Conditional Use Permit approval is granted to allow the establishment of a 24 hour copy center operation in approximately 5,400 square feet of the commercial building located at 10 E. Hamilton Avenue. Project approval shall substantially comply with statement of operation prepared by the applicant. (Planning) Sign Permit: Sign application to be submitted in accordance with provisions of the Sign Ordinance for all signs. No sign to be installed until application is approved and permit issued by Planning and Building Departments (Section 21.53 of the Campbell Municipal Code). (Planning) o Provide minimum of two (2) exits from the structure, UBC T33A (Building) Provide separate handicapped-accessible bathrooms for each sex; number of water closets per UBC, App. 'C' (Building) 5. The automatic sprinkler system must be modified for this space. (Fire) Further, the applicant is notified as part of this application that he is required to comply with all applicable Codes and Ordinances of the City of Campbell and the State of California which pertain to this development and are not herein specified.
